RESOLUTION NO.~
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
AUTHORIZING THE DESTRUCTION OF RECORDS
WHEREAS: Government Code Section 34090 authorizes the destruction
of certain City records, subject to certain limitations and subject to the
approval of the City Council by resolution and to the written consent of the
City Attorney; and
WHEREAS: it is in the best interests of the City to authorize the
destruction of certain records in accordance with law;
NOW, THEREFORE, BE IT RESOLVED:
1. That the City Manager be authorized to destroy the following records
of the City, provided that they are over five years old:
a. Paid Warrants
b. Paid checks
c. Paid vouchers
d. Accounts payable statements
and invoices
e. Vendor's files
f. City Clerk's receipts for cash
g. City Clerk's deposit receipts
h. City Clerk's business licenses
i. City Clerk's business license cash
receipts
j. Tapes and shorthand notebooks of all
meetings whose minutes have been approved.
2. That notwithstanding, the provisions of the preceding Paragraph !, no
records which consist of any of the following shall be destroyed:
a. Records affecting the title to real
property on liens thereon
b. Court records
c. All records required to be kept by statute
d. Records less than five years old
e. Minutes, ordinances, or resolutions of the
City Councilor any of its commissions or boards
f. Records of archival or historic value
g. General ledgers
h. Planning Department case files
i. Personnel records
j. Engineering records
k. City Council case files
3. That prior to the destruction of any records as authorized by the pro-
visions of Paragraph !, City Manager shall obtain the written approval therefor
of the City Attorney, and shall deliver to the City Attorney and retain in the
City's files an itemized list of all records to be destroyed.

RESOLUTION NO. 698
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TIBURON DECLARING A PUBLIC NUISANCE
AND ORDERING IT~ ABATEMENT.
WHEREAS pursuant-to Section 38773 of the Government Code of
the State of California, the City of Tiburon did adopt Ordinance No. 59 to provide for
the summary abatement of any nuisance and establishing procedures therefore, and;
WHEREAS it has been found that an unfenced pool is in
evidence upon certain property located at l23 Hacienda Drive, further described as
lot 18 Tiburon Properties (A. P. No. 39-l2l-02), and
WHEREAS the aforementioned unfenced pool is detrimental to
the public health, saftey and welfare of the citizens of Tiburon, in that the access-
ibi1ity of the pool provides and attractive public nuisance and does not meet the
standards as set forth in Section l3-5 of the City Code, and
WHEREAS the owners of the subject property have not indicated
a time frame for conformigg to minimum standards in a propitious manner,
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the
City of Tiburon finds and does declare that the unfenced pool on that certain property
located at l23 Hacienda Drive, lOt l8, Tiburon Properties (A. P. No. 39-121-02),
is a public guisance, and does"order that after the expiration of lO days from
the date of the adoption of this Resolution that the City Manager abate the subject
nuisance, and further;
THAT the City Council of the City of Tiburon does order
that the costs of abatement will be assessed upon the above described property and
shall constitute a lien upon such property until paid.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
RECOMMENDING APPROVAL OF THE TENTATIVE AND FINAL MAPS
FOR 30, 32, 34 MARINERO CIRCLE AND 93, 95, 97 LYFORD
DRIVE FOR SIX (6) CONDOMINIUM UNITS
WHEREAS: The Planning Commission has approved a Use Permit on
October 2, 1974, pursuant to which said Commission waived certain soud transmission
requirements in kitchen and entry of 97 Lyford Drive; and
WHEREAS: The Tentative and Final Maps of 30, 32, 34 Marinero
Circel and 93, 95, 97 Lyford Drive Condominiums has been submitted to the Planning
Commission and is compliance with Chapter lO-7.l of the Tiburon Zoning Ordinance, and
WHEREAS: said maps meet the submission requirements of Chapter
14 of the Tiburon Municipal Code, and
NOW, THEREFORE BE IT RESOLVED: that the Tentative and Final
Map of 30, 32, 34 Marinero Circle and 93, 95, 97 Lyford Drive Condominiums are
recommended for recordation subject to the following conditions:
1. That a new drainage plan be submitted to the City Engineer
and approved by him, and implemented prior to the recordation of the Final Map.
2. That the downspouts be brought to the street gutter and
approved by the City Engineer prior to the recordation of the Final Map.
3. That the soil and foundation report be amended to make
reference to a live spring under the parking deck and that a permanent installation
be placed underground to channel the spring.
4. That downspouts connected to the subdrainage system should
be disconnected.
5. That prior to recordation of the Final Map a structural
engineer retained by the City at the applicant's expense certify the structure and
submit a written report to the Department of Community Development stating that the
structure is safe.
6. That all of the above conditions be accomplished prior to
the recordation of the Final Map.
7. That the In-lieu of Park and Recreation fee in the amount of
$6,664.68 be paid in accordance with the applicable ordinance prior to the recordation
of the Final Map.

RESOLUTION NO. 696
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TIBURON RECOMMENDING APPROVAL OF THE TENTATIVE
AND FINAL MAP FOR 80 LYFORD DRIVE FOR EIGHT (8)
CONDOMINIUM UNITS
WHEREAS: The Tentative and Final Map of 80 Lyford Drive Condominiums
has been submitted to the Planning Commission and is in compliance with Chapter lO-7.l
of the Tiburon Zoning Ordinance, and
WHEREAS: said maps meet the submission requirements of Chapter l4
of the Tiburon Municipal Code, and
NOW, THEREFORE BE IT RESOLVED: that the Tentative and Final Map of
80 Lyford Drive Condominiums are hereby approved subject to the following conditions:
1. That the Final Map shall be subject to all conditions of the
City of Tiburon's subdivision Ordinance Section 14-23 and Condominium conversion
deficiencies should be corrected prior to recordation of the Final Map.
2. That prior to the recordation of the Final Map, the applicant
shall submit to the Department of Community Development a copy of the CC & R's for
approval by the City Attorney.
3. That prior to the recordation of the Final Map, the landscaping
plan shall be fully implemented and maintained satisfactorily to the Director of
Community Development or that landscaping requirements shall be accomplished accord-
ing to the new erosion control and screening ordinance.
4. That the erosion control and drainage conditions as specified
in the City Engineer's letter of October 24, 1974 be implemented prior to the
recordation of the Final Map or that a bond be deposited with the City of Tiburon
until such improvements are implemented.
5. That the drainage fee in the amount of $659.11 be paid in accord-
ance with the applicable ordinance prior to the recordation of the Final Map.
6. That the In-lieu of Park and Recreation fee of $9,801.00 be
paid in accordance with the applicable ordinance prior to the recordation of the
Final Map.

RESOLUTION NO. 695
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TIBURON AMENDING RESOLUTION NO. 667 BY INCREASING
THE MEMBERSHIP OF THE TIBURON ADVISORY LANDMARKS
COMMITTEE FROM FIVE TO SEVEN MEMBERS
WHEREAS, Resolution No. 667 officially recognized and
confirmed the appointment of five members to the Tiburon
Advisory Landmarks Committee, and
WHEREAS, said Committee has unanimously requested the
City Council to increase the present membership from five
to seven members.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Tiburon does hereby amend Resolution No. 667 by
increasing the membership of the Tiburon Advisory Landmarks
Committee from five to seven members, and recognizing and
confirming the appointment of the following individuals,
whose terms are specifically stated adjacent to each name:
Wesley Wilkes (January 1975 to January 1978)
Philip Molten (January 1975 to January 1978)
BE IT FURTHER RESOLVED that the Tiburon Advisory Landmarks
Committee shall elect their own Committee Officers which will
be a Chairman, Vice-Chairman and a Secretary/Treasurer.

DEFINING AND ESTABLISHING A PORTION OF STEWART DRIVE AS
A STOP INTERSECTION
BE IT RESOLVED by the City Council of the City of Tiburon as
follows:
SECTION I.
The following portion of Stewart Drive is hereby
defined as a stop intersection and shall be governed by the provisions
of Section 7.1 (a) and 7.1 (b) of Ordinance No. 55:
The westbound lane of Stewart Drive so as to stop traffic at
the intersection of Si1verado Drive and Stewart Drive.

AND VIA SAN FERNANDO AS STOP INTERSECTIONS
BE IT RESOLVED by the City Council of the City of Tiburon as
follows:
SECTION I. The following portion of Paseo Mirasol and Via
San Fernando is hereby defined as a stop intersection and shall be
governed by the provisions of Section 7.l (a) and 7.1 (b) of Ordinance No.
55:
The north and southbound lanes of Via San Fernando and the
east and westbound lanes of Paseo Mirasol so as to stop
traffic at the intersection of Via San Fernando and Paseo
Mirasol.

visions of Section 23.1 of the Tiburon City Code.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON ACCEPTING
GRANT DEED
WHEREAS, the Richardson Bay Land Company, a California
corporation, has offered to grant to the City of Tiburon the real
property described on the Grant Deed attached hereto as Exhibit "A"i
NOW, THEREFORE, BE IT RESOLVED, that the said offer is
hereby accepted, and the City Clerk is authorized to record said
Deed together with a certified copy of this Resolution.
