RESOLUTION NO. 2762
A RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF TIBURON
DENYING A REQUEST FOR AN EXTENSION OF
THE RING MOUNTAIN DEVELOPMENT AGREEMENT
WHEREAS, on February 1, 1984, the Town Council of the Town of Tiburon adopted
Ordinance No. 286 N.S. authorizing execution of the Ring Mountain Development
Agreement which Agreement was executed on February 9, 1984 but did not become effective
until March 1, 1984; and
WHEREAS, the Agreement was for a period of seven (7) years meaning it is due to
expire on March I, 1991; and
WHEREAS, Perini Land & Development Company, the successor in interest to the
original development company, requested a two-year extension of the agreement. This
request was processed pursuant to state law. The Planning Commission reviewed the
request on January 9, 1991, but was unable to reach a recommendation; and
WHEREAS, the Town Council considered the request on February 6, 1991, at a
public hearing. After considering all of the public testimony, documentary evidence and
other exhibits presented, the Council voted 3-1 to adopt a motion denying the request and
allowing all applications deemed complete by the Planning Director prior to March 1, 1991,
to be processed under terms of Ordinance No. 9 N.S. and all amending ordinances.
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of
Tiburon that the request to extend the Ring Mountain Development Agreement is hereby
denied. Be it further resolved that all design review applications for lots in the Ring
Mountain development deemed complete by the Planning Director prior to March 1, 1991,
shall be processed under the terms of Ordinance No.9 N.S. and all amending ordinances,
not Ordinance No. 360 N.S.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of
Tiburon on February 20, 1991, by the following vote:
