HomeMy WebLinkAboutTC Res 1991-09-03 RESOLUTION NO. 2806 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON CERTIFYING A NEGATIVE DECLARATION FOR ZONING ORDINANCE AMENDMENT Z91-1 REGULATING "UNDIVIDED INTEREST" PROJECTS Section 1. Findines. A. The Town has initiated an amendment to the Zoning Ordinance in order to regulate "undivided interest" projects by requiring a Conditional Use Permit priot to approval of said projects. B. An initial study and draft Negative Declaration have been prepared and circulated for the project. Notice of the Draft Negative Declaration was published in the ARK Newspaper and posted in the required places pursuant to the Town's Environmental review Guidelines and CEQA statutes. The 21-day public review and comment period on the Negative Declaration closed on August 28, 1991. No comments were received. C. The Planning Commission has held a duly noticed and advertised public hearing on August 28, 1991, and has adopted a Resolution recommending that the Town Council certify the Negative Declaration. D. The Town Council has held a duly noticed and advertised public hearing on September 3, 1991, and has considered Draft Negative Declaration and the recommendation of the Planning Commission. E. The Council also finds that the zoning ordinance amendment (the project) will have a de minimis effect on fish and wildlife and the Council declares that the State Department of Fish & Game is not entitled to payment of fees on that basis. Section 2. Certification of Neeative Declaration. NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Tiburon hereby certifies the Negative Declaration for Zoning Ordinance Amendment Z91-1 concerning "undivided interest" projects and declares that the Negative Declaration has been prepared and reviewed in accordance with all requirements of the California Environmental Quality Act and the Town's Local Environmental Review Guidelines. PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Tiburon on September 3, 1991, by the following vote: AYES: COUNCILMEMBERS: Friedman, Coxhead, Logan, Thayer NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: Kuhn ATTEST:
