RESOLUTION NO. 926
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
ADOPTING A CONFLICT OF INTEREST CODE APPLICABLE TO THE
CITY MANAGER PURSUANT TO THE POLITICAL REFORM ACT OF 1974
THE CITY COUNCIL OF THE CITY OF TIBURON HEREBY RESOLVES AS FOLLOWS:
SECTION 1. ADOPTION OF CONFLICT OF INTEREST CODE. In compliance with
~~ 87300, et seq., of the Government Code, the City Council hereby adopts
this Conflict of Interest Code.
SECTION 2. APPLICATION OF CODE. This Conflict of Interest Code shall
be applicable to the City Manager.
SECTION 3. DISCLOSURE. The City Manager is required pursuant to
Government Code gg 87200, et seq., to disclose investments, interests in real
property and income. No other or no additional disclosure requirements are
imposed by this Conflict of Interest Code.
SECTION 4. CIRCUMSTANCES REQUIRING DISQUALIFICATION. The City Manager
must disqualify himself or herself from making or participating in the making
of any decisions which will foreseeab1y have a material financial effect,
distinguishable from its effect on the public generally, on any economic
interest, as defined in Government Code g 87103. He shall not be prevented
from making or participating in the making of any decision to the extent his
or her participation is legally required for the decision to be made.
SECTION 5. DEFINITIONS. Except as otherwise indicated, the definitions
contained in the Political Reform Act of 1974 (Government Code g~ 8100, et seq.)
and Regulations adopted pursuant thereto are incorporated into this Conflict of
Interest Code.

SECTION 6. SEPARABILITY. If any section, subsection, sentence, clause
or phrase of this ordinance is for any reason held to be invalid or unconstitu-
tional by the decision of a court of competent jurisdiction, such decision shall
not affect the validity of the remaining portions of the ordinance. The City
Council of the City of Tiburon hereby declares that it would have passed this
ordinance, and each section, subsection, sentence, clause or phrase thereof,
irrespective of the fact that anyone or more other sections, subsections,
sentences, clauses or phrases may be declared invalid or unconstitutional.

RESOLUTION NO. 925
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
COMMENDING PETER HOYT BERG FOR HIS SERVICE AND OUTSTANDING
CONTRIBUTION TO THE PARKS AND RECREATION COMMISSION OF THE
CITY OF TIBURON
WHEREAS: Peter Hoyt Berg has served on the Parks and Recreation
Commission for a period of 3~ years, from April 1974 to July 1977;
and
WHEREAS: Peter Hoyt Berg has served as Chairman of the Parks and
Recreation Commission for 2 years exercising leadership during the
development of McKegney Green, the formation of the Be1vedere/Tiburon
Joint Recreation Committee, and the development of Richardson Bay
Lineal Park; and
WHEREAS: Peter Hoyt Berg has exhibited unusual initiative and made
more than ordinary contributions to the Parks and Recreation Commission;
and
WHEREAS: Peter Hoyt Berg has been a leader in the development of
activities and facilities, such as: Be1veron Mini-Park, the Community
Gardens, the Del Mar Tennis Courts, the Lanes and Paths program, Kite
Day, Ayala Day and many others which contribute greatly to the fabric
of city life; and
WHEREAS: The citizens of the City of Tiburon have particularly
benefitted as a consequence of the dedication, sensitivity, and aware-
ness of Peter Hoyt Berg in his role as Parks and Recreation Commissioner;
and
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of
Tiburon does commend Peter Hoyt Berg for his service to the past, present,
and future of the City of Tiburon.

RESOLUTION NO. 924
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TIBURON RECOMMENDING AMENDMENTS TO THE
STATE LAW TO PROVIDE IMPROVED REAL PROPERTY
ASSESSMENT PROCEDURES
WHEREAS, Assessors throughout the State have frequently assessed
business property substantially lower than 25 per cent of the market value,
and
WHEREAS, this inequity has forced substantial portions of the property
tax burden to rest upon the residential home owner, and
WHEREAS, the property-related costs of local government are usually
not compensated for by the property tax payments from businesses, and
WHEREAS, the lowered assessment for- business propermes ra-rely results in
aahieving any worthwhile social goals, such as lowered rentals for such property,
and,
WHEREAS, these practices result from a choice of methods for assess-
ment that the assessor alone makes, and
WHEREAS, these policy decisions are made in virtual absence of public
input to the Assessor's Office,
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. That the City of Tiburon request the State Board of
Equalization to declare a moratorium on assessing
home-owner-occupied residences until a coherent
program of reassessing business properties has been
completed.
2. That the State Board of Equalization develop a single
no-choice method for assessment of business or all
properties.
3. That State law be amended so that the Assessor's Office
shall have an elective body of Commissioners to act as
policy advisors to that office.

RESOLUTION NO. 923
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TIBURON AMENDING PROCEEDINGS IN
THE MATTER OF THE DATE FOR RECEIPT OF
CONSTRUCTION BIDS
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Tiburon that the proceedings for the formation of the
Miraflores Project Assessment District, City of Tiburon, Marin
County, California, be, and they are hereby, amended by deleting
from the Resolution and Order Preliminarily Adopting Engineer's
Report, Setting Public Hearing and Calling for bids, as well
as the Notice Inviting Sealed Bids, the date of August 4, 1977,
as the date for receipt of bids for the doing of the work, and
substituting therefore the date of August II, 1977.

RESOLUTION NO. 922
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TIBURON PROPOSING A 1977-78
SPORTS CHALLENGE TO THE CITY OF BELVEDERE
WHEREAS, the Cities of Belvedere and Tiburon met for the
first (sporting) time in December 1974 on the Del Mar gridiron;
and
WHEREAS, the two Tiburon Peninsula cities competed again
during the 1976 Bicentennial festivities in a challenging tug-
of-war contest; and
WHEREAS, in the continuing spirit of good sportsmanship, an
offer is now extended to the City of Belvedere to consider again
participating in a suitable sporting contest; and
WHEREAS, in accordance with the rules of proper gamemanship,
Belvedere is invited to select an appropriate sports challenge;
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Tiburon does hereby encourage the City of Belvedere
to pursue this sports challenge, select an event, and determine
the suitable time and location;
AND, BE IT FURTHER RESOLVED, that a somewhat less arduous
activity other than football or tug-of-war be considered, such
as volleyball, and that a desirable date and location could
conceivably be Labor Day weekend at McKegney Green.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TIBURON AMENDING RESOLUTION
NO. 908 BY ADDING CLARIFICATION TO
SECTION (j)
WHEREAS, Resolution No. 908 of the City of Tiburon,
adopted on June 27, 1977, recommends a realignment plan with
conditions for Highway 131 (Tiburon Boulevard) at the Trestle
Glen intersection; and
WHEREAS, the City Council now desires that Item (j) be
clarified,
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Tiburon does hereby amend Resolution No. 908 by
revising Item (j) to read as follows:
"that an underpass for pedestrians and bicyclists
be constructed in the most appropriate location and
that it be of good design and open to light and air;
and be provided with safety lighting; but the under-
pass not be designed so as to induce an increase of
height of the roadway above the existing ground
elevation;"

RESOLUTION NO. 914
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
AUTHORIZING SIGNING AND ENDORSING CHECKS AND OTHER
INSTRUMENTS
BE IT RESOLVED AS FOLLOWS:
1. That Crocker Bank, at the Tiburon-Be1vedere office, and the Bank of
America, Tiburon, are hereby selected and designated as the depositories of
funds of the City of Tiburon, and that checking accounts be established and
maintained by and in the name of this City at said banks, upon and subject to
such terms and conditions as the Councilmen hereinafter designated, or any of
them, may from time to time agree upon with said banks, and
(a) That all checks, drafts and other instruments in the amount of $250
or less for the payment from said accounts or at said offices be signed on be-
half of the City of Tiburon by Robert L. Kleinert and one of the following:
F. G. Knight, Barbara Brown or Deborah Zepnick, or one of the preceding and
one of the following: Albert Aramburu, George L. Ellman, Harold Edelstein, E.
Bruce Ross or Donald S. Tayer. Payroll checks will be signed by either Robert
L. Kleinert or F. G. Knight, or in their absence, a Councilman.
(b) That all other checks, drafts and other instruments for the payment
from said accounts or at said offices be signed on behalf of the City of
Tiburon by Robert L. Kleinert, F. G. Knight, Barbara Brown, Deborah zepnick,
and one of the following: Albert Aramburu, George L. Ellman, Harold Edelstein,
E. Bruce Ross or Donald S. Tayer; and
2. That any checks, drafts or other instruments for the payment of
money, endorsed on behalf of the City for deposit with or collection by said
banks, may be so endorsed in the name of the City by written or stamped
endorsement, without designation or signature of the person making such endorse-
ment; and
3. That the City Clerk is hereby authorized and directed to certify to
said banks that this Resolution has been duly adopted, and is in accordance
with this Rero1ution and the certification then in effect as above provided
for, including any such instrument drawn or endorsed to the personal order of,
or presented for negotiation or encashment by, any official signing or
endorsing the same; and
4. That said banks are hereby requested and authorized to honor, receive,
certify or pay any such instrument signed or endorsed in accordance with this
Resolution and the certification then in effect as above provided for, including
any such instrument drawn or endorsed to the personal order of, or presented
for negotiation or encashment by, any official signing or endorsing the same; and
5. That this Resolution and each certification shall remain in full force
and effect, and said banks are authorized and requested to rely and act thereon,
until they shall receive at their office to which the certified copy of this
Resolution is delivered, either a certified copy of a further Resolution
of the City Council of the City of Tiburon amending or rescinding this
Resolution or a further certification as above provided for, as the case may
be; and
6. That Resolution No. 820 is hereby rescinded.

RESOLUTION NO. 913
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TIBURON GRANTING A TEMPORARY USE
PERMIT TO PENNY PINCHER INC. TO OPERATE
A PENNY PINCHING MACHINE IN DOWNTOWN
TIBURON SUBJECT TO CERTAIN CONDITIONS
WHEREAS: A representative from Penny Pincher, Inc., requested that
he be granted a temporary permit to operate a penny pinching machine and
sell the pennies as souveniers on the Angel Island Ferry Dock at 21 Main
Street, and
WHEREAS: The City has determined that certain conditions should be
imposed on the granting of a Use Permit concerning operations of said machine,
NOW THEREFORE BE IT RESOLVED: That the City of Tiburon does grant to
Penny Pincher, Inc., or its agents, a Use Permit to operate a penny pinching
machine on the Angel Island Ferry Dock under the following conditions:
1. That the said Use Permit shall extend from July 2, 1977 to
October 3, 1977.
2. That the hours of operation of said machine shall be from 9:45
a.m. to 5:30 p.m. on weekdays and from 9 a.m. to 6 p.m. on weekends.
3. That the pretab 5' x 7' x 6' all steel shed in which said
machine is stored will be removed from the premises by October 4, 1977.
4. That the business shall be covered by "All Risk Inland Marins"
insurance which includes fire, theft, vandalism, property damage and
personal bodily injury.
5. That the railing which blocks pedestrian traffic between Sabella's
public access promenade and the Angel Island Ferry Dock at 21 Main Street
be removed permanently.
6. Failure to meet the conditions shall result in the revocation
of this Use Permit upon 10 days notice to Penny Pinchers, Inc. by the City.

WHEREAS: The Rules and Regulations for McKegney Green set forth the
policies and guidelines for the use of McKegney Green; and
WHEREAS: The Rules and Regulations for McKegney Green have been
reviewed and commented upon by Reed Unified School District, Tamalpais
Union High School District and the Tiburon City Council; and
WHEREAS: The Belvedere/Tiburon Joint Recreation Committee has
reviewed and revised the Rules and Regulations for McKegney Green; and
WHEREAS: The Belvedere/Tiburon Joint Recreation Committe has adopted
by Committee Resolution the Rules and Regulations for McKegney Green:
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Tiburon does hereby endorse the Rules and Regulations for McKegney Green

THE CITY OF TIBURON FIXING THE SALARY
OF THE CITY MANAGER FOR THE FISCAL
YEAR 1977-78
WHEREAS, Chapter 2, Article II, Section 2-7 of the
Municipal Code requires that the salary of the City Manager
be fixed by Resolution of the City Council;
NOW, THEREFORE, BE IT RESOLVED that the annual salary
of the City Manager for the Fiscal Year 1977-78 shall be
$28,116.

RESOLUTION NO. 910
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TIBURON ADOPTING A MUNICIPAL
BUDGET FOR FISCAL YEAR 1977-78
WHEREAS, the City Council now finds that the proposed
Municipal Budget as amended provides for all appropriate
municipal purposes and services within the current resources
and anticipated revenues for the fiscal year 1977-78.
NOW, THEREFORE, BE IT RESOLVED that said budget is here-
by approved and adopted as the Municipal Budqet for the City
of Tiburon for the fiscal year 1977-78, and all expenditures,
encumbrances, transfers and appropriations set forth therein
are also approved; and
THAT, the City Manager may make adjustments between func-
tions and activities within the budget provided that no increase
or diminishment in salaries result other than that provided
for by the personnel system, and provided that no expenditure
or encumbrance contingent on contract, agreement, or other
engagement requiring approval of the City Council shall be
made until such contract, agreement, or other engagement is
first approved by the City Council.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
ESTABLISHING THE ANNUAL SALARY PROGRAM FOR THE CITY OF
TIBURON FOR THE FISCAL YEAR 1977-78 WITHIN THE FRAMEWORK
OF THE PERSONNEL SYSTEM
WHEREAS, Section 3-3 of the City Code requires that an Annual
Salary Program be adopted for each fiscal year as part of the Personnel
System of the City of Tiburon;
NOW, THEREFORE, BE IT RESOLVED:
THAT the Memoranda of Understanding with the Miscellaneous
and Police employee units are ratified; and
BE IT FURTHER RESOLVED:
THAT the Annual Salary Program for the fiscal year 1977-78

Overtime compensation shall be paid for any time worked in excess of the normal working
day and for call-back time at a rate of time and one-half. Double time shall be paid
for any work performed on a Holiday.
All regular non-supervisory City employees are eligible for overtime compensation which
is applicable to all departments. - All overtime must be approved and authorized by the

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TIBURON RECOMMENDING A REALIGNMENT
PLAN AND CONDITIONS FOR HIGHWAY 131 (TIBURON
BOULEVARD) AT THE TFESTLE GLEN INTERSECTION
WHEREAS, CAL/TRANS and the City of Tiburon have been study-
ing for over four years the proposed realignment of Highway 131
(Tiburon Boulevard) through the area commonly known as Blackie's
Pasturej and
WHEREAS, the City wishes to increase conditions for safety
to drivers and pedestrians, as well as preserve the park and
recreational potential of the Blackie's Pasture area to the
maximum extent possible and at the earliest possible time; and
WHEREAS, CAL/TRANS has prepared an Environmental Impact
Statement (EIS) at the request of the City and full public
hearings have been held by CAL/TRANS and the City of Tiburon; and
WHEREAS, the City of Tiburon desires to receive a return of
the Open Space funds which were used to purchase portions of
Blackie's Pasture through which the realigned road would pass,
in order to use such funds for the acquisition of other valuable
areas of open space throughout the City of Tiburonj and
WHEREAS, the City of Tiburon desires to conclude its planning
and development of Richardson Bay Lineal Park based on a final
determination of the highway realignment and to integrate said
Park with the existing Belveron Mini Park; and
WHEREAS, the City of Tiburon desires to reduce to the
greatest extent possible the impact of the realigned road on the
environment of the areas through which it will pass and on neigh-
boring areas;
WHEREAS, the cities of the Tiburon Peninsula and CAL/TRANS
have previously unadopted a shoreline alignment of this road,
and thereby conserved valuable open space and shoreline areas,
as well as many millions of dollars, for better projects; and
the City of Tiburon has adopted a policy that Tiburon Boulevard
retain its two-lane character between Stewart Drive and Mar West;
NOW, THEREFORE, BE IT RESOLVED, that the City of Tiburon
advise CAL/TRANS as follows with regard to said realignment:
(a) that the Final EIS incorporate all commentary by the
public and public agencies; in particular, the comments
of the Planning Commission of the City of Tiburon
(Exhibit "A") and this Resolution of the City Council,
together with appropriate, complete and impartial
responses thereto by CAL/TRANS, all in accordance
with the California Environmental Quality Act and
Guidelines of the National Environmental Policy
Act, and that the Final EIS be completed with the
utmost rapidity, expedition and priority;
AND, BE IT FURTHER RESOLVED, that the final design shall be
based upon the following criteria and conditions and any construc-
tion shall be subject to said conditions:
(a) that the design of the realignment not be a "freeway" or
"superhighway" type of speed-inducing design, since
higher speeds in this portion of the highway are neiuher
necessary nor desirable to the City; and that the maximum
speed on this portion of the highway be 35 mph, as
compared to the existing maximum speeds of 40 mph west
of the project area and 35 mph east of the project area;
and that the desiqn shall be such as to encourage east-
bound drivers to slow to 35 mph or less by the time they
arrive at the Trestle Glen intersection, and particularly
at the Stewart Drive intersection.
(b) that the road be constructed to provide four lanes from
Reed Ranch Road to Trestle Glen, two eastbound and one
westbound lanes east of Trestle Glen and narrowing to
two lanes west of Stewart Drive, as illustrated in the
attached Exhibit "Bq; and that the overall width of
the complete roadway, including median and shoulders be
kept to a minimum in order to reduce visual impact;
(c) that any retaining walls adjacent to Reed Heights shall
be kept to a minimum in visibility and cost;
(d) that the realigned highway be as far away as possible
from the shoreline in the Blackie's Pasture area in
order to provide maximum potential park area on the
shore side of the highway, and to reduce impacts of
road noise and the like on the shore area;
(e) that every effort be made to provide for the maximum park and
recreational development potential, with related activities
of both remaining segments of Blackie's Pasture;
(f) that Greenwood Beach Road be terminated in a cul-de-sac
at the last legal building site, but with non-public
access to and from Highway 131 for emergency and main-
tenance vehicles at or near the same location as the
present eastern terminus of Greenwood Beach Road at
Highway 131;
(g) that CAL/TRANS remove the roadbed from the existing
portion of Tiburon Boulevard which will not be utilized
in the realigned highway, and dedicate said portion to
the City of Tiburon for additional park use;
(h) that all existing and new utilities in the project area
be undergrounded;
(i) that street safety lighting and signalization be provided
at the intersections:of Highway 131 with Trestle Glen Boul-
evardand Stewart Drive;
(j) that an underpass for pedestrians and bicyclists be
constructed in the most appropriate location and that
it be of good design and open to light and air; and be
provided with safety lighting;
(k) that the elevation of the roadbed of the realigned por-
tion of the highway in the Blackie's Pasture area be
as close as possible to the existing ground elevation
so as not to create serious visual damage to the Blackie's
Pasture area and to neighboring areas;
(1) that berms or other sound attenuating measures be used
to minimize the noise made from the road areas, thereby
complying with the Noise Element of the City General
Plan, but not in such a manner as to significantly
impair views from or across the road;
(m) that the highway be designed to a parkway character
consistent with the character of Tiburon Boulevard east
of the realigned highway and with the future park use
of the Blackie's Pasture area;
(n) that appropriate landscaping, utilizing drought-toler-
ant native California species, be installed by CAL/TRANS
on the median, shoulders, embankments and abandoned
roadbed, consistent with the intended use of the area
through which the road passes, after consultation with
the City.
(0) that the final design and implementation proceed with
the utmost rapidity, expedition and priority;

(p) that the final design incorporate the conditions sti-
pulated herein in order to achieve the most optimal
balance between the requirements for safety, the
environment and park and recreation needs.
As most illustrative of the best balance of the criteria and
descriptions described herein, the City recommends that the
approximate alignment shown in Study C-4A, dated June 20, 1977,
be used as a basis for the development of the final design;
and that the final design should be based upon optimal engineering
criteria, but not necessarily the most stringent as would be
suitable to a road in this sensitive location.

WHEREAS: Louise Mirata has been employed with the City of Tiburon
for more than eleven years, from May 31, 1966 to June 30, 1977; and
WHEREAS: Louise Mirata has served ably as a member of the General
Services Department; and
WHEREAS: Louise Mirata has served as the Assistant City Clerk,
the Deputy Treasurer, and the General Services Supervisor; and
WHEREAS: Louise Mirata has served the City of Tiburon since its
earliest days and has been central in the establishment of many city
procedures while being a valuable resource to other staff members with
her knowledge of the history and operations of the city; and
WHEREAS: Louise Mirata provided supervision as well as technical
and professional competence;
NOW THEREFORE, BE IT RESOLVED: that on the eve of Louise Mirata's
retirement from the City of Tiburon, the Tiburon City Council does declare
its sincere appreciation on behalf of the citizens of Tiburon for the

ING THE MARIN COUNTY WORKERS COMPENSATION
FUND
WHEREAS, substantial increases in the cost of Workers'
Compensation Insurance for municipalities has required cities
to seek means for reducing such costs, and
WHEREAS, the managers of these cities have proposed a
program for a Workers' Compensation Fund that has been reviewed
and found to be acceptable by the Councils of said cities and
which will assist in addressing this problem.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
hereby approves a Joint Powers Agreement in the form attached
hereto with certain cities for the purpose of establishing the
Marin County Workers Compensation Fund, authorizes the Mayor
to execute the same, and directs the City Staff to take such
steps as may be necessary to carry out the program.

CITY OF TIBURON APPROVING THE PARCEL MAP
FOR DEVELOPMENT OF ASSESSOR'S PARCEL
58-132-18
WHEREAS: The City Council of the City of Tiburon adopted Ordinance
No. 168 N.S. on February 9, 1976, approving the Master Plan for development
of Assessor's Parcel 58-132-18.
WHEREAS: Allan and Caroline Littman, and Jeremy Littman have submit-
ted a Precise Plan for the development of three (3) single family dwelling
units on 1.75 acres of land consisting of A.P. 58-132-l8 located in the RPD-2
zone at the end of Rolling Hills east of Tiburon Boulevard, and
WHEREAS: The Planning Commission has reviewed the Precise Plan and
found the submission is consistent with the adopted Master Plan of the project
and the Tiburon General Plan, and
WHEREAS: The Planning Commission conditionally approved said Precise
Plan on March 17, 1976, and the City Council reviewed and approved said Precise
Plan on April 12, 1976, and extended said approval for one additional year, and
WHEREAS: The Planning Commission and City Council have reviewed the
Tentative Parcel and found it in conformance with the approved Precise Plan.
NOW, THEREFORE BE IT RESOLVED: that the City Council of the City of
Tiburon does hereby approve of the Parcel Map as Exhibit 1, subject to the
following conditions and dated May, 1977:
1. That the Parcel Map shall be subject to all conditions of the City
of Tiburon's Subdivision Ordinance, prior to recordation.
2. That all drainage improvements for the development shall be consistent
with the Tiburon Master Drainage Plan (1974) as revised. Drainage for the
roadway shall be as approved by the City Engineer.
3.
That all utilities serving the development shall be underground.
4. The road right-of-way shall be offered for dedication to the public.
It is the intent of the City Council to consider accepting or rejecting said
offer or dedication at the time the Final Parcel Map for the remaining 2 parcels
is considered.
5. That no structure shall be erected in the development until the same
have received site plan and architectural approval by the Board of Adjustments
and Review.
6. That prior to recordation the applicants shall make prov~s~on for an

satisfactory to City Attorney and Director of Community Development.

LEWIS PROJECT. CONSISTING OF LOTS 9 THROUGH 29
WHEREAS: Mr. Leonard Cahn and Mr. David Lewis have submitted a Master
Plan for the development of 29.4 acres of land located in the RFD-l zon8,
and
WHEREAS: The City Council on July 28, 1975 adopted Ordinance No. 161
N.S. conditionally approving the Master Plan and Text for the Cahn/Lewis devel-
opment, dated July 28, 1975, and
WHEREAS: The City Council on October 14, 1975 adopted Resolution No. 768
approving the Precise Plan and Tentative Map, dated October 5, 1975, and Exhibit
A for development of 2904 acres of land in the RPD-l and 2 zones, and
WHEREAS: The City Council on January 13, 1976 amended Resolution
No. 768 by adopting Resolution 788 amending the Precise Plan and Tentative
Map with regard to setbacks for Lots 5, 6 and 7 in Phase I, and
WHEREAS: The City Council and the Planning Commision have reviewed
changes in the location of several lots and building envelopes for the
lots in Phase II, especially Lots 9 through 16, and has approved a revised
Precise Plan and Tentative Map for Phase II of the project.
NOW THEREFORE BE IT RESOLVED: That the City Council does hereby adopt
the Final Subdivision Map as Exhibits A and B dated , subject to
the following conditions:
1. That all subdivision improvements be subject to the approval of
the Board of Adjustments and Review.
2. That all of the conditions specified on the Precise Plan and
attached to the Resolution approving the revised Precise Plan for the second
phase shall constitute conditions of approval of the precise Plan and Final
Subdivision Map for the developmento
3. That In-lieu Parks and Recreation fees of $3267.38 shall be paid
to the City of Tiburon in accordance with the applicable ordinances and
prior to the recordation of the Final Subdivision Map. These funds are
to be spent in conformance with Section 14-50 of the Code and Article III
of the Subdivision Map Act as amended.
40 That Parcels Band C consisting of Open Space Preserve excluding
well or waste water facilities and easements shall be dedicated to the
City of Tiburon prior to recordation of the Final Subdivision Map in a form
suitable to the City Attorney.
5. That prior to the recordation of the Final Subdivision Map, the
applicant shall submit to the Department of Community Development and Copy
of the Deed and Title restrictions for approval by the City Attorney.
60 That the drainage system be installed as shown, or the improve-
ments bonded as shown on sheet 7 of the Precise Plan and Tentative Map
dated September 19, 1975, and as described in Ordinance No. 161 N.S., Section
2D, prior to issuance of any building permit for any subdivision improvements.

WASTE MANAGEMENT IN MARIN COUNTY
WHEREAS, the County of Marin and its incorporated cities are required
by Section 66796 of the Government Code to designate an enforcement
agency to carry out the provisions of the Z'Berg-Dapi1off Solid Waste
Control Act of 1976; and
WHEREAS, the Division of Environmental Health possesses the required
capabilities in environmental health and solid waste management to
implement the Z'Berg-Kapiloff Solid Waste Control Act of 1976 and the
regulations and ordinances that have been and will be adopted pursuant
thereto; and
WHEREAS, the Division of Environmental Health has been given
sufficient personnel and an adequate budget to carry out the enforcement
program specified by law; arid
WHEREAS, it is the understanding of this Council that the County
of Marin and a majority of the cities within the county containing a
majority of the population of the incorporated area of the county intend
to designate the Division of Environmental Health as the enforcement
agency for the county and all cities contained within the county;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Tiburon that it hereby approves the designation of the Division of
Environmental Health by the County of Marin as enforcement agency for
the county and all cities contained within the county, pursuant to
subsection (a) (1) of Section 66796 of the Government Code.

RESOLUTION TO THE CITY OF TIBURON APPROVING THE EX-
PENDITURE OF FEDERAL-AID FOR INSTALLATION OF A SIDEWALK
AND HANDRAIL ON PARADISE DRIVE IN THE VICINITY OF MAR
WEST.
WHEREAS, the Congress of the United States has declared it to be
in the national interest for Federal funds to be expended for highway,
fringe parking, bicycle transportation, pedestrian walkways, and mass
transportation projects; and
WHEREAS, the Legislature of the State of California has enacted
legislation by which certain Federal funds authorized may be made
available for use on local transportation facilities in accordance
with the intent of Federal acts; and
WHEREAS, there exist a compelling need for a sidewalk and handrail
on Paradise Drive in the vicinity of Mar West; and
WHEREAS, the City of Tiburon and STATE therefore desire to make use
of such Federal funds as may be made available within the jurisdictional
boundaries of said City of Tiburon; and
WHEREAS, before Federal-aid will be made available for projects,
LOCAL AGENCY and STATE are required to enter into an agreement relative
to prosecution of the said project and maintenance of the completed
facility; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Tiburon approves the installation of a sidewalk and handrail on
Paradise Drive 99% funded by Federal-aid and 1% funded by the City of
Tiburon.

Tiburon authorize the Mayor to execute the Local Agency-State

WHEREAS: Vernon Coleman has served ably as a member of the Public
Works Department; and

Working Foreman in the Public Works Department; and

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
APPROVING THE PRECISE PLAN AND TENTATIVE MAP FOR THE
CAHN/LEWIS PROJECT
WHEREAS: Mr. Leonard Cahn and David Lewis have submitted a Master Plan
for development of 29.4 acres of land located in the RPD-I and RPD-2 zones; and
WHEREAS: the City Council on July 28, 1975, adopted Ordinance No. 161
N. S., conditionally approving the Master Plan and Text for the Cahn/Lewis develop-
ment dated July 28, 1975; and
WHEREAS: Mr. Leonard Cahn and Mr. David Lewis have submitted a Precise
Plan and text and Tentative Map for development of 29.4 acres of land located in
the RPD-1 and RPD-2 zones on August 18, 1975, and the Planning Commission of the
City of Tiburon has held a public hearing on the Precise Plan and text and Tenta-
tive Map and considered all arguments both for and against said plan and map; and
WHEREAS: the Planning Commission held a public hearing on amendments
to the Precise Plan and Map at the request of numerous groups, which resulted
in the alteration of building envelopes and lot lines for Lots 9 through 16; and
WHEREAS: said Amendments to the Precise Plan were approved by Planning
Commission Resolution No. 227 on March 2, 1977, and by the City Council Resolution
No. 885, on March 28, 1977; and
WHEREAS: the revised Tentative Map has been reviewed and found to be
in conformance with the revised Precise Plan; and
WHEREAS: the Planning Commission did on April 27, 1977, by Resolution
No. 233, recommend to the City Council approval of the Precise Plan and Tentative
Map for the Cahn/Lewis Project.
NOW, THEREFORE BE IT RESOLVED: that the City Council of the City of
Tiburon does hereby adopt the proposed revised Tentative Map as Exhibit A, subject
to the following conditions:
1. That the Precise Plan shall be subject to all conditions of the
City of Tiburon's Zoning Ordinance, Section 10-4 G 2 prior to the
City Council approval of the Final Map.
2. That all subdivision improvements shall be subject to the approval
of the Board of Design Review.
3. That all conditions specified on Sheet "T" of the Precise Plan
shall constitute conditions of approval of the Precise Plan and
Tentative Map for subject development, and are attached as
Exhibit B.
4. That In-lieu park and recreation fees of $4,737.70 shall be paid
to the City of Tiburon in accordance with the applicable ordinance
and prior to recordation of the Final Subdivision Map. These funds
are to be 'spent in conformance with Section 14-50 of the code and
Article III of the Subdivision Map Act as amended in April, 1975.
5. That parcels A, B, and C consisting of 16+ acres of Open Space
Preserve excluding waste water reclamation facilities and easements
shall be dedicated to the City of Tiburon prior to recordation of
the Final Subdivision Map in a form suitable to the City Attorney.

6. That prior to the recordation of the Final Subdivision Map, the
applicant shall submit to the Department of Community Development
a copy of the Deed and Title restrictions for approval by the
City Attorney.
7. That drainage system shall be installed as shown on sheet 7 of the
Precise Plan and Tentative Map dated September 19, 1975, and
described in Ordinance 161 N.S., Section 2 D.

Conditions on Tentative Map and Precise Plan, October 5, 1975
Miraflores Project
Notes:
1. The Soil Mechanic's Report of Cooper-Clark dated September 2, 1975, plus
addendum and the Water Use and Reclamation Report of Gonzales and Ober-
kamper, form a part of this Tentative Map and Precise Plan.
2. Property owners of record are Mr. L. Cahn (60 Union Street, S.F. CA)
and Shapero Estates (c/o Trust Department, Bank of America, San Rafael, CA).
3. The property is not presently formally used. Proposed use of parcels
1-29 is single family residential and the proposed use for parcels A, Band
C is public open space.
4.a. The project will provide open space. It will not obstruct views of SF/Bay
from existing residences. It provides each parcel with views. It will
provide a variety of residential designs. It creates a sense of place by
virtue of the views. It is organized within the bowl of the site (parcels
8-29), along existing adjacent patterns of development (parcels 5-7), and
in the western pocket of the site (parcels 1-4).
4.b. Improvements will be provided in accordance with all applicable codes and
regulations. Water mains will be installed of sufficient size to deliver
1,000 gpm for fire flows throughout the project. Fire hydrants will be
installed at a distance of no more than 300 ft. apart in accordance with
Tiburon Fire Protection District. Standard concrete lined ditches or other
permanent structures will be provided as needed to direct storm water to
storm drains. Erosion control improvements will be provided as required
by the City. Improvements will be provided in accordance with the standard
specifications of Cities of Marin and County of Marin.
5. All utilities will be provided underground in streets and easements. Water
will be provided by the MMWD. Sewage disposal will be provided by Richardson
Bay Sanitary District. Gas and Electricity will be provided by PG&E.
Cable TV will be provided by Tele-vue Systems.
6. All improvements indicate intent only and are subject to changes or additions
at time of Final Design.
7. Sub-drainage will be provided in parcels A, Band C to establish existing
slides within these parcels.
8. All existing improvements along project frontage will be repaired as required
by the City.
9. Parcel A (in phase 1) and parcels B and C (in phase 11) will be dedicated
to the City of Tiburon prior to recording of the Final Map. The dedication
will be in a form acceptable to the City Attorney. It will accommodate
the following easements and restrictions: Easements: the Project will
retain the rights of access to and ownership of utility, water and/or
sewage treatment system installed in Parcels A, Band C in connection with
the Project. Restrictions: The City shall be restricted from development
of Parcels A, Band C. The Project will leave these parcels in as close
to their present form as is possible and the City shall continue this policy.

EXHIBIT B:

Utility poles 1, 2 and 3 as shown on the adjoining drawing, will be under-
ground as part of Phase 1 of the Project in accordance with the following
procedure. The services will be undergrounded. Residences served by the
poles will be notified by registered letter of the date of undergrounding.
The existing residences will make their own connections to the undergrounded
services within one year. If the residences make the connection within
the year, the sub-divider will remove the overhead lines and poles.

The out of tract drainage as shown on sheet 7 will be installed as a portion
of the improvements of Phase 11 of the Project.

d. Maintenance of the screens for the first year will be by the
Project and will be bonded accordingly. After one year, the
screens on private parcels will be under the jurisdiction of
the parcel owners and subject to appropriate maintenance as
specified in the Conditions, Covenants and Restrictions associated
with the sale of the parcels. Should any screens in parcels A, B,
and C grow to a height that they obstruct the views (this does not
seem likely) those parties whose views are obstructed will have
the right to initiate pruning as required and this will be included
in the terms of dedication of Parcels A, Band C.
21. The concrete surface drainage elements at the southern portion of Phase 11
will be constructed of concrete that is colored to blend in with the surround-
ing area as best as is possible and also, in so far as is practical. Trans-
ition type vegetation will be provided to screen these surface drainage
elements.

RESOLUTION NO. 889
A RESOLUTION OF THE CITY OF TIBURON
ESTABLISHING A DISTRIBUTION OF FUNDS UNDER
THE URBAN AND COASTAL BOND ACT, 1976
WHEREAS, the County of Marin, the incorporated cities of
the County of Marin and certain community service districts
are eligible for funding assistance for parks and recreation
projects as a result of the passage of the Urban and Coastal
Bond Act in November, 1976; and
WHEREAS, this Act calls for the establishment of a Priority
Expenditure Plan which is endorsed by fifty (50%) percent of
the cities representing fifty (50%) percent of the County's
population and the Board of Supervisors; and
WHEREAS, it is the intent of all involved to arrive at
an equitable distribution of the available funds.
NOW, THEREFORE, BE IT RESOLVED that the City of Tiburon
endorses the following distribution of funds available to the
County of Marin under the Urban and Coastal Bond Act of 1976
subject to the following provisions:
1. Fifty (50%) percent of the monies to be allocated to
the County of Marin and the Community Service Districts, and fifty
(50%) percent of the monies to be allocated to the incorporated
cities of the County of Marin endorsing this project with the
distribution based on the current population of each city as per
Table 1;
2. The Local Parks Assistance Program sponsored by the
County of Marin shall be 'continued at not less than its current
funding level of $312,000, and this money shall be made available
from County General Revenue Sharing Funds;
3. The Local Parks Assistance Program shall continue in
force for those years that the County of Marin receives funds
from General Revenue Sharing sources in an amount equal to the
actual 1976/77 funding level.
BE IT FURTHER RESOLVED that the City of Tiburon proposes
to the Board of Supervisors of the County of Marin a second
alternative consisting of:
1. As per capita distribution of the funds to the incorporated
cities of Marin, the eligible community Service Districts and to
the County of Marin based on the unincorporated area outside
eligible districts, as per Table 2;
2. The Local Parks Assistance Program sponsored by the
County of Marin shall be continued at not less than its current
funding level of $312,000, and this money shall be made available

3. The Local Parks Assistance Program shall continue in
force for those years that the County of Marin receives funds

Executive Director of the Ecumenical Association for Housing since its inception
in 1968 for which in the beginning he received no compensation; and
WHEREAS: the Ecumenical Association for Housing and Martin Mackey
realized the housing need in Marin County for heterogeneous income and age groups; and
WHEREAS: the Ecumenical Association for Housing made adequate and attractive
housing available to peoples of all incomes and ages in Marin County; and
WHEREAS: the Ecumenical Association for Housing under Martin Mackey's
leadership is the only agency dealing with the problems of affordable housing for
families; and
WHEREAS: under Martin Mackey's leadership the Hi1arita was sponsored,
developed and made operative in the City of Tiburon to provide housing for low and
moderate income residents, and
WHEREAS: Martin Mackey has contributed to the Tiburon Peninsula and
the County of Marin in a selfless and dedicated manner.
NOW, THEREFORE, BE IT RESOLVED: that the City Council of the City of
Tiburon does hereby commend Martin Mackey for his dedicated and generous service to
the community.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
AMENDING PROCEDURES FOR ENVIRONMENTAL IMPACT REVIEW
WHEREAS, Section 21082 of the Public Resources Code of the State
of California requires that all public agencies shall adopt procedures
for the evaluation of projects and the preparation of environmental
impact reports pursuant to the Environmental Quality Act of 1970; and
WHEREAS, pursuant to Section 21083 of the Public Resources Code,
the Secretary of the Resources Agency of the State of California has
adopted guidelines for the implementation of the Environmental Quality
Act of 1970; and
WHEREAS, pursuant to said guidelines, the City Council adopted
Resolution No.664, adopting procedures and guidelines for, and exemp-
tions from, environmental impact review; and
WHEREAS, the Secretary of the Resources Agency of the State of
California, on December 23 ,1976, adopted amended guidelines, which
require that the City of Tiburon revise its existing procedures; and
WHEREAS, the procedures attached hereto as Exhibit A are
consistent with the provisions of said guidelines as amended by the
Secretary of the Resources Agency of the State of California, and with
the Environmental Quality Act of 1970, as amended;
NOW THEREFORE, BE IT RESOLVED that the City Council hereby
adopts as its procedures for the evaluation of projects and the prepara-
tion of environmental impact reports pursuant to the Environmental
Quality Act of 1970, as amended, the procedures attached hereto as
Exhibit A.
BE IT FURTHER RESOLVED that the procedures adopted herein shall
supersede the procedures adopted by Resolution No. 664, except that
any project as to which an environmental impact report has been
certified prior to the date on which this resolution has been adopted,
shall be governed by the procedures adopted by Resolution No. 664

in a cooperative program of improvement of an Urban Thoroughfare
System, and
WHEREAS this program is of mutual benefit to both the County
and Cities of Marin; and

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TIBURON APPROVING THE PRECISE PLAN FOR THE
CAHN/LEWIS DEVELOPMENT.
WHEREAS: the Precise Plan of the Cahn/Lewis development has been
submitted to the Planning Commission and found in compliance with the approved
Master Plan and Text for the Cahn/Lewis development dated July 28, 1975, and
WHEREAS: the City Council has held a public hearing on the revised
Precise Plan and Text for Phase II and considered all arguments both for and
against said plan, and
WHEREAS: the revised Precise Plan and text as Exhibit A, dated
February, 1977, have been conditionally recommended for approval by the Planning
Commission, and
WHEREAS: said maps meet the requirements of Section 10-4 G 2 and 27
of the Tiburon Zoning Ordinance and Chapter 14 of the Tiburon Municipal Code.
NOW, THEREFORE BE IT RESOLVED: that the Precise development Plan for
the Cahn/Lewis development prepared by Ber1ine Associates dated September 19, 1975,
consisting of 8 pages, as revised by composite attached hereto as Exhibit A,
and water use and reclamation report, prepared by Gonzales/Oberkamper, dated
July I, 1975, consisting of 15 pages, and soils mechanic report prepared by
Cooper Clark dated September 2, 1975, and the revised Precise Plan dated February,
1977, are approved by the City Council of the City of Tiburon subject to the
following conditions:
I. That the revised Precise Plan shall be subject to all conditions
of the City of Tiburon's Zoning Ordinance, prior to the City Council approval of
the Final Map.
2. That all subdivision improvements shall be subject to the approval
of the Board of Adjustments & Review.
3. That a Tentative Map be filed and processed by the City.
4. That all conditions specified on Sheet "T" of the Precise Plan
shall constitute conditions of approval of the Precise Plan.
5. That In-lieu park and recreation fees of $4,737.70 shall be paid to
the City of Tiburon in accordance with the applicable ordinance and prior to
recordation of the Final Map. These funds are to be spent in conformance with
Section 14-50 of the code and Chapter IV, Article III of the Subdivision Map Act.
6. That parcels A, B and C,.consisting of 16+ acres uf Open Space Preserve
excluding waste water reclamation facilities and easements shall be dedicated to the
City of Tiburon prior to recordation of the final subdivision map in a form suitable
to the City Attorney. The precise location and extent of the well. water reclamation
facilities and easements shall be subject to the approval of the City Engineer.
7. That prior to the recordation of the Final Map the applicant shall
submit to the Department of Community Development a copy of the deed and title
restrictions for approval by the City Attorney.
8. That the drainage system shall be installed as shown on sheet 7 of
Exhibit A dated September 19, 1975, as set forth and before described in Ordinance
161 N.S., Section 2 D.

9. Prior to approval of the final subdivision map, applicant shall
submit evidence satisfactory to the City that all utilities serving the entire
development are available.
10. Building envelopes setbacks on Lots 5, 6 and 7 shall be thirty
(30) feet from the pavement to conform with lots across Avenida Mira Flores.
II. Prior to the approval of the Final Subdivision Map, the City shall
assure itself that the Regional Water Quality Control Board requirements have been
met.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the City Council finds that
the proposed subdivision, together with the provisions for its design and improve-
ments, is consistent with the City's general plan.

A RESOLUTION OF THE CITY OF TIBURON ENDORSING AND
SUPPORTING THE REGIONAL HOUSING SUBSIDY DISTRIBUTION
SYSTEM AND AUTHORIZING THE ASSOCIATION OF BAY AREA
GOVERNMENTS TO APPLY FOR SUPPLEMENTAL FEDERAL HOUSING
ASSISTANCE ON BEHALF OF MARIN COUNTY AND THE CITY OF
TIBURON.
~
WHEREAS: local governments in the Bay Area have developed local housing
elements and housing assistance plans, pursuant to State and federal requirements;
WHEREAS: local governments acting through ABAG, the areawide planning orga-
nization for the San Francisco Bay Area, have committed themselves to improved
housing for low and moderate income people regionwide in Phase 1 of the
Regional Housing Element, approved by ABAG's Executive Board of August 21,1975;
WHEREAS: through Title 11 of the Housing and Community Development Act
of 1974, federal housing subsidies are available to assist low and moderate
income people get decent housing that meets their needs;
WHEREAS: federal housing subsidies are distributed among the nine Bay Area
counties and their municipalities according to the Regional Housing Subsidy
Distribution System, developed and approved by ABAG's Executive Board on September
16, 1976, following extensive communication with local elected officials, citizens
and public groups;
WHEREAS: said regional system sets numerical goals for the distribution
of low and moderate income housing assistance to the nine Bay Area Counties
and their larger municipalities in support of locally developed Housing
Assistance Plans; and
WHEREAS: ABAG shall apply for additional federal housing assistance on
behalf of local governments and participating jurisdictions which support and
endorse said regional system;
NOW THEREFORE, BE IT RESOLVED, that the City of Tiburon, a participating
jurisdiction, supports implementation of the goals and objectives of ABAG's
Regional Housing Subsidy Distribution System and urges ABAG to seek additional
federal housing assistance to meet the needs identified in Marin County.

WHEREAS: said Noise Element sets forth a general objective and
supporting policies which will serve as a guide for the future planning
and development of the City; and
WHEREAS: the Planning Commission of the City of Tiburon has studied
and reviewed said Noise Element on November 3, 1976 and on January 5, 1977
and has approved said Element; and
WHEREAS: the City Council of the City of Tiburon has held two public
hearings on the Element and has reviewed the recommendations of the Planning
Commission.
NOW THEREFORE BE IT RESOLVED: that the City Council of the City of
Tiburon does hereby adopt the Noise Element of the Tiburon General Plan

said EIR, to wit, November 3, December 1 and December 15; and
WHEREAS: the Planning Commission has caused a supplement containing
corrections and comments to be prepared, and reviewed said supplement on
December 15, 1976, and
WHEREAS: the Planning Commission of the City of Tiburon has reviewed
the Draft EIR on the Zelinsky Master plan and recommended that the City
Council review and certify said EIR and supplement as complete and in
compliance with the requirements of the California Environmental Quality
Act as amended, and in so certifying this EIR, the City does not adopt
the conclusions or make any expressed or unexpressed approval of the
project.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of
Tiburon does hereby find that the EIR prepared on the Zelinsky Master Plan
is adequate and in compliance with CEQA and does hereby certify said EIR.

RESOLUTION NO. 879
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TIBURON DESIGNATING LYFORD'S STONE TOWER
AND ITS SITE AS AN HISTORICAL LANDMARK.
WHEREAS: the City Council of Tiburon approves the report of the
Tiburon Planning Commission dated November 17, 1976, on Lyford's Stone
Tower, and accepts the recommendation of said Commission set forth in
Planning Commission Resolution #217, and further approves the report and
findings of the Tiburon Heritage Advisory Committee dated January 4, 1977,
and adopts findings of said Commission and Committee; and
WHEREAS: the Tiburon Heritage Advisory Committee has found, pursuant
to Tiburon City Ordinance 129 N.S. Chapter 13B, that certain structure
commonly known as Lyford's Stone Tower, and the site, described in Exhibit
A, attached hereto and made a part thereof, on which it is situated, are
of historic, cultural, and aesthetic significance, and are worthy of
consideration for protection, enhancement and perpetuation as such; and
WHEREAS: the structure commonly known as Lyford's Stone Tower has
been listed on the National Register of Historic Places, effective
December 2, 1976; and
WHEREAS: pursuant to Tiburon City ~13B-4, the matter was duly
referred to the Planning Commission for a report; and
WHEREAS: the Tiburon Heritage Advisory Committee, subsequent to the
receipt of the report from the Planning Commission, acted to recommend that
the said structure and site on which it is located as described in Exhibit A,
be designated a City historical landmark and its report and recommendations
have been forwarded to the City Council, together with the report of the
Planning Commission; and
WHEREAS: a public hearing was duly set for February 14, 1977, before
the City Council for the purpose of acting on said recommendation; and
WHEREAS: said public hearing was duly noticed by publication in a
newspaper of general circulation in the City of Tiburon at least ten days
before the date of said hearing, and the owners and lienholders of record
of said property were duly notified in writing ten days in advance of said
hearing date; and
WHEREAS: said public hearing was duly held on February 14, 1977,
at which time the City Council, after due deliberation concurred in the
recommendation of the Tiburon Heritage Advisory Committee and the
Planning Commission, that said structure and site ought to be designated
as an historical landmark; and
NOW THEREFORE BE IT RESOLVED as follows:
1. That Lyford's Stone Tower, and the site upon which it is located,
as described in Exhibit A, are hereby designated as an historical landmark
of the City of Tiburon.
2. That no work shall be commenced, and no permits shall be issued
by any city department, for any demolition, removal, destruction, alteration,
repairs, addition or change of any type to Lyford's Stone Tower and its
adjacent walls and terrace, except for routine maintenance and repair, nor
shall any permits be issued for any work to be done on the Stone Tower or
the land area described in Exhibit A, attached hereto and made a part
thereof of this resolution, until the plans for all such proposed work
have been submitted to the Tiburon Heritage Advisory Committee, and,
thereafter, approved by the City Council. All such plans shall first be
submitted to the Tiburon Heritage Advisory Committee for its review,
comment and recommendations, and the Committee shall act upon such
referrals within 30 days after such plans are filed with the City.
The City Council shall act upon said plans and application for permits
at its next regular meeting following the expiration of the 30 day
period provided for review by the Tiburon Heritage Advisory Committee.

RESOLUTION NO. 878
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TIBURON ACCEPTING GRANT OF OPEN SPACE EASEMENT
(STONE TOWER)
WHEREAS, Alfredo L. Caceres and Doris Caceres, his wife,
have offered to deed to the City of Tiburon an easement in perpetuity
for open space purposes pursuant to the Open-Space Easement Act
of 1974, over and across certain real property in the City of
Tiburon; and
WHEREAS, there is located on said property a structure
known as the Lyford Hygeia Stone Tower; and
WHEREAS, said Alfredo L. Carceres and Doris Caceres have
also offered to grant to the City an easement for pedestrian,
maintenance, and repair purposes over and across that portion
of the property on which the Stone Tower is located; and
WHEREAS, a copy of the deed and agreement containing said
offers is attached hereto as Exhibit "A"; and
WHEREAS the said offers have been referred to the Tiburon
Planning Department and the report of the Planning Department has
been received;
NOW, THEREFORE, the City Council of the City of Tiburon
finds as follows:
1. The preservation of the land as open space is
consistent with the Tiburon General Plan.
2. The preservation of the land as open space is in the
best interest of the City for the following reasons:

a. The land is essentially unimproved, except as
stated above, and if retained in its present state, has scenic
value to the public.
b. The document attached to this Resolution as
Exhibit "A" contains appropriate covenants assuring the retention
of the land in its present state.
c. It is in the public interest that the land be
retained as open space because it will add to the amenities of
living in neighboring urbanized areas.
d. For the reasons set forth in this Resolution, the
public interest will be served consistent with the purposes of
the Open-Space Easement Act of 1974 and of Section 8 of Article
XIII of the California constitution.
IT IS FURTHER RESOLVED that the deed of easement attached
hereto as Exhibit "A" be accepted, that the acceptance of the City
be endorsed on the original thereof, that it be recorded in the
office of the Marin County Recorder, and that a copy thereof be
filed with the Marin County Assessor.

RESOLUTION NO. 877
A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF TIBURON
APPROVING THE FEDERAL-AID URBAN PROGRAM RECOMMENDED BY THE
MARIN COUNTY URBAN SYSTEM COMMI TTEE
WHEREAS, the City of
Tiburon
desires to continue to partici-
pate in the Federal-Aid Urban Program for funding approved transportation
projects as authorized by the Federal Highway Act of 1973 and succeeding
amendments, and;
WHEREAS, the Federal Highway Act, the State Transportation Board
and the Metropolitan Transportation Commission required that a program of
projects approved for Federal-Aid Urban funding, be established by a County-
wide Committee consisting of representatives from each City, the County,
Transit District, California Department of Transportation, Golden Gate Bridge
District, and the Metropolitan Transportation Commission, and;
WHEREAS, the Board of Supervisors has approved procedures for the
Federal-Aid Urban Program and the formation of the Marin County Urban System
Committee, and;
WHEREAS, the Marin County Urban System Committee did meet to review
the program and new projects which had been submitted for consideration as
part of a five-year program; and
WHEREAS, the Marin County Urban System Committee did meet to review
the program and new projects which had been submitted for consideration as
part of a five-year program; and
WHEREAS, the Marin County Urban System Committee did approve a five-
year Federal-Aid Urban Program on January 14, 1977;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Tiburon does hereby approve the five-year Federal-Aid Urban Program of
projects beginning 1977-78 recommended by the Marin County Urban System
Committee as follows:

to the Board of Supervisors of the County of Marin, the California
Department of Transportation and to the Metropolitan Transportation

RESOLUTION NO. 876
A RESOLUTION OF THE CITY COUNCIL PROVIDING
FUNDS FOR THE PURCHASE OF BOOKS FOR THE
BELVEDERE-TIBURON LIBRARY.
WHEREAS, the Tiburon City Council adopted resolution No. 863
expressing its intent to contribute to the fund for the purchase of
books for the nonfiction reference section of the Be1vedere-Tiburon
Library if Tama1pais Union High School District and the City of Belvedere
also contributed; and
WHEREAS, Tama1pais Union High School District has approved funding
amounting to $10,000.00 for the Library; and
WHEREAS, the City of Belvedere has agreed to fund one-thira of an
approximate $4,000.00 cost for the purchase of books; and
NOW THEREFORE, BE IT RESOLVED, that the City Council and the City
of Tiburon does hereby:
1. Authorize payment not te exceed two-thirds of $4,000 towards
the purchase of books for the Be1vedere-Tiburon Library
2. Encourages and sanctiones a community fund raising drive to be
held during National Library Week in April
3. Encourages the Marin County Board of Supervisors to complete
the recent expansion project by funding the purchase of
equipment for microfilm system, periodicals and other items

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TIBURON GRANTING AN EXTENSION OF APPROVAL
OF THE PRECISE PLAN AND TEN~TlVE SUBDIVISION
MAP OF THE LITTMAN PROJECT FROM FEBRUARY 10, 1977
TO FEBRUARY 10, 1978.
WHEREAS: On February 10, 1976, Allan, Caroline and Jeremy
Littman filed a Master Plan for the development of 1.7 acres off
Rolling Hill Road; and
wtillREAS: the applicants did request on December 28, 1976
that a one (1) year extension in which to file Tentative and Final
Map be granted, and
WHEREAS: the Planning Commission has reviewed and endorses
this request.
NOW THEREFORE BE IT RESOLVED: that the City Council of the
City of Tiburon has considered said request and hereby grants a
one (1) year extension of the Precise plan and Tentative Subdivision
Map of the Littman Project from February 10, 1977, to February 10,1978,
subject to the conditions of Resolution No. 821.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
ACCEPTING IMPROVEMENTS AT LYFORD DRIVE ROUND HILL ROAD.
WHEREAS, improvements consisting of an asphalt concrete overlay of
Lyford Drive, Round Hill Road and Tara Hill Road and Mar West Street
asphalt concrete plugging, overlay and catch basin have been completed,
and
WHEREAS, the work performed by the contractor Bresnan-Dalecio, Inc.
had been performed in a satisfactory manner and accepted by the City Engineer.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of
Tiburon does hereby accept the improvements to Lyford Drive, Round Hill
and Tara Hill Road, and Mar West Street subject to those provisions of
the agreement with Bresnan-Da1ecio, Inc., dated September 27, 1976.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
ACCEPTING IMPROVEMENTS AT MCKEGNEY GREEN.
WHEREAS, improvements consisting of irrigation and landscaping have
been installed in McKegney Green, and
WHEREAS the work preformed by the contractor Watkin and Bortolussi,
Inc., has been preformed in a satisfactory manner and accepted by the
City Engineer.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City
of Tiburon does hereby accept the improvements to McKegney Green
subject to those provisions of the agreement with Watkin and Bortolussi,
Inc., dated July 16, 1976.
