RESOLUTION NO. 34-2008
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF
TIBURON SUPERSEDING RESOLUTION NOS. 2560 AND 3247
AND RE-ADOPTING WITH AMENDMENTS THE MAR WEST,
ESPERANZA & CENTRO WEST STREET RESIDENTIAL
PARKING PERMIT PROGRAM
WHEREAS, on September 2, 1987, the Town Council established the Mar West
Parking Permit Program through adoption of Resolution No. 2472; and
WHEREAS, said program was amended on November 2, 1988 through adoption
of Resolution No. 2560, and was expanded on October 15, 1997 through adoption of
Resolution No. 3247 to include portions of Esperanza Street and Centro West Street; and
WHEREAS, the Town Council now desires to further amend the Mar West
Parking Permit Program to implement, among other things, various cost recovery and
administrative provisions; and
WHEREAS, on June 18,2008, the Town Council held a hearing on the proposed
amendments and considered any and all testimony received; and
WHEREAS, the Town Council finds and determines as follows:
1. Parking on that portion of Mar West Street between 1645 Mar West Street and
Los Lomas Lane, and on that portion of Centro West Street between
Esperanza Street and Raccoon Lane, continues to be subject to heavy use and
demand from non-resident commuters who work in or visit the downtown
area.
2. Parking on that portion of Esperanza Street between Mar West Street and
Cazadero Lane, and on that portion of Centro West Street between Esperanza
Street and Raccoon Lane, provides only marginally adequate on-street parking
for residents.
3. Continuation of the two hour parking zone and a residential parking permit
program for this area, hereinafter referred to as the "Mar West, Esperanza &
Centro West Street Residential Parking Permit Program," will continue to
, alleviate the parking problems of the residents of those streets.
4. The California Vehicle Code authorizes the Town to adopt a system granting
preferential parking privileges on streets within the Town to residents adjacent
to such streets.

NOW, THEREFORE, THE TOWN COUNCIL ON THE TOWN OF TIBURON
DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. Authoritv. This resolution is adopted pursuant to Section 22507 of
the Vehicle Code of the State of California.
Section 2. Permit System Re-Adopted. The Mar West, Esperanza & Centro
West Street Residential Parking Permit Program is hereby re-adopted with certain
modifications from those provisions adopted in Town Council Resolution Nos. 2560 and
3247. For ease of use, the entire program as modified is set forth below and is
accompanied by a map depicting the geographic area covered by the program. The area
covered by the program is generally described as follows: that portion of Mar West
Street located between 1645 Mar West Street and Las Lomas Lane; that portion of
Esperanza Street between Mar West Street and Cazadero Lane; and that portion of Centro
West Street between Esperanza Street and Raccoon Lane.
Section 3. Parking Restricted. No operator of any vehicle shall stop, stand or
park such vehicle in the area covered by the Mar West, Esperanza & Centro West Street
Residential Parking Permit Program, hereinafter called the "program area", as set forth in
Exhibit "A" attached hereto and made a part of this Resolution, on any day, including
Saturdays, Sundays, and Holidays, for a period of time longer than two hours, between
the hours of 8:00 AM and 10:00 PM, unless a valid Residential, Guest, Party, or
Construction Parking Permit is displayed as specified below for each type of permit.
Section 4.~. Street signs shall notify the public that any vehicle parked in
violation of the parking permit program authorized by this Resolution may be cited
and! or towed.
Section 5. Residential Parking Permits. Residential Parking Permits are to be
affixed to the left rear window of the vehicle.
A. Residents. Residents meeting the following criteria may apply for
Residential Parking Permits at the Police Department:
1. The applicant presents proof of residency within the program area, such as
a property tax bill or utility bill bearing the applicant's name and address
within the program area, or presents a title to property or a lease or rental
agreement for a dwelling unit within the program area, and
2. The applicant presents one of the following:
a) A valid vehicle registration, temporary registration or title bearing the
applicant's name, the name of a family member or domestic partner, or
b) A letter from the registered or legal owner of the vehicle stating the
person is authorized to use the vehicle accompanied by valid vehicle
registration for the vehicle.

B. Dual Residence. Residents of the program area who maintain more than one
household, and whose vehicle or vehicles are registered at an address not located within
the program area, will be entitled to obtain parking permits upon meeting the
requirements of Section 5.A.l., accompanied by a written statement affirming that the
applicant periodically resides in a dwelling unit within the program area, and that said
dwelling unit is not rented to others who occupy the premises to the exclusion of the
applicant.
C. Company Vehicles. Applicants who regularly operate a vehicle
owned!leased by their employer shall, in addition to providing proof of residency,
provide proof of the vehicle assignment by furnishing a letter attesting to the fact, and
signed by an officer or managing agent of the company on company letterhead.
D. Multiple Permit Stickers. A single permit sticker will be issued for each
vehicle registered meeting the requirements of Section 5 .A.l.or Section 5.A.2.
Section 6. Guest Parking Permits. Two Guest Parking Permits for each legally
established dwelling unit will be provided to applicants meeting the conditions described
in Section 5 .A.l.or Section 5.A.2. A Guest Parking Permit is to be suspended from the
interior rear-view mirror of the guest's vehicle while the vehicle is parked in the program
area.
Section 7. Party Parking Permits. Party Parking Permits for each legally
established dwelling unit may be obtained from the Police Department. Residents may
obtain the desired number of temporary guest permits by bringing one of their Guest
Parking Permits to the Police Department during normal business hours. A member of the
department will duplicate the Guest Parking Permit on department letterhead and sign
and date/time the temporary permit for the start of the desired 24 hour period. The Party
Parking Permit is to be displayed on the driver's side dashboard of the party guest's
vehicle. Each Party Parking Permit will be valid for a 24-hour period only.
Section 8. Construction Parking Permits. Construction Parking Permits for each
legally established dwelling unit may be obtained from the Building Division and are to
be displayed on the driver's side dashboard of each construction vehicle. Each
Construction Parking Permit will show the address where work is being done, an
expiration date not to exceed six months from issuance, and will be valid only during
those days and times set forth in Title IV, Chapter 13, Section 13-6 of the Tiburon
Municipal Code. Construction Parking Permits are not valid on Sundays or Holidays
observed by the Town of Tiburon.
Section 9. Bradley House Residents Exempted from Fees. The residents of the
Bradley House (101 Esperanza Street) shall be exempted from paying the fees associated
with the Residential Parking Permit Program, but will be required to obtain the necessary
permits from the Town associated with this program.

Section 10. Fees. The fees for the issuance of the parking stickers and permits
are as follows:

Section 11. Replacement Sticker and Permits. Upon loss, destruction, or theft
of a resident parking sticker or guest parking permit, the Police Department will issue a
replacement sticker or permit with a new number. Any vehicle displaying a permit
previously reported as lost or stolen, or otherwise invalid, is in violation of the program
authorized by this Resolution and is subject to citation and!or towing.
Section 12. Violation. Vehicles parked in violation of the program authorized
by this Resolution are hereby decreed a public nuisance and shall be subject to a fine of
$30.00. The owner/operator of the vehicle is responsible for payment of all towing and
storage fees.
Section 13. Effective Date. The Mar West, Esperanza & Centro West Street
Residential Parking Permit Program as amended and set forth herein shall be effective
immediately upon the passage of this Resolution.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Tiburon on July 16, 2008, by the following vote:
