RESOLUTION NO. 2804
A RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF TIBURON
DENYING AN APPEAL OF A DECISION OF THE
DESIGN REVIEW BOARD - 75 BOND LANE
(SIEVERT AND WEBSTER APPLICANTS)
WHEREAS, on August 23, and September 27,1990, the Design Review Board
("DRB") approved a new single family residence at 75 Bond Lane; and
WHEREAS, during the course of the grading on site, the applicant discovered
that the floor elevations as surveyed were ofT by seven feet; and
WHEREAS, on July 11, 1991, the DRB heard an application to allow the
residence to be constructed seven feet higher. The application was denied on the
grounds of inadequate information; and
WHEREAS, an appeal of that decision was filed by the applicants in a timely
manner; and
WHEREAS, on July 25, 1991, the Design Review Board reconsidered the
application, but continued the matter for lack of information; and
WHEREAS, on August 7, 1991, the Town Council held a public hearing on
the appeal. After hearing public testimony, comments of members of the Design
Review Board and considering all evidence submitted, the Town Council voted
unanimously (Kuhn, Friedman, Coxhead--yes; Thayer and Logan absent) to deny the
appeal without prejudice and remand the matter back to the Design Review Board
with instructions as to information to be provided by the applicants to the Design
Review Board.
NOW, THEREFORE, BE IT RESOLVED, that the Town Council of the Town
of Tiburon does hereby deny the appeal of the Design Review Board's July 11, 1991,
decision on 75 Bond Lane without prejudice and remands the matter to the Design
Review Board for a noticed public hearing on August 22, 1991, with the requirement
that the applicants submit the additional information requested by the Design
Review Board at their July 25, 1991, meeting. All such information shall be signed
by a registered civil engineer, surveyor or architect where appropriate.
