RESOLUTION NO. 2757
A RESOLUTION OF THE TOWN COUNCIL OF
THE TOWN OF TIBURON APPROVING GENERAL
PLAN AMENDMENTS THAT ARE PART
OF THE VISTA TIBURON PROJECT
WHEREAS, the Town has received an application from Taldan Investment
Company to construct an infill residential subdivision to be located on 15.66 acres
in the hills of western Tiburon and accessed by Blackfleld Drive and Via Los Altos
(hereafter "the Vista Tiburon site"); and
WHEREAS, the Town of Tiburon did adopt a revised General Plan on
September 28, 1989, the Land Use Element of which presently restricts the Vista
Tiburon site to 13 units at a density of .8 dwelling units per gross acre; and
WHEREAS, the Town and the property owner have entered into a Settlement
Agreement, dated March 28, 1990, which contemplates amending the General Plan
to increase the density to 1.41 dwelling units per gross acre; and
WHEREAS, the proposed development at the Vista Tiburon site would allow
a minimum density of 1.41 dwelling units per gross acre and exceed the maximum
density limits placed on the site by the General Plan Land Use Element, and
therefore requires a General Plan Amendment; and
WHEREAS, the Circulation diagrams of the Circulation Element depict a
trail on the Vista Tiburon site providing access to the Ring Mountain Preserve, and
this trail is proposed for elimination from the diagrams; and
WHEREAS, it has been determined that elimination of the trail would
eliminate land use conflicts due to trespass, littering, noise, and other potential
nuisances; and that adequate trail access is provided to the Ring Mountain PreserVe
from other locations; and
WHEREAS, the Town Council has, in accordance with the provisions of the
California Environmental Quality Act ("CEQA"), certified a Final Environmental
Impact Report prepared in connection with the Vista Tiburon Project, including the
proposed General Plan Amendments set forth below, after a public hearing on
January 16, 1991, by Resolution No. 2755; and
WHEREAS, the Town Council has, in accordance with the provisions of
CEQA, made findings regarding the environmental efTects of the proposed General
Plan Amendments and adopted a statement of overriding considerations after a
public hearing on January 16, 1991, by Resolution No. 2756; and
WHEREAS, the Town Council finds that the General Plan Amendments as
proposed would be consistent with other portions of the General Plan, Tiburon
Zoning Ordinance, and other applicable regulations.
NOW, THEREFORE, the Town Council resolves as follows:
The Town Council directs that the Town of Tiburon General Plan be amended
as follows:
(a) Table 1, Land Use Element, page 12: Change units and
DU/acre to reflect 22 units and a 1.41 DU/acre density for the
Taldan property.
(b) Diagram LU-3, Proposed Land Use, Land Use Element:
Change Vista Tiburon designation from ML (Medium Low
Density Residential) to M (Medium Density Residential).
(c) Diagram OSC-2 (Open Space Areas) and OSC-3 (Potential
Open Space), Open Space & Conservation Element: Amend
diagrams to reflect the open space and development areas
consistent with the Vista Tiburon project.
(d) Diagram C-l (Existing Circulation) and Diagram C-2
(Proposed Circulation), Circulation Element: Change diagrams
to eliminate existing private trail on the Vista Tiburon site.
(e) Table 3, Housing Element, page 20: Change units and
DU/acre to reflect 22 units and a 1.41 DU/acre density for the
Taldan property.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Tiburon held on January 16, 1991, by the following vote:
