RESOLUTION NO. 1030
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TIBURON APPROVING THE PACIFIC
TELEPHONE EQUIPMENT BUILDING
WHEREAS, the City Council of the City of Tiburon has considered
a proposal to construct a telephone equipment building on City
property behind the Corporation Yard; and
WHEREAS, the City Council has received a recommendation for
approval from the Planning Commission for the proposed equip-
ment building;
WHEREAS, the City Council has reviewed the environmental impact
of the proposal and has certified a Negative Declaration of Environ-
mental Impact; and
WHEREAS, the Board of Adjustments and Review has recommended
approval of the general design and location of the building.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Tiburon has found that the location and design of the build-
ing is appropriate and finds further that construction of the
building and related undergrounding for telephone cables will
have no significant environmental impact; and
BE IT FURTHER RESOLVED that the City Council of the City of
Tiburon finds that Pacific Telephone's equipment building is approved
subject to the following conditions:
(1) That the final details and landscaping be reviewed and
approved by the Board of Adjustments and Review.
(2) Obtaining a Use Permit as required by the Tiburon Zoning
Ordinance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TIBURON APPOINTING COUNTY TREASURER OF THE
COUNTY OF MARIN AS PAYING AGENT FOR BONDS TO BE
ISSUED IN MIRAFLORES PROJECT ASSESSMENT DISTRICT,
SUPPLEMENTAL ASSESSMENT
The City Council of the City of Tiburon resolves:
The City Council has authorized issuance of bonds in the
principal amount of $105,000.00, to be issued under the Improvement
Act of 1911.
The City of Tiburon has an existing agreement with the
County of Marin by which said County Treasurer of the County of
Marin acts as paying agent for the bonds of the City of Tiburon.
Said fees as set forth on said existing agreement appear
fair and reasonable for the services provided by said County Treasurer
of the County of Marin.
This Council hereby appoints the County Treasurer of the
County of Marin, State of California, as paying agent for the bonds
issued in Miraflores Project Assessment District, Supplemental Assess-
ment, City of Tiburon, Marin County, California, and said County of
Marin shall be paid in accordance with the existing agreement between
said City of Tiburon and the County of Marin.
The City Clerk of the City of Tiburon is hereby directed
to file a certified copy of this resolution with the County Treasurer
of the County of Marin.

RESOLUTION NO. 1028
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TIBURON APPROVING REPORT AND ASSESSMENT AND
ORDERING SUPPLEMENTAL ASSESSMENT, MIRAFLORES
PROJECT ASSESSMENT DISTRICT, SUPPLEMENTAL
ASSESSMENT
The City Council of the City of Tiburon resolves:
This City Council has taken a series of actions preliminary
to ordering the supplemental assessment in Miraflores Project Assess-
ment District, Supplemental Assessment, City of Tiburon, Marin County,
California, and now makes the following findings and orders:
l. The City Council adopted its resolution of intention
in the matter of the supplemental assessment described therein under
the Municipal Improvement Act of 1913, and directed Oberkamper &
Associates Civil Engineers, as Engineer of Work for the assessment
district, to prepare the report required by Section l0204 of the
Streets and Highways Code.
The improvement is generally described as follows:
Additional costs and related incidental expenses
in connection with the Miraflores Project Assess-
ment District relating to the street work, the
water system, slide correction work, drainage
improvements and the acquisition of the water
system, the costs of which were in excess of the
amounts stated in the Amended Engineer's Report
approved by the City Council of the City of
Tiburon on August 22, 1977.
2. The Engineer of Work filed the report as directed, and
the City Council called a hearing on the report as required by
Section l030l of the Streets and Highways Code. Notice of the
hearing was given by publication, by street posting and. by mail-
ingto affected property owners, all according to the Municipal
Improvement Act of 1913. Affidavits of publication, posting
and mailing were filed with the City Clerk.
3. At the time and place for which notice was given, the
City Council conducted a public hearing and gave every in.terested
person an opportunity to object to the proposed supplemental assess-
ment.
4. The City Council finds that the written protests
against the proposed supplemental assessment have not been made by
owners representing more than one-half of the area of the land to
be assessed for the supplemental assessment.

6. The City Council approves the Engineer's Report and each
component part of it, including each exhibit incorporated by refer-
ence in the report.
7. The City Council finds that the Engineer of Work, in
the Report, has fairly and properly apportioned the cost of the
improvement to each parcel of land in the assessment district in
proportion to the estimated benefits to be received by each par-
cel, respectively, from the improvement. The City Council hereby
confirms and levies each individual assessment as stated in the
Engineer's Report.
8. This City Council orders the improvement described
in paragraph 1 and as detailed in the Engineer's Report.
9. Serial bonds representing unpaid assessments of
fifty dollars ($50) or more, and bearing interest at a rate not
to exceed eight percent (8%) per annum, will be issued in the
manner provided in the Improvement Act of 1911 (Part 5 of Division
7, Streets and Highways Code), and the last installment of the
bonds shall mature eighteen (18) years from the second day of
January next succeeding the next September lst following their
date.
10. According to Section 10603 of the Streets and Highways
Code, the City Council designates the County Treasurer of the County
of Marin to collect and receive payment of the assessments.
ll. If, on completion of the improvement and payment of all
costs, any surplus remains in the improvement fund for the assessment
district, the su~plus shall be distributed in accordance with Section
10427 of the'Streets and Highways Code.

RESOLUTION NO. 1027
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TIBURON ESTABLISHING A FEE FOR
THE LICENSING OF BICYCLES
WHEREAS, the Tiburon City Council adopted Ordinance No.
205 N.S. establishing regulations for the licensing of bicycles;
and
WHEREAS, the Tiburon City Code requires that fees be esta-
blished by Resolution of the City Council;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
Ci ty of Tiburon does hereby fix the bicycle licensing fee at
the sum of ~3.00.

RESOLUTION NO. 1026
A RESOLUTION OF INTENT OF THE CITY COUNCIL
OF THE CITY OF TIBURON TO IMPLEMENT THE
WATER QUALITY PORTIONS OF THE ABAG ENVIRON-
MENTAL MANAGEMENT PLAN
WHEREAS, the Association of Bay Area Governments (ABAG)
was designated by the U.S. Environmental Protection Agency
(EPA) and State Water Resources Control Board (SWRCB) to pre-
pare an Environmental Management Plan (EMP) for the San Fran-
cisco Bay Area;
WHEREAS, ABAG has prepared an initial EMP that includes
water quality, air quality, solid waste management and water
supply elements;
WHEREAS, the water quality element of the EMP contains
policies and actions for surface runoff that were developed by
the counties of the Bay Area;
WHEREAS, ABAG has received more than 1,500 pages of public
comment on the draft EMP, and these have been considered fully
by the responsible ABAG approving bodies;
WHEREAS, the initial EMP has been reviewed, modified and
approved by the ABAG Environmental Management Task Force,
Regional Planning Committee, Executive Board, and General
Assembly;
WHEREAS, the City of Tiburon has reviewed the initial EMP;
WHEREAS, EPA and SWRCB policy is that significant water
quality management agencies named in the EMP must indicate
their willingness to implement the EMP before EPA and SWRCB can
give unconditional approval and/or certification to the initial
EMP;
WHEREAS, the City of Tiburon is a significant management
agency for the purpose of implementing portions of the initial
EMP relating to water quality;
WHEREAS, flexibility in implementation of the initial EMP
is implicit in the plan so as to include good faith efforts to
implement;
WHEREAS, ABAG has developed a continuing planning process
so that the initial EMP can be updated and revised on a regular
basis;
WHEREAS, although additional local expenditures resulting
directly from the EMP are not large relative to previous or
ongoing environmental management activities, local government
fiscal resources are strained by the Statewide passage of
Proposition 13 on June 6, 1978;

NOW, THEREFORE, BE IT RESOLVED that the City of Tiburon
approves and adopts the water quality portions of the initial
EMP for implementation; and
BE IT FURTHER RESOLVED that the City of Tiburon agrees to
proceed with a good faith effort to implement those portions of
the initial EMP relating to water quality
that are within this jurisdiction's responsibility; and
BE IT FURTHER RESOLVED that the City of Tiburon agrees to
seek adequate legal authority if it does not currently have power
to implement any portion of the water quality plan for which it
has been given implementation responsibility; and
BE IT FURTHER RESOLVED that implementation of actions
financed wholly or in part by Federal and/or State funds will be
conditioned on the availability of that money; and
BE IT FURTHER RESOLVED that the City of Tiburon, because of
the impact of Proposition 13, reserves the right to postpone
implementing any provision in the EMP involving additional local
expenditures; and
BE IT FURTHER RESOLVED that the City of Tiburon will seek
to modify the initial EMP as appropriate during the continuing
planning process if implementation does not proceed according to
the EMP's approved schedule; and
BE IT FURTHER RESOLVED that this resolution is entered into
on the condition that the water quality portion of the initial
EMP will be certified without change by the State.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TIBURON APPROVING FIVE (5) YEAR
FEDERAL-AID URBAN PROGRAM AS RECOMMENDED
BY THE MARIN COUNTY URBAN SYSTEM COMMIT-
TEE BEGINNING 1979-80
WHEREAS, the City of Tiburon desires to continue to
participate in the Federal-Aid Urban Program for funding approved
transportation projects as authorized by the Federal Highway
Act of 1973 and succeeding amendments; and
WHEREAS, the Federal Highway Act, the State Transportation
Board and the Metropolitan Transportation Commission required
that a program of projects approved for Federal-Aid Urban funding,
be established by a Countywide Committee consisting of represent-
atives from each City, the County, Transit District, California
Department of Transportation, Golden Gate Bridge District, and
the Metropolitan Transportation Commission; and
WHEREAS, the Board of Supervisors has approved procedures
for the Federal-Aid Urban Program and the formation of the Marin
County Urban System Committee; and
WHEREAS, the Marin County Urban System Committee did meet
to review the program and new projects which had been submitted
for consideration as part of a five-year program; and
WHEREAS, the Marin County Urban System Committee did approve
a five-year Federal-Aid Urban Program on November 29, 1978;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Tiburon does hereby approve the five-year Federal-Aid
Urban Program of projects beginning 1979-80 recommended by the
Marin County Urban System Committee as follows:

RESOLUTION NO. 1024
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TIBURON APPROVING PRECISE
PLAN FOR THE FRANK HOWARD ALLEN
BUILDING AT 1660 TIBURON BOULEVARD
WHEREAS, the Planning Commission of the City of Tiburon has received and
considered the amended Master Plan drawings submitted by the Frank Howard Allen
Company for a commercial and office building to be located at 1660 Tiburon
Boulevard, and
WHEREAS, the Planning Commission and the City Council have approved
the Master Plan for said building; and
WHEREAS, the Planning Commission has reviewed the Precise Plan drawings
for the said building and has found them to be in conformance with the approved
Master Plan as submitted to the City, and has recommended in Resolution 264 the
approval of the Precise Plan;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Tiburon has found that the Precise Plan drawings are in substantial conformance
with the Master Plan for the Frank Howard Allen Building at 1660 Tiburon Boulevard,
and further a~proves the Precise Plan subject to the following conditions:
1. That the building be sited as shown on drawings dated
August 29, 1978 by Gilbert Murphy [1 Associates.
2. That the requirements for both interior and exterior fire
protection systems submitted to the City by the Tiburon Fire
Protection District be met.
3. That applicable drainage fees be paid.
4, That the drainage plan and tie-in to existing storm drainage
systems be approved by the City Engineer as in conformance with
the Downtown Drainage Plan.
5. That the color scheme for the building shall be reviewed and approved
by the Board of Adjustments and Review.
6. That the landscaping as shown on the Precise Plan drawings, attached
hereto as Exhibit "A", be installed prior to occupancy of the building,
and that maintenance of said landscaping shall be insured by a bond
satisfactory to the Department of Community Development.
7. That a final landscaping plan shall be approved by the Board of
Adjustments and Design Review.
8, That a Master Plan for all signs, lighting and fencing for the building
be submitted to and approved by the Board of Adjustments and Design
Review prior to occupancy of the building.
9, That all of the conditions of the Master Plan be met.

10. That the pedestrian access be provided from Juanita Lane to
Tiburon Boulevard with proper paving and openings in landscaping,
as shown on Precise Plan drawing.
11. No barrier be placed across entrances/exits to parking without
prior approval of City Council.
12. That the Director of Community Development insure that trees on
Juanita Lane do not obstruct traffic.
This Resolution shall become effective on the effective date of Ordinance
No. 206 adopted September 20, 1978 by the City Council of the City of Tiburon.

Gentlemen:
We hereby tender you a bid for all, but not less than all, of the
bonds to be issued pursuant to the provisions of the improvement
Act of 1911 (based upon proceedings to be taken pursuant to the
provisions of the Municipal Improvement Act of 1913), which
bonds are to be issued to represent the cost of the improvements
and acquisitions to be made in Miraflores Project Assessment
District, Bond Series 1978, City of Tiburon, Marin County,
California.
We will pay:
Ninety-five percent (95.00%) of the total par value
of the bonds to be issued in said proceedings, with
accrued interest.
This bid is made to you upon the basis that said bonds shall mature
in- nineteen (19) equal annual installments commencing January 2,
1980; that they shall bear interest at the rate of eight percent (8%)
per annum; that they shall be payable to bearer; that upon redemption
the property owner must pay five percent (5%) of the then unmatured
principal as premium; and that they will be dated no later than
December 15, 1978, and will be delivered to the undersigned at the
City Offices in Tiburon, California.

We further agree to take delivery of, and pay for, said bonds when
said bonds are ready for delivery; that we will purchase and take
delivery of bonds for an amount not to exceed $105,000.00.
This bid is, furthermore, made on the condition that the bonds will
be accompanied by the legal opinion of Sturgis, Ness & Brunsell a
professional corporation, Attorneys at Law, Emeryville, California,
approving the legality of said bond s and the proceedings leading up
to the issuance thereof, without qualification and without expense
to us.

OF TIBURON ACCEPTING REPORT AND SETTING HEARING
OF PROTESTS
MIRAFLORES PROJECT.ASSESSMENT DISTRICT,
SUPPLEMENTAL ASSESSMENT
The City Council of the City of Tiburon resolves:
1. At the direction of this City Council, OBERKAMPER &
ASSOCIATES CIVIL ENGINEERS, INC., Engineer of Work for improvement
proceedings in Miraflores Project Assessment District, Supplemental
Assessment, City of Tiburon, Marin County, California, has filed with
the City Clerk the report described in Section 10204 of the Streets and
Highways Code (Municipal Improvement Act of 1913). This Council accepts
the report without modification, for the purpose of conducting a hearing
of protests to the supplemental assessment described in the report.
2. This Council sets 8:00 P.M. on Wednesday, December 6,

A RESOLUTION OF INTENTION OF THE CITY COUNCIL
OF THE CITY OF TIBURON IN THE MATTER OF A
SUPPLEMENTAL ASSESSMENT FOR MIRAFLORES PROJECT
ASSESSMENT DISTRICT, CITY OF TIBURON, MARIN
COUNTY, CALIFORNIA
WHEREAS, on the 11th day of July, 1977, the City Council of
the City of Tiburon, Marin County, California, adopted its Resolution
of Intention No. 919 for the acquisition and/or construction of streets
in the Miraflores Project Assessment District, City of Tiburon, Marin
County, California; and
WHEREAS, a special assessment for said purpose was levied by
the City Council on the 22nd day of August, 1977; and
WHEREAS, since the levy of said assessment, it has been deter-
mined that the costs and related incidental expenses in connection with
the Miraflores Project Assessment District relating to the street work,
the water system, slide correction work, drainage improvements and the
acquisition of the water system, were in excess of the amounts stated in
the Amended Engineer's Report approved by the City Council on the 22nd
day of August, 1977,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Tiburon, Marin County, California, that it is the intention of said
City Council to levy a supplemental assessment in Miraflores Project
Assessment District to provide for the additional costs and expenses
set forth above, pursuant to Sections 10425 and 10426 of the Streets and
Highways Code of the State of California.
Reference is hereby made to Resolution of Intention No. 919,
adopted by the City Council of the City of Tiburon on the 11th day of
July, 1977, and proceedings subsequent thereto, for all details as to
plans and specifications for the work and property subject to assessment.
NOTICE IS HEREBY GIVEN that serial bonds to represent unpaid
assessments and bearing interest at a rate of not to exceed eight per
cent (8%) per annum shall be issued herein in the manner and form pro-
vided in Part 5, Division 7 of the Streets and Highways Code of the
State of California (Improvement Act of 1911) to represent unpaid
assessments of Fifty Dollars ($50.00) or over, the last installment of
which bonds shall mature eighteen (18) years from the 2nd day of January
next succeeding the next September 1st following their date. Said bonds
shall be payable to bearer, and may be redeemed as provided in the Im-
provement Act of 1911, and there shall be added to the redemption clause
in said bonds the following words:
"...together with a premium of five percent (5%) of
the unmatured principal."
In case of default, there shall be added to the defaulted
amount one percent (1%) of the amount thereof, and on the first day of
each month following such default there shall be added a further penalty
of one percent (1%) of such defaulted amount. The one percent (1%) penalty

first imposed shall be retained by the Treasurer as a cost of servicing
the delinquency and all subsequent penalties shall be paid to the holder
of the bond along with and as a part of such defaulted payment; and
proceedings for said supplemental assessment shall be taken
pursuant to the Municipal Improvement Act of 1913 and the bonds herein-
above described shall be issued under the provisions of the Improvement
Act of 1911 as heretofore described.
BE IT FURTHER RESOLVED that the matter of a supplemental assess-
ment herein referred to is hereby referred to OBERKAMPER & ASSOCIATES
CIVIL ENGINEERS, INC., Engineer of Work for Miraflores Project Assessment
District, and they are hereby directed to make and file with the City Clerk
of the City of Tiburon a report in writing containing the following:
a. An estimate of the additional costs herein described
and incidental expenses in connection with said costs,
in excess of the Amended Engineer's Report heretofore
filed on August 22, 1977, and approved by the City
Council on August 22, 1977.
b. A proposed assessment of the total amount of said addi-
tional costs and expenses upon the several subdivisions
of land in the district in proportion to the estimated
benefits to be received by such subdivisions, respec-
tively, from the improvements and acquisitions.

reviewed said Element and has found it to be in conformance with the

of Tiburon and has recommended its adoption by Planning Commission Resolution
No. 265, and
WHEREAS, the City Council of the City of Tiburon has held a Public
Hearing on October 18, 1978 on the Environmental Hazards Element and has

A RESOLUTION OF THE CI'IY COUNCIL OF THE CITY OF TIBURON
CONSENTING TO THE CONDEMNATION OF A PRIVATE SANITIARY
SEWER EASEMENT IN A PORTION OF ANTONETTE DRIVE, TIBURON
WHEREAS, the owners of that property identified as Marin County
Assessor's Parcel No. 38-111-17, lying within the City of Tiburon
and the bOillldaries of Sanitary District No.2, have received a building
permi t from the City of Tiburon to construct a house on said property,
and
WHEREAS, Sanitary District No. 2's regulations prohibit construction
of individual sewage disposal systems and require new buildings to be
connected to a public sewer, and
WHEREAS, the nearest public sewer lS located In Paradise Drive at
Antilles Way, and
WHEREAS, that roadway easement known as Antonette Drive lS the most
logical route between said parcel and Paradise Drive, and
WHEREAS, the owners of said parcel have indicated their intent to
file a complaint in eminent domain pursuant to Civil Code Section 1001
and Code of Civil Procedure Section 1245.325 to acquire the right to
construct a private sewer line in that portion of Antonette Drive more
particularly described in Exhibit "A" attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF TIBURON, MARIN COUNTY,
CALIFORNIA:
A. The following findings are made In regard to the intended complaint
In eminent domain:
1. There is a great necessity for the taking in that there is no
existing public route or sanitary sewer easement available to
serve the parcel.
2. The location of the proposed easement affords the most reasonable
service to the property to which it will be appurtenant, consistent
with the least damage to the burdened property in that disturbance
of a roadway area is normal for sanitary sewer construction and
readily repairable.
3. The hardships to the owners of the appurtenant property Cinabili ty
to occupy a house on the property) if the taking is not permitted,
clearly outweighs any hardship to the owners of the burdened
property (sewer line usage of an existing road) pursuant to Code
of Civil Procedure Section 1245.325.
B. The City consents to the condemnation of that sanitary sewer easement
described in the attached exhibit "A".

INSTALLATION OF SAFETY IMPROVEMENTS
BY CAL/TRANS FOR STATE HIGHWAY 131
(TIBURON BOULEVARD) FROM THE VICINITY
OF REED RANCH ROAD THROUGH THE STEWART
DRIVE INTERSECTION
WHEREAS, the City of Tiburon and CAL/TRANS have been con-
sidering needed safety improvements for Highway 131 (Tiburon
Boulevard) in the vicinity of the Trestle Glen intersection
for several years; and
WHEREAS, completion of said improvements will provide sub-
stantial safeguards to both motorists, cyclists, and pedestrians
who regularly utilize this section of Tiburon Boulevard; and
WHEREAS, after consideration of various realignment and safety
improvement alternatives by CAL/TRANS and the City of Tiburon
there now appears to be general acceptance of a roadway improvement
plan within the current alignment of Tiburon Boulevard between the
vicinity of Reed Ranch Road and Stewart Drive; and
WHEREAS, the Marin County Urban System Committee's Project
Priority Subcommittee will meet in October 1978 to prepare its FAU
project priority recommendations for submittal to the full Committee;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Tiburon does hereby reaffirm its support for those Tiburon
Boulevard safety improvements from the vicinity of Reed Ranch Road
through Stewart Drive, as shown schematically in CAL/TRANS' Plans
A and 8 which were recently discussed by representatives from CAL/
TRANS and the City of Tiburon, including traffic signals at the Stewart
Drive intersection as provided for in Plan A; and the City further
strongly urges that signals be provided at Reed Ranch Road and that the
two eastbound lanes be merged to one lane west of Reed Ranch Road; and
BE IT FURTHER RESOLVED that the City of Tiburon does strongly
request that CAL/TRANS support said safety improvements, both
financially and verbally, at the forthcoming Federal Aid Urban System
Committee meetings in Marin County.

WHEREAS, a tentative map has been submitted to complete the condominium
conversion process as set forth in Section 10-7.1 of the Tiburon Zoning Ordinance.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby approve
the tentative map as Exhibit "A", subject to the following conditions:
1. That all conditions listed in Resolution No. 261 are met
prior to parcel map recordation (Exhibit "B"), with an
amendment to the City Engineer's letter of July 27, 1978,

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TIBURON DECLARING A PUBLIC
NUISANCE AND ORDERING ITS ABATEMENT
WHEREAS, pursuant to Section 38773 of the Government Code
of the State of California, the City Council of the City of
Tiburon did adopt Ordinance No. 59, to provide for the abatement
of any nuisance and establishing procedures thereof; and
WHEREAS, 'it has been found that unauthorized grading has
taken place on property at 285 Roundhill Road, being Lot #7
of the Smith Ridge Estates; and
WHEREAS, the unauthorized grading has resulted in an encroach-
ment upon City Open Space property; and
WHEREAS, the aforementioned unauthorized grading is detrimental
to the public health, safety and welfare of the citizens of Tiburon,
in that unless remedial action is taken in the near future, damage
to the City Open Space will become permanent; and
WHEREAS, a hearing on this matter was held on September 6, 1978,
and the owners of subject property failed to appear; and
WHEREAS, the City Council authorized staff to prepare a resolu-
tion declaring a public nuisance and ordering its abatement; and
WHEREAS, the owners of subject property have commenced the
repair of the property but have not completed the repair in con-
formance with a proper engineering solution;
NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the
City of Tiburon finds and does declare that the unauthorized
grading on that certain property at 285 Round Hill Road resulting
in damage to adjacent City Open Space is a public nuisance and
it does order that if repairs are not complete to the satisfaction
of the City by October 20, 1978, the City Engineer shall abate the
subject nuisance, and further, that the City Council of the City
of Tiburon does order that the costs of the abatement will be assessed
upon the above described property and shall constitute a lien upon
such property unnil paid.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TIBURON GRANTING A TEMPORARY USE
PERMIT TO THE SOUTHERN PACIFIC RAILROAD
TO OPERATE A PARKING LOT IN DOWNTOWN
TIBURON SUBJECT TO CERTAIN CONDITIONS
WHEREAS, the Southern Pacific Railroad, through its agents and
subsidiaries has operated a temporary parking facility for approximately 100
cars in downtown Tiburon since 1968; and
WHEREAS, the said Railroad has requested that the Use Permit be
renewed; and
WHEREAS, the City has determined that certain conditions should be
imposed on the granting of a Use Permit concerning the operations of said
parking lot;
NOW, THEREFORE, BE IT RESOLVED that the City of Tiburon does grant
to the Southern Pacific Railroad, or its agents, a Use Permit to operate a
parking lot for 350 cars on its property in downtown Tiburon under the following
conditions:
1, That the said Use Permit shall expire one year from the date
of this Resolution,

2, That the landscaping and fencing be maintained in a neat,
healthy, and weed-free condition satisfactory to the Director
of Community Development.
3, That at least 4 handicapped stalls a minimum of 12 feet wide
shall be provided near pedestrian exits without obstruction.
4. That no valet parking be permitted in the lot.
5. That the old Fig Tree and the old Palm Tree, both in the area
of the lot, be protected.
6. That the City may place bicycle racks in and around the lot for
the use of commuters and tourists.
7. That the lot be maintained in a neat, orderly and proper manner.
8. That no parking be permitted outside the area designated on the
Northwestern Pacific Roalroad drawing T-24426, attached to
Resolution No. 851.
9, Failure to meet the conditions shall result in the revocation of
this Use Permit upon 30 days notice to the Railroad by the City.

AFFECTED PROPERTY OWNERS TO THE UNDERGROUND
UTILITIES ALONG TIBURON BOULEVARD BETWEEN
ROCK HILL ROAD AND SAN RAFAEL AVENUE
WHEREAS, in November 1977, the Tiburon City Council desig-
nated the area along Tiburon Boulevard, between Rock Hill Road
and San Rafael Avenue'as an Underground Utility District; and
WHEREAS, the Tiburon City Code 'provides that the City Council
shall fix the time within which such removal and utility under-
ground installation shall be accomplished; and
WHEREAS, the City Council previously noted its future
intent to select a date to be determined as the date upon which
affected property owners must be ready to receive underground
service; and
WHEREAS, the City has noticed its intent to adopt a Negative
Declaration of Environmental Impact in connection with such
undergrounding pursuant to CEQA; and
WHEREAS, the noticing of public hearing has been given to
all affected property owners and such hearing has been duly and
regularly held;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Tiburon does hereby establish February 1, 1979, as the
date of completion for the utility undergrounding project along
Tiburon Boulevard between Rock Hill Road and San Rafael Avenue;
and
BE IT FURTHER RESOLVED that the City Council designates
March 1, 1979, as the deadline for which the affected property
owners within the Underground Utility District must be ready to
receive the Underground Utility service.

RESOLUTION NO. 1011
RESOLUTION OF NECESSITY FOR CONDEMNATION
WHEREAS, the City Council of the City of Tiburon has pro-
cessed to completion proceedings under the Municipal Improvement
Act of 1913 (Sections 10000 and following, California Streets and
Highways Code) for an assessment district known as Miraflores
Project Assessment District, together with issuance and sale of
improvement bonds under the Improvement Act of 1911 (Sections
5000 and following, Streets and Highways Code, and specifically
sections 6400 and following pertaining to said bonds); and
WHEREAS, the work being undertaken by said proceedings
includes, among other items, earthslide preventive and correc-
tive work on city open space property and adjacent property
downhill in the Miraflores Project subdivision; and
WHEREAS, during the course of performing this soils work,
in connection with the Miraflores Project Assessment District, an
earthsl~de has occurred upon a portion of certain real property
contiguous to and uphill from the subject city open space property;
and
WHEREAS, R. H. Wayne Agency, Ltd., a California corporation,
is the record owner of the fee title of that uphill property, includ-
ing the portion described in Exhibit A attached hereto and by reference
incorporated herein; and
WHEREAS, the public interest and necessity require acquisition
of a permanent slope easement for the purpose of performing the pro-
posed earthwork on said parcel; and
WHEREAS, in anticipation of commencement of an eminent domain
proceeding to acquire said easement, this Council has on this date
conducted the noticed hearing required by Section 1245.235 of the
California Code of Civil Procedure, following notice of hearing as
required to both the property owners and their attorney; and
WHEREAS, on the basis of the evidence presented, this Council
has made the findings and determinations specified by subparagraph
(c) of Section 1245.230 of said Code of Civil Procedure,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Tiburon, Marin County, California, as follows:
Section 1. The foregoing recitals are true and correct.
Section 2. This resolution is adopted pursuant to Section
1245.230 of said Code of Civil Procedure.
Section 3. All actions precedent to the adoption of this reso-
lution have been taken in the time and manner required by law.
Section 4. The public interest and necessity require the per-
formance of the earthwork proposed for the subject parcel.

Section 5. The said project is planned and located in the
manner that will be most compatible with the greatest public good
and the least private injury.
Section 6. The permanent slope easement respecting the pro-
perty described in Exhibit A is necessary for the proposed project.
Section 7. Special counsel is authorized and directed to
file an action in eminent domain for acquisition by the City of the
permanent slope easement respecting the property described in
Exhibit Ai to take steps necessary to obtain possession of the
easement prior to judgmenti and to do all other acts required to
acquire the easement in the name of the City.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TIBURON APPROVING THE
APPLICATION FOR GRANT FUNDS UNDER THE
ROBERTI-Z'BERG URBAN OPEN SPACE AND
RECREATION PROGRAM
WHEREAS, the legislature of the State of California has enacted
the Roberti-Z'Berg Urban Open Space and Recreation Program, which
provides funds to certain political subdivisions of the State of
California for acquiring lands and for developing facilities to
meet urban recreation needs; and
WHEREAS, the State Department of Parks and Recreation has been
delegated the responsibility for the administration of the program,
setting up necessary procedures governing application by local
agencies under the program; and
WHEREAS, said procedures established by the State Department
of Parks and Recreation require the applicant to certify by resolu-
tion the approval of applications prior to submission of said
applications to the state; and
WHEREAS, said applications contain a certification that the
applicant will comply with all federal, state, and local environ-
mental, public health, relocation, affirmative actio-, and clear-
inghouse requirements and all other appropriate codes, laws and
regulations prior to the expenditure of the grant funds; and
WHEREAS, the project(s) applied for under this program must
be of a high priority and satisfy the most urgent park and recrea-
tion needs with emphasis on unmet needs in the most heavily pop-
ulated areas;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Tiburon does hereby:
1. Approves the filing of an application for funding under
the Roberti-Z'Berg Urban Open Space and Recreation Program;
and
2. Certifies that said agency understands the general provisions
of the agreement; and
3. Certifies that said agency has or will have sufficient funds
to operate and maintain the project(s) funded under this
program; and
4. Certifies that said agency has or will have available prior
to commencement of any work on the project(s) included
in this application matching money from a nonstate source;
and
5. Certifies that the project(s) included in this application
conform to the recreation element of the applicable city
or county general plan; and

6. Appoints the City Manager as agent of the City of Tiburon
to conduct all negotiations, execute and submit all docu-
ments including, but not limited to, applications, agree-
ments, amendments, payment requests, and so on which may be
necessary for the completion of the aforementioned project(s);
and
7. Appoints City Attorney as legal counsel for said agency
with authorization to sign the certification on page 1 of
application.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TIBURON PROPOSING A 1978 AYALA
DAY SPORTS CHALLENGE TO THE CITY OF
BELVEDERE
WHEREAS, the Cities of Belvedere and Tiburon met for the
first (sporting) time in December 1974 on the Del Mar gridiron;
and
WHEREAS, the two Tiburon Peninsula cities competed again
during the 1976 Bicentennial festivities in a challenging tug-
of-war contest; and
WHEREAS, these same cities competed again at the 1977 Ayala
Day festivities in a scrappy volleyball contest; and
WHEREAS, in the continuing spirit of good sportsmanship,
an offer is now extended to the City of Belvedere to consider
again participating in a suitable sporting contest; and
WHEREAS, in accordance with the rules of proper gamemanship,
a rematch of last year's game may be appropriate;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Tiburon does hereby challenge the City of Belvedere to
a volleyball contest, and that a desireable date and location
would be Ayala Day 1978 on Angel Island.

CITY OF TIBURON ADOPTING THE CITY OF
TIBURON'S 1978-79 OPEN SPACE BOND TAX
RATE AS COMPUTED BY THE MARIN COUNTY
AUDITOR/CONTROLLER
WHEREAS, in 1972 the City of Tiburon approved the issuance
of bonds for the preservation of open space on the Tiburon Peninsula,
and
WHEREAS, prior to Proposition 13, each fiscal year the City
of Tiburon computed and approved the City's tax rate for the open
space bonds, and
WHEREAS, all general obligation tax rates must now be audited
by the County of Marin Auditor/Controller, and
WHEREAS, the County of Marin Auditor/Controller's office
has computed the City's Open Space Bond Tax Rate for 1978-79 based
upon current assessed valuation,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Tiburon does hereby fix the 1978-79 Open Space Bond Tax
Rate upon secured and unsecured property within the City of Tiburon
at $.137 upon each one hundred dollars ($100) of assessed valuation.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TIBURON ADOPTING THE MUNICIPAL
BUDGET FOR FISCAL YEAR 1978-79
WHEREAS, the City Council now finds that the proposed
Municipal Budget as amended provides for all appropriate muni-
cipal purposes and services within the current resources and
anticipated revenues for fiscal year 1978-79.
NOW, THEREFORE, BE IT RESOLVED that said budget is hereby
approved and adopted as the Municipal Budget for the City of
Tiburon for fiscal year 1978-79, and all expenditures, encum-
brances, transfers and appropriations set forth therein are also
approved; and
THAT, the City Manager may make adjustments between func-
tions and activities within the budget provided that no increase
or diminishment in salaries result other than that provided
for by the personnel system and master salary program, and provided
that no expenditure or encumbrance contingent on contract, agree-
ment, or other engagement requiring approval of the City Council
shall be made until such contract, agreement, or other engagement
is first approved by the City Council.

granting Donald and Sharon Ham a Use Permit to convert three
units to condominiums; and
WHEREAS, a Tentative Parcel Map has been submitted to com-
plete the condominium conversion process as set forth in Section
10-7.1 of the Tiburon Zoning Ordinance; and
WHEREAS, the Planning Commission did on June 21, 1978,
adopt Resolution No. 259 recommending approval of said subdivision
map;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the

WHEREAS, the Planning Commission passed Resolution No. 249
granting Maxine Coplin a Use Permit to convert a duplex to a
condominium; and
WHEREAS, a Tentative Parcel Map has been submitted to complete
the condominium conversion process as set forth in Section 10-7.1
of the Tiburon Zoning Ordinance; and
WHEREAS, the Planning Commission did on June 21, 1978, adopt
Resolution No. 260 recommending approval of said Tentative Parcel
Map;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Tiburon does hereby approve the Tentative Map as Exhibit
A subject to the following conditions:
1. That all the conditions listed in Resolution No. 249
of the Planning Commission are met prior to Parcel Map
recordation (Exhibit B) .
2. That the applicant obtain an encroachment permit and that
all the conditions set forth in the granting of said
permit be met prior to Parcel Map recordation.
3. That curb, gutter and a four foot wide sidewalk be installed
for the full length of the property; all work to be performed
to the satisfaction of the Superintendent of Public Works
and in conformance to the City's standards.
4. That the drainage pipe be extended to the bottom of the
cliff with an energy dissipator to be provided at the
end of the pipe.
5. That permanent access to the drainage pipe for maintenance
and future replacement be provided.
6. That in-lieu park and recreation fees of $500 shall be
paid to the City of Tiburon in accordance with the
applicable ordinance and prior to recordation of the
Parcel Map.
7. That all other applicable fees for subdivision shall be
paid prior to Parcel Map recordation.

RESOLUTION NO. 1002
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TIBURON APPROVING THE TENTATIVE PARCEL MAP
FOR MASTER PLAN LOCATED AT ASSESSOR'S PARCEL
39-070-03 (WILKINS COURT)
WHEREAS: Mr. Don Brooks has submitted a Master Plan for development of 1.97
acres of land located in the RPD-l zone.
WHEREAS: The City Council on July 10,1978, adopted Ordinance No. 198 N.S.,
conditionally approving the Master Plan located at Assessor's Parcel 39-070-03 and
exempting the Master Plan from Precise Plan procedures as allowed by Section 10-4
(G)b of the Tiburon Zoning Ordinance, and
WHEREAS: Mr. Don Brooks has submitted a Tentative Parcel Map for development
of 1.97 acres located in the RPD-l zone on March 17, 1978 and the Planning Commission
of the City of Tiburon has held public hearings on the Tentative Parcel Map and con-
sidered all arguments both for and against said map.
WHEREAS: The Planning Commission did on June 7, 1978 adopt Resolution No. 258
recommending approval of said Tentative Parcel Map.
NOW, THEREFORE BE IT RESOLVED: that the City Council of the City of Tiburon
does hereby approve the Tentative Map as Exhibit A, subject to the following
condi tions:
1. That all conditions specified in Section 3 of Ordinance No. 198 N.S.
be met prior to Parcel Map recordation.
2. That the In-lieu park and recreation fees of $500 per unit shall be paid
to the City of Tiburon in accordance with the applicable ordinance and
prior to recordation of the Parcel Map. These funds are to be spent in
conformance with Section 14-50 of the Tiburon Zoning Ordinance and Chapter
4, Article III of the Subdivision Map Act as amended in March 1975.
3. That the drainage fee of $880.59 be paid to the City in accordance with
the applicable ordinance prior to recordation of the Parcel Map. These
funds are to be spent in conformance with Section 14-50-5 of the Tiburon
Zoning Ordinance and Chapter 4, Article 5 of the Subdivision Map Act as
amended in March 1975.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TIBURON APPROVING THE EXPENDITURE OF FEDERAL AID
FOR THE INSTALLATION OF A GUARDRAIL ON MAR WEST
AND CENTRO EAST AND THE INSTALLATION OF A
SIDEWALK AND HANDRAIL ON PARADISE DRIVE
WHEREAS the Congress of the United States has declared it to be in
the National interest for Federal funds to be expended for highway, fringe
parking, bicycle transportation, pedestrian walkways, and mass transportation
projects, and
WHEREAS the Legislature of the State of California has enacted
legislation by which certain Federal funds authorized may be made available
for use on local transportation facilities in accordance with the intent of
Federal acts, and
WHEREAS there exists a compelling need for a sidewalk and handrail on
Paradise Drive in the vicinity of Mar West, and
WHEREAS there exists a compelling need for a guardrail on Mar West
and Centro East, and
WHEREAS the City of Tiburon and STATE therefore desire to make use
of such Federal funds as may be made available within the jurisdictional
boundaries of said City of Tiburon, and
WHEREAS before Federal aid will be made available for projects,
LOCAL AGENCY and STATE are required to enter into an agreement relative to
prosecution of the said project and maintenance o'f the completed facility, and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Tiburon approves the installation of a sidewalk and handrail on Paradise Drive
90% funded by Federal aid and 10% funded by the City of Tiburon.
BE IT FURTHER RESOLVED that the City Council of the City of Tiburon
authorize the Mayor to execute the Local Agency State Agreement for Federal
Aid Projects.
