RESOLUT ION NO. 543
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
AUTHORIZ n~G MAYOR TO ACCEPI' AS S IGNMENTS UNDER
INSTRUMENTS RELAT L~G TO LAND ACQUIRED FROM RAILROAD
WHEREAS, the City of Tiburon has previously acquired cer~ain
real property (former right-of-way) from the Northwestern Pacif1C
Railroad Company; and .
~dEREAS, said Railroad Cornpany had, prior thereto, entered into
a number of agreements (primarily concerning the granting of licenses
and easements) covering the subject property; and
WHEREAS, it appears that the Railroadls interest in these
various agreements should be assigned to the City as the new owner;
NO\\T, THEREFORE, BE IT RESOLVED that the Mayor of the City of
Tiburon is hereby authorized to accept the said assignments offered
by the Railroad Company and is further authorized to agree that the
City of Tiburon will perform and abide by all of the terms, covenants
and conditions therein contained. Said agreements are more particu-
larly described in that certain document entitled ASSIGNMENT on file
with the City Clerk.
PASSED AND ADOPTED at a regular meeting or the City Council of
the City of Tiburon held on June 11th , 1973, by the follow-
ing vote:
