A RESOLUTION OF THE TOWN COUNCIL OF THE
TOWN OF TIBURON DENYING AN APPEAL AND
AFFIRMING THE DECISION OF THE BOARD OF
ADJUSTMENTS AND REVIEW APPROVING AN
ADDITION AT 12 MARA VISTA COURT (IN CHon
WHEREAS, on July 5 and August 16, 1990, the Board of Adjustment and
Review (BAR) held duly noticed public hearings to consider an application for an
addition to the residence at 12 Mara Vista Court. After fully considering the
application with revisions and all written and oral evidence, the BAR approved the
application; and
WHEREAS, the BAR's decision was appealed in a timely manner on the
grounds that the addition would adversely affect appellants' views and privacy; and
WHEREAS, the Town Council considered and upheld the appeal on
September 19, 1990. On October 17, the Town Council approved a motion to rehear
the matter and vacated its September 19, 1990, decision; and
WHEREAS, on November 26, 1990, the Town Council again considered the
appeal in a hearing de novo. After considering all of the public testimony,
documentary evidence and all other exhibits presented, the Council found that the
addition did not materially impact views or privacy of the neighbors and denied the
appeal.
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town
of Tiburon that pursuant to Section 19 of the Tiburon Zoning Ordinance, the Board
of Adjustments and Review's approval of the addition to the residence at 12 Mara
Vista Court is hereby affirmed.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Tiburon on .January 16, 1991, by the following vote:
