To the Members of Tiburon Town Council,
At the July 21, 2008, meeting of the Belvedere-Tiburon Library Agency (Agency),
the Agency voted the Civic Connection alternative as the preferred placement of
the Library expansion. This alternative places the expansion on the existing
parking lot and locates parking on the land to the back.
The Town of Tiburon General Plan, approved on September 7, 2005, includes
the following declarations in regard to the expansion of the Belvedere- Tiburon
Library.
Implementing Programs for Public Facilities
DT-u: Facilitate expansion of the Belvedere- Tiburon Public Library by
employing streamlined permit review processes typically used
for major public projects.
At this time, the Belvedere- Tiburon Library Agency respectfully requests that the
Council direct Staff to begin implementation of Program DT -u by drafting the
appropriate ordinance for consideration by the Town Council. The Agency is
moving forward with plans for expansion and would appreciate a determination
of the public facility permit review process.

Dear Rev. Reichert:
Thank you for taking the time to talk with me yesterday regarding the
recent problems the Church and the neighborhood have been
experiencing with regard to special events.
I have spoken at length with Ian Pearson of the Pilgrim Heights
Homeowners' Association about recent issues, and with you as well. Both
parties have expressed that the extant Memorandum of Understanding,
which was negotiated between the CCC and the Pilgrim Heights
Homeowners' Association in 2000, sets forth the framework for
harmonious co-existence in the small Rock Hill Drive neighborhood
environment.
I was gratified to hear you restate the CCC's belief that the MOD remains
valid and that it is the CCC's intention to abide by its terms.
Despite recent difficulties, it is my hope that everyone can move forward
from this point forward in a spirit of cooperation to avoid future
problems. If problems nevertheless occasionally occur, I urge the parties
to engage in swift and calm communication and follow-up to resolve
them. If problems persist, I will ask both sides to engage Marin Mediation
Services to facilitate communication and problem resolution, but both the
neighbors and you have expressed the opinion that such a step is not
necessary at this time, or perhaps ever.
In conclusion, I believe the Church has a right to its activities, but the
neighborhood also as a right to not be overrun with traffic and parking
problems as a consequence. The MOU sets forth a plan to avoid and
minimize problems; .,<;<~~nce both sides have affirmed their belief in its
efficacy, it sh?ulc~ work if its terms are honored.

Dear Committee:
It was approximately the summer of last year that we met and discussed in depth the
progress of this project. I believe the last direction the Town received from the
Committee was to put the project on-hold; to be revisited at some later date.
In a recent discussion with PG&E, they strongly recommended that we close out the
project with them since there is no activity with the project. While open, the project
continues to accrue administrative charges which is eating into our original deposit with
them. In fact, it has already surpassed the deposit by a substantial amount. We still need
to reconcile this with them in one way or another.
While we resolve this with them, the Town concurs with their recommendation that the
project be closed out with PG&E. There is no drawback with this approach, and the
project can be restarted at a later date if desired. There is only an upside by no longer
accruing administrative charges. We will proceed to close out this project with PG&E
in two weeks time. If you have any comments, please provide it to us within this period
for consideration.

The residence at 6 Acela Drive has been unoccupied for seven years. Considerable paint has
cracked and peeled off. Lot landscaping has been untouched for seven years. Gates, fencing,
and walls have deteriorated. The property is a blight and eyesore to an otherwise beautiful
street.
More importantly, yard weeds have grown to over two feet and are extremely dry. We believe
the property now constitutes a serious fire hazard.
Many owners of adjacent properties and others on Acela Drive have attempted to contact the
owner and owners attorney who do not live in Tiburon. These contacts received no response.
We, the undersigned neighbors, are appealing to you to help us in getting something done to
clean and upgrade the appearance of this lot and building and to remove the weeds and fire
hazard conditions.

I am bringing to your attention and requesting your assistance on an issue of some
concern to the Town of Tiburon. As you may already be aware, there is a 25 foot wide
public services easement that forms the rear portion of the above-listed Rancho Drive
lots in the Cypress Hollow Subdivision. This easement combines with a 15 foot wide
drainage easement located on adjacent properties along Blackfield Drive to encompass
what is locally called the West Ditch of Flood Control District #4.

Portions of this easement area were heavily landscaped in the early 1990's in response
to County of Marin conditions of approval on the Cypress Hollow Subdivision. The
landscaping within this area is owned and maintained by the Town of Tiburon as part of
the Cypress Hollow Landscaping & Lighting Assessment District, which was assumed
by the Town of Tiburon when the Cypress Hollow area annexed into Tiburon in 1999.
As you will see from the attached materials, the purpose of the landscaping installed in
the easement area was to create a dense, layered screen of vegetation between the
newly-created Cypress Hollow lots and existing homes along Blackfield Drive. In
recent months, the Town has noted numerous instances of cutting of vegetation in the
easement area. Some of these cuts have been performed by Cypress Hollow residents,
who have again been warned of the illegality of such cutting (see attached materials).
The Town is aware that both Flood Control District #4 maintains facilities within the
easement that do require ongoing maintenance and periodic trimming and removal of
vegetation. We certainly respect your obligation and recognize the importance of
maintaining an unobstructed flood prevention channel in this easement area. However,
we would respectfully request that the Flood Control District and its contractors be
especially sensitive to preserving the screening effects created by the vegetation. We
would urge you to minimize the loss of such screening as much as reasonably possible
while properly maintaining your facilities within the easement.

Dear Mr. Martaen:
I received a copy of a letter of complaint from six of your neighbors, who are
concerned about this property that has been unoccupied and in a state of
neglect for six or seven years.
In response to an earlier complaint in 2005, your property manager, Mr. Tsan,
constructed an air-tight cover over the abandoned swimming pool, which
effectively dealt with the safety and mosquito breeding problems.
The cover is still in place and functioning as intended, but the current concern
is the neglected state of the property, both from an aesthetic and fire safety
point of view. '
I spoke to Mr. Tsan this morning and he asked that I fax him instructions for
cleaning up the property. He also mentioned that you have contracted with a
local architect to proceed with the interior remodel project that was abandoned
shortly after the interior demolition was completed. Please provide me with
the name of your architect and the date that you expect plans to be submitted
for review.
In the meantime, please have Mr. Tsan clean up the property by removing all
dead vegetation that could pose a fire hazard. A general cleanup would also
make this abandoned property less offensive to the neighbors and pose less of
a hazard as an attractive nuisance.
I remind you again of CBC Section 3401.2, which requires the owner of a
property to maintain the property in a safe and sanitary condition.
Please respond promptly and avoid imposition of penalty fees.

Dear Rancho Drive Owner and/or Resident:
As you may already be aware, there is a 25 foot wide public services easement that
forms the rear portion of your Rancho Drive lot. This easement begins at the outer side
of your rear yard fence and includes the access road and drainage ditch. All
landscaping within the easement area is controlled and maintained by the Town of
Tiburon through the Cypress Hollow Landscaping & Lighting Assessment District.
Please be further advised that when the Cypress Hollow Subdivision was approved, the
developer (Southwest Diversified) was required to plant trees and shrubs in this 25 foot
wide easement area in order to provide dense screening between your/lots and existing
Blackfield Drive homes (see attached document).
All trees and shrubs within this easement are maintained by the Town of Tiburon in
such a manner that their primary screening function is preserved. Please be advised
that you are not allowed to trim, alter or remove any of the trees. or shrubs located
within the 25 foot wide easement. Unauthorized cutting of vegetation in the easement
will be subject to citations, fines, penalties, and possible criminal prosecution.
If you have concerns or problems with any of the trees or shrubs in this easement area,
please contact Joel Brewer, Superintendent of Public Works for the Town of Tiburon, at
(415) 435-7399. Mr. Brewer is in charge of the maintenance of this area and will be
able to assist you.

SCREEN IMPROVEMENTS

THEME
The landscape screening for lots 10 through 21 from Blackfield Drive shall consist of
layered screen elements. These screen elements shall have an immediate effect and
continue to grow to provide a denser screen as time passes. The elements shall consist
of a wood screen fence, large shrubbery and trees on both edges of The Richardson Bay
Sanitary District twenty five foot {25'} easement and trees within the rear yards of lots 10
through 21. The screen improvements will re-establish lush green backdrop behind the
existing Blackfield Drive residences.
FENCE
. ,
The fence shall be immediate in size and impact. The fence is solid to four feet {4'} with
an additional two feet {2'} of lattice. The fence shall be located along the rear property
line of lots 10 through 21.
RICHARDSON BAY SANITARY DISTRICT EASEMENT PLANTING
The planting consisting of trees and shrubs will be on both sides of the access road. The
plants on the two sides of the access road will not be symmetrical.
The area between the West ditch and the access road will incorporate areas of low
groundcover shrubs only approximately twenty {20} feet in length at approximately one
hundred feet {1 DO'} intervals. These areas are intended to serve as points of access into
the West ditch for maintenance and would also provide for establishment of sedimentation
basins where cat tails or other plants would be encouraged to grow to help trap
sedimentation. To facilitate coordination, the landscape contractor will work with Flood
Control staff to field locate some of the plantings. These lower shrubs will occur in
locations which have existing screens occurring in the backyards of the homes along
Blackfield Drive. The lower shrubs in use in these areas shall be Lonicera involucrata
{California Honeysuckle} and Symphoricarpos albus {Snowberry}. The installation size
of these shrubs shall be five {5} gallon. The remaining area shall be comprised of the
following trees and shrubs. The tree plantings shall be comprised of the following trees:
Acer macrophyllum {Bigleaf Maple}, Acer Negundo {California Box Elder}, Aesculus
californica {California Buckeye}, Fraxinus latifolia {Oregon Ash}, Quercus lobata {Valley
Oak} and Salix lasiandra {Yellow Willow}. The tree sizes shall be determined by the
largest container sizes per species locally available up to 24" box. There are 97 trees to
be planted in this area. There breakdown IS as follows: Bigleaf Maple 11, California Box
Elder 15, California Buckeye 13, Oregon Ash 14, Valley Oak 8, and Yellow Willow 36. The
shrub planting shall be comprised of the following shrubs: Calycanthus occidentalis
{Spicebush}, Cornus stolonifera {Redtwig Dogwood}, Rhamus californica {California
Coffeeberry}, Ribes speciosum {Fuchsia Flowered Gooseberry} and Sambulus cacrulea
{Blue Elderberry}, as the low growing shrubs: Lonicera involucrata {California
Honeysuckle} and Symphoricarpos albus {Snowberry}. The minimum size of the shrubs
shall be five {5} gallon. There are 579 shrubs to be planted. Their breakdown is a
follows: Spicebush 62, Redtwig Dogwood 51, California Coffeeberry 117, Fuchsia
Flowered Gooseberry 42, Blue Elderberry 42 and as the low growing shrubs, California
Honeysuckle 69 and Snowberry 22.
The area between the access road and fence shall be continuously planted with screening
shrubs. The tree planting have some areas of open areas which are screened by the
trees on the West ditch side or in the rear yards along Blackfield Drive. The planting shall
be comprised of the following trees: Acer negundo {California Box Elder} Sequoia
semperviren {Coast Redwoods} and Alnus cordata {Italian Alder}. The minimum size
of these trees shall be fifteen {15} gallon. There are 82 trees to be planted. Their
breakdown is as follows: California Box Elder 11, Coast Redwood 43 and Italian Alder
28. The shrubs planting shall be comprised of the following shrubs: Heteromeles
arbutifolia {Toyon}, Prunus i1icifolia {Hollyleafed Cherry.} and Rhamus californica
{California Coffeeberry} and Lonicera involucrata {California Honeysuckle}. The
minimum size of the shrubs shall be five {5} gallon. There are 288 shrubs to be planted.
Their breakdown is as follows: Toyon 46, Hollyleafed Cherry 21 and California
Coffeeberry 134 and California Honeysuckle 87.
REAR YARD PLANTING
The individual lots shall have some trees located in the back yards to supplement the
screening located in the easement area. The location of the trees vary on each lot to
provide maximum screening. The trees used in the rear yards are: Sequoia
sempervirens {Coast Redwood}, Alnus cordata {Italian Alder} and Tristania conferta
{Brisbane Box}. The sizes of these rear yard trees are minimum fifteen {15} gallon with
twenty four inch {2411} box and thirty six inch {3611} box trees. There are forty one {41}
trees to be planted. They break down as follows: Coast Redwood, 11-2411 box, 8-3611 box,
Italian Alder 13-15 gallon, 3-24" box, Brisbane Box 5-15 gallon and 1-36" box.
GROUNDCOVER FOR REAR YARD LOTS
Two {2}, non-irrigated hydroseed groundcover mixes are proposed at this time. For
erosion control/re-vegetation hydroseed mix # 1 {Native Grass #37} shall be used in
areas requiring re-vegetation and hydroseed mix #2 {Flower Meadow - Tiburon
groundcover #57 modified} shall be used in cut and fill slopes up to 3:1 in steepness.
The Flower Meadow hydroseed mix shall receive supplemental water by water truck a
minimum of twice {2} a month for three {3} months after germination is established.
CYPRESS HOLLOW SCREEN IMPROVEMENTS
PLANTING METHODS
The drought has significant influence on the method of planting and maintenance of the
plant material. The holes for planting should be dug significantly over size. A five gallon
{5} container planting should have a hole dug three feet by three feet {3'x3'}. These
holes should then be filled with water, a minimum three {3} times enabling the water to
seep into the soil and build a moisture reservoir. When installing the actual plant the plant
should be installed at surrounding soil level, allowing for settling and water again three
{3} times. Note, the soil below the plant should be compacted to insure the new plant,
particularly the trees, do not settle to oelow grade. Reclaimed water can be used to
create the moisture reservoir if it is not high in salts or other plant inhibiting elements,
future irrigation water should be as chemically free as possible. The drought eliminates
natural rain leaching process of chemicals, therefore a higher quality of reclaimed water
if required.
IRRIGATION
The trees and shrubs within the easement shall be irrigated with pressure compensating
bubbler drip heads delivering 1/4 gallon per hour per head. there are approximately 362
heads requiring 90.50 gallons of water an hour when operating.
The water for this required irrigation could be supplied in a number of the following ways.
In the interim drought period, water shall be imported to the site utilizing well water or
reclaimed water. The water must be cleaned and filtered to eliminate clogging of low flow
irrigation drip bubbler heads.
MAINTENANCE
The maintenance of the twenty five foot {25'} wide easement shall be eventually
maintained by the Assessment District after the ninety {90} day establishment period.
Southwest Diversified shall maintain the area prior to the turn over of maintenance to the
district. The planting in the rear yards of the lots shall be the maintenance responsibility
of the new homeowner.
IMPLEMENTATION SCHEDULE
The creation of the screening improvements shall be installed immediately upon agency
approval of this project and before any residential permit is granted so as to allow
additional time and growth to screen the future home construction. These improvements
shall include installing the screen fence and planting all trees and shrubbery in the
easement. An irrigation program shall also be installed with the screen improvement
system. The trees on the individual lots shall be installed upon sale of the new residence
depending on the drought situation.

Dear Mr. Beuhler:
I am bringing to your attention and requesting your assistance on an issue of some
concern to the Town of Tiburon regarding landscaping in the above-described area.
The Town's concerns are set forth in the attached letter dated July 31, 2008 to the
County of Marin Public Works Department, which also maintains facilities in the
easement area. I would request the same sensitivity when trimming or cutting the
screening landscaping in this easement area as is requested of the County Public Works
Department.

To Whom It May Concern:
The Belvedere Tiburon Chamber of Commerce proposes a
change in the ordinance regarding deliveries on Main Street.
Currently delivery vehicles are not allowed past 11 :OOam. We
would like the 11 :OOam deadline changed to 11 :45am.
We believe the change to 11 :45am will have very little impact on
downtown traffic or business. The downtown is generally very
quiet before noon Monday thru Friday. The few deliveries that
happen on weekends are normally done by 10:30am.
Even though purveyors (mostly of restaurants) are aware of the
current 11 :OOam deadline, it is sometimes difficult for them to
comply. Many times beer, liquor or grocery deliveries will be
well over 100 cases (sometimes even 200 cases). It may take
as long as one to two hours to unload and deliver one truck.
Fresh seafood presents another delivery issue. Fresh fish is
ordered in the morning for same day delivery. An extra 45
minutes will give seafood companies significient extra time to
receive product and deliver it to Tiburon.
Fuel costs are another sign ificient issue relating to delivery
times. All companies are taking their costs into account when
planning their routes. Again, the extra 45 minutes would give
them some extra leeway.
(This matter will be voted on at the Board Meeting 8/6/08)

Dear Peggy Curran,
Here is a "green suggestion" for your consideration: will the Town consider
requesting or requiring that the Boardwalk and Delano Market set up recycling containers
for aluminum, plastic bottles, glass and newspaper?
I see that Shark's Deli has recycling containers already.
For the past few months I have informally expanded my "litter patrol" as I walk from
the parking lot to work to include salvaging aluminum cans from some of the "garbage"
cans at both markets. I notice that there are also a fair amount of plastic bottles (more
than I want to handle) as well as some glass and occasional newspapers.
Since I only skim the cans, rather than really rummage through the often messy
garbage, I am missing some, along with the other potential recyclables. The volume
probably seems small, but over the course of a year or decades it adds up.
I guess my hope is that the Town will encourage the management of the Boardwalk
Center and the Delano Market folks to work with Mill Valley Refuse to set up recycle
containers.

Dear Mayor Slavitz,
I am writing to you with the hope there is a rational and not monetary reason why I am hearing
jackhammers from the Bank of America before 7AM on a sunny Wednesday morning (7/30).
This has been going on for 2 weeks. I know that B of A brings money and jobs to Tiburon. I also realize
that sometimes there is a need for early morning construction. Today, they were working on the drive
thru window roadway. I really think this could have waited until a normal hour. I'm sure B of A did not
want to disturb any of their customers and did not want their employees to hear this racket first thing in
the morning. What about the residents that live here? Why are we forced to listen to construction at this
ridiculous hour.
PS, I did close the windows and the sliding doors to our deck, no use.
Hope to see some changes regarding the noise i.e. construction, let's not get into the useless leaf blowers
that were outlawed in Palo Alto a few years ago because they only move the leaves from one spot to
another,that this small,quiet community is known for.

Hello, Mr. Hennigan:
I am sorry you are being bothered by nearby construction activity; I know it can be hard to
tolerate.
The Town's municipal code section entitled Hours of Construction (Sec. 13-6) permits
construction work from 7:00 a.m. to 5:00 p.m. Monday through Saturday. Work is not
permitted on Sundays or specified holidays. There is a prohibition on the use of "heavy
equipment (such as graders and backhoes)" before 8:00 a.m. and on Saturdays.
You say the activity is occurring "before 7 AM", which would be inappropriate. I will alert our
building official of the situation so that he can communicate with the contractor and reiterate
the rules.
Please let me know if there are any other questions. Meanwhile, unless you object, I will
include your e-mail in our weekly" digest" of incoming materials so that the entire Town
Council sees your complaint.
