RESOLUTION NO. 2712
A RESOLUTION OF THE TOWN COUNCIL OF THE
TOWN OF TIBURON ACKNOWLEDGING AN ERROR IN
MERGING CERTAIN LOTS ON MAR EAST STREET
WHEREAS, on December 19, 1983, the Tiburon Town Council
authorized the recordation of a "Notice of Merger" of three parcels located
at 2310 and 2312-2314 Mar East Street. Specifically, the "Notice of Merger"
caused the merger of parcels 59-194-42, 59-194-08 and 59-194-70 into a single
lot, and
WHEREAS, the Subdivision Map Act then in effect allowed for merger
only when one of the lots was not legally improved, and
WHEREAS, the Town Council finds that at the time of the merger,
two of the above parcels were then improved with two-family dwellings:
namely, 59-194-08 and 59-194-70,
NOW, THEREFORE, BE IT RESOLVED that the Town Council of the
Town of Tiburon does hereby find that by adoption of this resolution, the
Town Council determines the failure of the Town to comply with the
requirements of the prior law establishing requirements for the merger of
contiguous parcels or units of land held in common ownership. It is the
Council's determination that parcels 59-194-70 and 59-194-08 remain
separate and distinct parcels and that 59-194-42 has properly merged with
59-194-08.
BE IT FURTHER RESOLVED that notice of this determination shall
be provided to the owner of the property and also filed with the County
Recorder.
PASSED AND ADOPTED at a regular meeting of the Town Council
of the Town of Tiburon on .June 6, 1990 by the following vote:
