The regular meeting of the City Counci I of the City of Tiburon, State of Cal ifornia,
was cal led to order by Mayor Gordon W. Strawbridge at 8:20 p.m., January 24, 1966, at
the Del Mar School.

It being the appointed time to hear the appeal of Mr. and Mrs. John M. Hieb,
dated January 6, 1966, from the decision of the Planning Commission on January 3,
1966, denying an appl ication for an adjustment permit to al low two single-fami Iy

The Administrator present80 ino applicaiion as heard
by the Planning Commission and reviewed the proceedings of the Planning Commission
which led "to denial of the appl ication.
Mrs. Hieb presented a letter dated January 23, 1966, stating grounds of the appeal
accompanied by a petition signed by neighbors in the Greenwood Beach area.

The City Attorney expressed doubt that tho authorization sought for could be
granted by adjustment, giving it as his opinion that rezoning was the only way
in which the additional unit could be premitted.
The Counci I proceeded to consider the appoal, having regard for action in former
years by the county to grant adjustment for such purposes and the effect that
continuation of this practise would have on tho community.
Recognizing the request of tho appl icant that somo method be found to give them
reI ief from a tax situation, it was movod by Hannahs, soconded by Hoffmire, to
continue consideration of the appeal to the next regular meeting of tho City
Counci I. Asked by the Chair if the applicant would consent to the continuation

PROHIBITION OF USE AND CARRYING OF FIREARMS IN CITY
Re-introduction
An ordinance entitled AN ORDINANCE OF THE CITY OF TIBURON PROHIBITING THE USE
AND CARRYING OF FIREARMS WITHIN THE CITY OF TIBURON, which was originally
introduced at the meoting of January 13, 1966, and withdrawn beforo roading
was re-introduced.
It was moved by Hoffmire, seconded by EI! inwood, to road the ordinanco by
title only.
Hannahs questioned whether the ordinanco should be amended to restrict tho carrying
of firoarms by juveniles ~to such timos that adult supervision was prosent. ~~___
With permission of the seconder, the mover withdrow the motion to read by title
only. The Chair ordered tho matter be put ovor for consideration by the Administrat-
ion of the proposal of Hannahs.

RECREATION USE OF HIGHWAY LAND
State Division of Highways
The Administrator of Planning and Developmont reviewed the staff report and the
action of tho Planning Commission dated December 20, /965, urging the City
Counci I to enter into agreement to acquire the land by lease for recroational use.
Question was raised as to whether at this time tho City was prepared to approve
an al ignment for the highway as would bo impl iod by adoption of paragraph one
of the proposed pol icy statement.

It was further questioned whether tho Planning Commission at this time noeded
immodiate adoption of th8 proposed p()1 icy statement for purposes of determining
recreational use of the land. The Cnunci I roceived the report of tho City
Manager that the Counci I had already adopted a report recommending use of tho
land for rocreational purposes; that pursuant to instruction nf tho Counci I
he had negotiated a lease of the land for recreational purposes;Qnd that
the lease had beon receivod and was being reviewed by the City Attorney.
After further discussion, motion of Parnel I, seconded by Hannahs, to ccntinue
tho matter and to have Counci 'men EI I inwood and Hoffmire meet with the PI~nning
Commission to draft a limited pol icy statement for tho purpose of furthering
recreationnl use of the lands, carried unanimously.

ESTABLISHMENT OF COUNTY SERVICE AREA FOR MARINCELLO
The Counci I considered a resolution by tho City of Novato 97-65, which
urged the Board of Supervisors to form a county servico area for the
Marincel 10 develorment. Motion of EI linwood, seconded by Strawbridge to
instruct tho City Attorney to prepare a resolution simi larly urging the
Board of Supervisors to form a county service area, fai led:

PETITION FOR REI~~BURSEMENT OF EXPENSES - Tiburon Sanitary District No.5
AND REPORT ON FLOODING - City Manager
Tho Chair ordered that the claim of the Sanitary District #5 for reimbursement
dated October 28, 1965, and tho report of the City Manager, entitlod Flooding
In Downtown Tiburon, dated December 13, 1965, be considered simultaneously.
The City Manager presented an agenda bi I I dated January 5, 1966, recommending
that the claim of tho Sanitary District for reimbursement of a deficit of
$1,729.93 be denied based on four findings set forth in tho bi I I, plus an
additional finding that as early as September 1964 the District was aware
that procoedings could be terminated and expenses incurred would therefor
not be recoverable. OrallY1 the City Attorr,ey concurred with the recommendation
of the City Manager on the basis that roimbursement would be a gift of rubl ic
funds.
Speaking to a finding in the bi I! that tho City might purchase plans and data
from the Sanitary District oS a menns of roimbursement, Hannahs asked if this
would be legally possible. Tho City Attorney gave it as his opinion that the
City could proporly acquire tho plans and data.
Motion of HoffmirG, seconded by Hannahs, to offer to pay to the Sanitary
District Ne. 5 for the plans and data of the suspended assessment proceedings
the sum of $1,200, provided that the City of Belvedere agreed to pay the
District for the plans and data the sum of $500, fai led:

MASTER DRAINAGE PLAN
Turning again to the flooding roportl the City Counci I considered what methods
might bo avai lable to get mnster planning immediately commenced for the down
town water shed including al I faces of Rod Hill and the entire Belvedere Lagoon.
Mr. Dick Adams, Mr. Jack Newel I and Mr. John Pelkan, al I residents of the Cove
Road area of Belvedere, spoke and urged the City Counci I to do what it could
to encourage early 01 imination of flooding problems. !t was proposed by tha r.
City Manager that a consultant be immediatoly sought and that tho City of
Belvedere and the Belvedere Lagoon Property Owners Association be encouraged
to jointly underwrite with the City of Tiburon a master drainage plan exclusive
of the drainage plan which is a part of the appl ication for stato planning
assistance.
Motion of Hoffmire, seconded by Hannahs, to authorize the City Managor to
negotiato with the Belvedere Lagoon Property Owners Association on the basi.s
of contributing 25% of the cost of the drainage planl the balance to be pro-
rated betweon the City of Tiburon and the City of Belvedere and to interview
consultants to prepare the plan, carried:

, UNIFORM TRAFF IC REGULAT IONS
Council received the agenda bill of January 19, 1966, containing the
recommendations of the City Manager that a uniform traffic ordinance
based on the model ordinance of the League of California Cities be
prepared in order to codify existing traffic regulations and establish
a uniform system for enactment and amendment of traffic regulations.
Motion of Hannahs, seconded by Parnell, to adopt the report, instructing
the City Attorney to prepare the ordinance, carried:

PARK AND RECREATION MATTERS

Council received agenda bill dated January 19, 1966, containing the
recommendation of the City Manager that park and recreation matters
not be held until the Park and Recreation Commission is established
but in the alternative that he be authorized to forward urgent matters
to the Planning Commission for action, holding for the Park and Recrea-
tion Commission only urgent matters for the t~e being.
Motion of Hannahs, seconded by Hoffmire, to adopt the recommendations
of the City Manager, carried unanimously.
RECREAT IONAL USE OF LANDS LEASED FROM STATE, PET IT ION TO PERMIT OPERAT ION OF
MINI-BIKES - Mr. and Mrs. Alfred Azevedo
The Council received a letter from Mr. and Mrs. Alfred Azevedo dated
January 8, 1966, asking that they consider permitting use of a portion
of the recreational area near the Richardson Bay Sanitary plant for the
operation by juveniles of "mini-bikes". The Council also received a
letter dated January 20, 1966, from Mr. Robert Gaw, Principal of the
Del Mar School, supporting the Azevedo letter and urging the need for
an appropriate location for this type of recreation.

Thereafter, Council received an agenda bill from the City Manager dated
January 19) 1966) recommending that the proposal be referred to the
Police Dept. for recommendations; the City's insurance carriers for a
report; the Planning Commission for study by its committee rather than
wait for appointments and organization of the Parks and Recreation Com-
mission; and to neighborhood associations.
Mr. W. S. Holcombe appeared before the Council expressing no opposition

to use of the site, but complaining that operation and repair of the mini-
bikes in the neighborhood was objectionable.
Mrs. J. Andrews appeared before the Council and objected to use of the
site on the grounds that it should be a game reserve and because there was
no convenient access.
Mr. Subl, President of the Pine Terrace Property Owners Association, appeared
before the Council and protested on the grounds of noise, dust and the hazard
to small children who might wander onto the site. He submitted a petition
dated February 8, 1966, signed by nineteen people, protesting the proposal.
Mr. H. Lautmann appeared before the Council and protested on the grounds that
it would be a poor public use of the site and the noise caused by the opera-
tion of the mini-bikes would be a nuisance to the neighborhood.
Mr. Arthur Gensler, President of the Little Reed Heights Property Owners
Association, stated that he had contacted some forty people, all of whom
were opposed to the proposal on the grounds that the use would be disturb-
ing to their view and the noise would be distracting. He further proposed
that the school site should be considered as an alternative and the proposal
be summarily rejected without further consideration.
Mr. Earl Fern objected on the grounds that dust and noise would disturb the
neighborhood.
Mr. Hokesine appeared for the Reedlands Property Owners Association and
entered a general objection.
Mr. James Johnston objected that a general nuisance would be created by
a limited use of an area intended for general public enjoyment; also, that
the use would pose a hazard to the horse "Blackie".
Dr. Samuelson raised questions of public liability and the problems of
regulation if the use were pe~itted.
There being no further appearances, the Chair ordered the matter submitted
to the Council.
Councilman Hannahs urged the need for the acco~odation of recreational
activities for juveniles and proposed that the matter be studied further
before rejection.
Councilman Parnell protested allegations that the Council was about to act
without public awareness and observed that, since the mini-bikes could not
he operated on public streets, an off-street site would have to be found.
Councilman Ellinwood observed that due procedur~ should be followed before
any action.
Councilman Hoffmire observed that the proposed type of juvenile recreation
was not suitable to this area.
Motion of Hoffmire, seconded by Ellinwood, to close the matter without fur-
ther reference on the grounds that the proposal conflicted with community
purposes, failed:

Hannahs asked that the minutes show his vote was occasioned by a lack of
sufficient information upon which to reach a decision.
It was moved by Parnell, seconded by Hannahs, to adopt the recommendations
of the City Manager.
On the recommendation of the City Manager, it was moved by Hannahs, seconded by

Parnell, to amend the main motion by authorizing the City Manager to consider
whether recreational use of mini-bikes was feasible anywhere in the city,
rather than merely at the proposed location.
The motion to amend the main motion carried:

COMMENDAT ION FOR COMMITTEE APPEARANCE IN RE ANGEL ISLAND
The Chair commended Councilman Ellinwood for her initiative in appearing
before a committee of the Board of Supervisors of the City and County
of San Francisco resulting in postponement of action on a recreational
proposal regarding Angel Island then being considered, until conferences
could be held with representatives of the City of Tiburon.

SUBDIVISION ORDINANCE AND BUILDING ORDINANCE
The City Council recessed and convened as a Committee of the Whole for
the purpose of considering a proposed subdivision ordinance and a pro-
posed building ordinance.
Mr. Sidney Williams, Plannin~ Consultant, was present to discuss the sub-
division ordinance which had been prepared by his firm.
After hearing a representative of the Pacific Gas and Electric Company,
the committee changed the wording of Section 8.11.
The committee then proceeded to consider the building ordinance in consul-
tation with the Administrator of Planning and Development.
The committee reported out the ordinances with recommendations that they
be adopted and thereafter adjourned.
At 11:45 p.m. the City Council reconvened after having received the report of the
committee of a whole and adjourned sine dei.

APPEAL PLANNING COMMISSION DENIAL OF ADJUSTMENT PERMIT
Mr. and Mrs. John Hieb, 396 Greenwood Beach Road
The City Attorney stated the rules under which the appeal would be heard.
Mrs. Heib, presented a letter dated January 23, 1966, which was introduced into
evidence and marked Exhibit A.
Mrs. Heib, presented a letter dated February 14, 1966, which was introduced into
evidence and marked Exhibit B.
The City Manager then preceeded to read the letter from Mr. and ~~rs. Heib to
the City Council dated February 14, 1966.
The City Attorney stated that the adjustment permit could be granted if there
were special circumstances or conditions appl icable to the land, building or
use referred to in the appl ication; that tho granting of the appl ication is
necessary for the preservation and enjoyment of substantial property rights;
that the granting of the appl ication wi I I not materially affect adversely the
health or safety of persons residing in the neighborhood of the property of
the appt icant and wil I not be materially detrimental to the public welfare or
injurious to property of improvements in said neighborhood.
Wi I 1 iams, Cook and Mocine letter dated January 19, 1966, was introduced into
evidence, marked Exhibit C and then read.
The Administrator of Planning and Development stated that he agreed with the
January 19, 1966 letter from Wil I iams, Cook and Mocine and the findings of
the Planning Commission.
The Department of Planning and Development report dated January 3, 1966, was
introduced into evidence and marked Exhibit D.

Ordinance No. 36 be repealed, as wel I as those sections of Ordinance No. 13
and 14 prohibiting parking within 9 feet of the center I ine of the street,
and instead an ordinance be enacted appl icable to al I streets of the City
which would prohibit parking except where 12 feet of clearance was avai 'able
on the side, ahead and behind.

authorizing the Mayor to execute the lease on behalf of the city; that the
City Manager be authorized to designate the Superintendent of Construction
and Maintenance as the administrativo authority responsible for operation

The City Council received an agenda bi I I dated 21 February, 1966, introducing and
recommending adoption of a resolution providing for stop signs at the exits to
the parking lot for the Boardwalk Shopping Center, Tiburon Blvd. and Beach Road;
and the exits from the Safeway parking lot on the east side of Tiburon Blvd.
at Beach Road.
Ellinwood questioned whether the prol iferation of stop signs could not be fore-
stal led by the construction of a stacking lane on Tiburon Blvd. for left turns
into the Safeway parking lot and a reorganization of the circulation pattern
entering and exiting the Safeway lot. Sgt. Barnes observed that delays would
insue while negotiating with the state for construction of such a lane, and
that it would be costly to instal I.
After further questions, it was moved by Hoffmire, seconded by EI I inwood, to
adopt Resolution No. 97. After further debate, the question being cal led for,

INCREASE IN POLICE SERVICES
The City Council received an agenda bi I I dated February 21, 1966, recommending
the addition of a second deputy to the weekend staff of city pol ice services,
to be on duty from Friday night to Sunday night; the promotion of Sgt. George R.
Barnes to Lt.; and the renting of an additional car while the other personnel
was on duty, the total cost for the four months remaining in the current fiscal
year computed to be $3,521.00. The bil I also recommendod that the sum of $3,600.00
be approved for transfer from the contingency fund to the general fund to provide
for the cost.
After a comment by Hoffmire, that the increase of personnel was in accordance
with the purpose of providing better service for the city, and that the hi I I
indicated sufficient revenue to accompl ish the increase, it was moved by
Hoffmire, seconded by EI linwood, that the bi I I be adopted. After further

Hannahs commended the department for its operation and inquired if there was any
need for clerical help to reI ieve Sgt. Barnes of clerical duties. Sgt. Barnes
responded that clerical help for perhaps one day a week would be most useful.

The City Counci I received an agenda bi I I dated February 9, 1966, presenting the
landscaping plan for Tiburon Blvd. betweon Reed Ranch Road and Ceci I ia Way as
prepared by Mr. Anthony Guzzardo under authorization of the City Counci I of
October 25, 1965, together with the recommendation of the City Manager that
the plan be approved and that the Manager be authorized to negotiato construction
of the various phases of the plan. Mr. Guzzardo appeared before the Counci I

The question was raised as to whether the use permit was solely for construction
or included approval of uses of the structure. The Administrator of Planning and
Development stated that the appl ication requested approval of use for retai I
stores but the staff report of February 7, 1966, the agenda bi I I of February 24,
1966, and Planning Commission Minutes #52 were found to be mute on this point.
The Chair therefore ruled that the action of the City Counci I in approving and
confirming the action of the Planning Commission constituted approval of retail
sales as a permitted use of this structure.

Geographic Names that Hospital Cove on Angel Island be re-named Ayala Cove,
and containing the recommendation of the City Manager that the change be
opposed. A letter from Mr. Shapovalov, a member of the state agency, dated
February 18, 1966, recognizing possible local opposition to the change, was
also read.
It was moved by Hoffmire, seconded by Parnel I, that the City Manager be asked
to prepare a letter for the signature of the Mayor objecting to the change of
the name. The Mayor expressed favor for the change as being less pedestrian
and more historical. Ellinwood also expressed favor toward the change, citing
Ayala's early explorations of the area, but also observing that the Ayala could
be honored at other locations.

The report of activities for the Department of Construction and Maintenance for the

MUNICIPAL OPERATION OF MERCHANTS PARKING LOT
The report of the City Manager contained in the agenda bi I I dated February 21, 1966,
to the effect that further negotiations with the Northwestern Pacific Rai I road for
municipal operation of the Merchants parking lot on Tiburon Blvd. near Main Street
appeared fruitless, and recommending that in the alternative a prel iminary study be
authorized to determine the cost and effects of widening Tiburon Blvd. between Mar
West-Cove Road on the north and Main Street on the south to provide for curbside
parking, was received. After receiving assurances of the City Manager that the
study was preliminary in nature and woulc constitute no commitment to an undertaking,
and after being assured that the study would not result in any major expenditures,
motion of Hoffmire, seconded by EI I inwood, to authorize the City Manager to proceed
with the study in accordance with the bi I I, carried unanimouSly.
QUESTIONS
Parnel I rut the question of when the Planning Commission would be enlarged from five to
seven members in accordance with the just-adopted Ordinance No.50. The Chair responded
by inviting members of the City Counci I to submit to him names of persons they wished
him to consider for nomination to the Commission.
Ellinwood put the question of whether additional public telephones would be instal fed
in the downtown area and was informed by the City Manager that one additional was being
installed and others were pending; put the question of whether bids for the city's
liabi I ity insurance had been sol icited, and was advised by the City Manager that four
bids had been filed; put the question of whether a study for re-Iocation of the bus
$top near Rock Hi I I Road was under way, and was advised by the City Managor that the
~tate Division of Highways had commenced such a study; put the question of whether any
inquiry had been made of the Northwest Pacific Rai I road as to the possibility of
constructing a foot path across the former rai I road yards; and was advised by the City
Manager that the inquiry had been made and the Rai I road had categorically refused to
permit such a facil ity.

QUESTIONS
Parnel I put the question to the City Attorney on the status of the Aurguey vs. city.
The City Attorney answered that a trial date is being awaited.
Parnel I put the question whon budget study for the next fiscal year would be commenced.
It was the sense of the response that ful I studies should not be commenced unti I after
tho municipal election of Apri I 12, 1966.
Strawbridge put the question of when tho audit would be ready. The City Manager
responded that he expected it to be avai lable for the meeting of the City Counci I
on March 28, 1966.
Hoffmire put the question of the status of the del inquent business licenses which had
been referred to the City Manager for collection. The City Manager responded that tho
thirty-day grace period would end on March 18, 1966, and that he would thereafter
pt'oceed in accordance with the authority earl ier given to him by tho City Counci I.
Hoffmire questioned the propriety of a letter dated February 24, 1966, written by
Hannahs to Mr. Phi lip Lygron purporting to be the final report of an ad hoc committee
appointed to consider the problem of retaining an engineer.
Counci I discussed the question of prorriety raised by Hoffmire after an opinIon by the
City Attorney that the letter had become a matter of publ ic record and was therofore
not privi leged.

The City Manager reviewed McCreary-Koretsky's proposal dated March I I, 1966, to
prepare a drainage study for downtown Tiburon at a cost of $8,850. The City
Manager also proposed an al location of costs between the City of Belvedere, and
the Belvedere Lagoon Property Owners Association, which had previously been agroed
to as a proposal by representatives of the other agoncies.

and stated he would recommend the study and al location to the Belvedere City
Council.
MI-. George Bitter, representing the Belvedere Lagoon Property Owners Association,
appeared before the Counci I and stated that they were agreeable to making the
proposed contribution if was understood that the study would encompass the
problem of si Iting in the Belvedere Lagoon.

The City Manager reviewed his report dated March 24, 1966, rocommending that
Counci I permit the petitioners to withdraw their request to operate mini-bikes
on recreational lands leased by the City from the State.
Motion of EI linwood, seconded by Parnel I, to permit the petitioners to withdraw

COUNTY PARKS & RECREATION BOND ISSUE
The City Manager advised the Counci I that the County Parks and Recreation Bond
Issue presently proposed for the June 7 bal lot might be changed as to the
al location of funds, though as presently proposed no monies would be designated
for the City of Tiburon.
It was moved by EI linwood, seconded by Hofimire, that if the Board of Supervisors
determino that the pro-rata system of 01 locating park and recreation bond funds
be substituted, then the population figures for the City of Tiburon should be
the official population figures rather than other estimates; but if the
present specific project arrangement is retained, then the City would wish t8
be included in the program and monies for the acquisition of a downtown
waterfront park.

The Chair introduced the memorandum regarding the audit which the City Manager had
prsented to the Council on 28 March, 1966, but which had been referred to committee
at that time instead of being read. The City Manager was asked if he cared to
comment on the memorandum. The City Manager responded that it would not now be
necessary, since the City Counci I had probably read it, but that he would respond
to questions.

Hannahs objected that Mr. Soderblom of the auditing firm had not been invited to
be present at the meeting, that the matter was in committee and that the City
Council should not now recal I it from committee without a committee report. The
responded with a rul ing that it was necessary under the circumstances to bring
the matter back to the City Counci I, and this procedure would prevail.
Motion of Hoffmire, seconded by Hannahs, to confirm the ruling of the Ch~ir,
carried.

Questions were put to the City Manager on the purposes of an audit, on his
objections to accrual methods and on the budgeting Qnd reporting system of the
city. Also introduced was a letter from the City Attorney dated Apri I I, 1966,
containing a reference to an opinion from Mr. Soderblom that the books and records
of the city were being kept in a perfectly proper fashion, a conclusion which
Mr. Soderblom bel ieved was made clear in the audit.

the City Manager's records and financial report on the first year's fiscal
operations as reflectod in two seperate examinations by the state and by Dalton,
Graupner and Barber. After discussion of the motion, the question being cal led

DENSITY STANDARDS
Motion of Parnel I, seconded by Hannahs, that the City Councl I ask the Planning
Commission for density standard for al I parts of R-P zones within the City of
Tiburon with reference to the Wi I Iiams, Cook and Mocine report of Sept. 13, 1965,

The City Manager gave a report on the forth-coming election.
Counc: lman Ellinwood gave thanks to the Mayor and stated that it was a privi lege to
serve the City of Tiburon.
Parnel I put the question on the status of a city offices. Hoffmire responded that the
matter was in committee.
Hannahs put the question regarding the State Beaches and Parks Commission access to Angel
Island. The City Manager advised the Council that they desired a meeting with the City
Counci I and the Planning Commission to go over plans.
Hannahs put the question regarding the feasibi lity study with Stone and Youngberg. The
City Manager informed the Counci I that Stone and Youngberg thought a feasibi lity study
WnS premature at this time.~ A feasibi lity study should.be for a specific area.
Mayor Strawbridge put the question of the status of the Downtown Plan. The City Manager
informed the Counci I that the plan was in the Planning Commission.

California, the meeting of the City Council of the City of Tiburon was called to
order for the purpose of canvassing returns of the municipal election of April 12,
1966, and for such other purposes appropriate to the occasi.u. Mayor Gordon w.

Mayor Strawbridge spoke to the Citr CQuncil withdrawing his name from consideration
for re-appointment to the Mayorality. He spoke further of the accomplishments of
the City during its first two years and the achievements of his administration. He
expressed appreciation of the honor of serving as the first mayor of the city.
CANVAS OF RETURNS
The Council proceeding to examine the returns from the municipal election of
April 12, 1966. Upon satisfying themselves that the returns were in order and did
properly substantiate the semi-official returns as previously announced, adoption
of Resolution No. 103 was moved by Ellinwood, seconded by Parnell, a resolution
certifying the results of the municipal election of 12 April 1966, and declaring
elected as Councilmen of the City of Tiburon for terms of four years each, Mr. Thomas
E. Drohan, Mr. William R. Bremer, and Mr. Branwell Fqnning; and certifying further
that the whole number of votes cast in the City of Tiburon in said election were 1,207;
that the names of the persons voted for were: Alfred J. Azevedo, William R. Bremer,
Thomas E. Drohan, Anne L. Ellinwood, Branwe1l D. Fanning, Fred C. Hannahs, Hal R.
Le~ar, Jacqueline A. Parnell; that the candidates were each a candidate for one of
three seats to be vacated at the expiration of proper terms as fixed by law; that
this Board hereby finds that the number of votes cast in said election for each
candidate for the office of Councilman was as follows:

CERTIFICATE OF ELECTION
OATH OF OFFICE
The City Clerk signed and delivered to Thomas E. Drohan, and William R. Bremer,
Certificates of Election and thereafter administered to them the oath of office.
The new City Council was thereupon seated.
ELECTION OF OFFICERS
The City Clerk occupied the Chair for the purpose of receiving nominations for and
conducting the election of the Mayor. The name of John S. Hoffmire, Jr. was placed
in nomination by Gordon W. Strawbridge. It was moved by Strawbridge, seconded by
Bremer, that the nominations be closed, and John S. Hoffmire, Jr. be declared elected
Mayor of the City of Tiburon. The motion carried unanimously, and Mayor Hoffmire
took the Chair.
The Chair invited nominations for the office of Vice Mayor of the City of Tiburon.
The name of Thomas E. Drohan was placed in nomination by Councilman William R. Bremer.
It was moved by Strawbridge, seconded by Bremer, that the nominations be closed and
Councilman Drohan be declared elected as Vice Mayor. The motion carried unanimously.
HONORS TO GORDON W. STRAWBRIDGE
The Honorable Peter Allan Smith, Judge of the Municipal Court, appeared before the
City Council and addressed compl~ents to former Mayor Gordon W. Strawbridge,
presenting him with a plaque commemorating his Mayorality. Councilman Strawbridge
responded with remarks of appreciation.

The Chair reviewed agenda bi I I dated Apri I 22, 1966, containing the recommendations
of the City Manager that the City enter into an agreement with Fred G. Zel insky
whereby Mr. Zelinsky would deposit with the City the sum of $11,516.36 against
eventual issuance of drainage in-lieu certificates when legislation providing
for such certificates is adopted.
The Chair further noted that the effect of such an agreement, when executed, would
be to consent to the lapsing of the performance bond in the amount of $36,800
which Mr. Zelinsky had maintained since 1963 to assure construction of a drainage
system required as a condition of a use permit for the Safeway Store on Tiburon
Blvd.
The Deputy City attorney explained to the Counci I the detai Is of the proposed
agreement.
Mr. Fred Mantegani, appeared before the Counci I and spoke on the matter.
Motion of Strawbridge, seconded by Bremer, to adopt the City Manager's rocommendation
to authorize the mayor to execute the agreement on behalf of the City upon payment
of $5,000 and delivery of a note, as provided in the agreement, carried:

FLOODING PROBLEM - Tiburon Fire Protection District 5

Mr. Jim Jenkins, Secretary of the Tiburon Fire Protection District 5, appeared
before the Counci I and spoke on the problems of flooding in the vicinity of the
Fire House.
The City Manager gave a verbal progress report on strom drainage studies for
the downtown area.
The City Engineer stated that the McCreary-Koretsky drainage study for downtown
Tiburon would be completed in 90 days, but gave it as his opinion that the
actual storm drainage construction would not be completed before the next
rainy season.
Mr. Fred Mantegani appeared before the Counci I and spoke on tho matter.
Mr. Lou Britt appeared before the Council and spoke on the matter.
Motion of Strawbridge, seconded by Fanning, that the City Manager be directed
to work with the City Engineer and consultants to provido temporary rei iof of
the Fire House flooding problem beforo next winter and report back to the

for an additional sign which they bel ioved was permitted by Ordinance No.5.
The City Manager responded that because of the zoning of the property and
cond;+ions of the permit for the motel, the Planning Commission had authority
to pass on al I signs and further, that the Planning Commission had not
denied the additional sign but simply had not acted upon it. It was the sense
of the Counci I that, under the circumstances reported by the City Manager,
the Counci I was without jurisdiction at this timo as to the additional sign.

The Chair reviewed agenda bi I I dated Apri I 21, 1966, containing the recommondations
of the Consulting Engineer that, there being no apparent benefit to the City by
retaining in publ ic ownership tho parcel of land situated between Parcels 34 and
35, Block 102, Assessor's Book 59, on Eastview Avenue, the appl icant's request be
approved and abandonment proceedings be initiated; and the City Manager9s
recommendation that the City Counci I indicate a wi I lingness to convey title to

QUESTIONS
ORGANIZATION, PROCEDURES AND POLICY DIRECTIVES
It was moved by Fanning, seconded by Bremer, that the City Manager be directed
to prepare a table of organization for the City Counci I providing for the
establ ishment of three standing committees so that the committees would have
responsibi lity for matters of land use, zoning1 publ ic welfare, administration
and finance. There being no objections, the Chair so ordered.
It was moved by Bremor, seconded by Strawbridge, that a resolution compl imenting
the Planning Commission be prepared; that the Counci I cease automatic review
of al I actions of the Planning Commission and hear only appeals from appl icants,
requests of the Planning Commission for roview, appeals desired by two or more
members of the City Counci I, or appoals from aggrieved citizens; and that
legislation be prepared for the establishment for a Board of Adjustments and
a Board of Design Review within the fromework of the Planning Commission. There
being no objections, the Chair so ordered.
It was moved by Strawbridge, seconded by Bremer, that the City Counci I recognize
as a general policy guide the majority recommendations of the Citizens Advisory
Committee for Planning as contained in the report of that committee fi led with
the City Counci I on July 12, 1965. There being no objections, the Chair so ordered.
It was moved by Drohan, seconded by Fanning, that the City Manager recommend
the scope of work of ad hoc committees to study financing of the acquisition of
the downtown water front and to study the problems and procedures for annexation
of areas within the sphere of interest of the city. There being no objections,
the Chair so ordered.
It was moved by Fanning, seconded by Drohan, that the City Manager be directed
to have ready a prel iminary budget for the fiscal year 1966-67 by the end of
May. There being no objections, the Chair so ordered.
It was moved by Fanning, seconded by Bremer, that the administration review
Resolution No. 92, providing for a Parks and Recreation Commission, and make
recommendations on amendments. There being no objections, the Chair so ordered.

The City Engineer reviewed the action of the appl ication beforo the Planning
Commission on 18 Apri I, 1966, in which the staff recommendations were over-ruled
and tho development proposal was approved. The engineer advised the City Ccunci I
that they would have to approve and confirm the tentative subdivision map
contrary to information previously given to the Planning Commission.
Mr. Bryan Chapman, architect with tho firm of Cal I ister and Payne, representing
the appl icant, appeared before the Counci I and spoke to the matter.
Motion of Strawbridge, that the matter be returned to the Planning Commission with
the recommendation that the subdivision be conformed with tho City Engineer's
recommendation died for lack of a second.
Motion of Bremer, that the action of the Planning Commission be approved and
confirmed died for lack of a second.
It was moved by Fanning, soconded by Bremor, to approve and confirm the action of
the Planning Commission on the tentative map with the condition that the exterior
wal Is of the structures as shown on the appl ication be seperate.
Mr. Chapman consented on behalf of the appl icant to postponment of two woeks, it

best participate in a program coordinated by the school district.

The Chair ordered that the regular order-of.business.be sus~ended so that the~City
Council might extend the courtesy of the city to Marin County Supervisor Peter Behr,
present to address the Council on the matter of the Park Bond issue appearing on
the ballot for the general election of 7 June 1966.
Supervisor Behr was recognized and conceded that protests of the City of Tiburon
respecting the population figures used in the proposed allocation of bond revenues
were proper, and assured the Council that additional appropriations due the
City of Tiburon would be made from the County's share of the revenues. The Mayor
made clear that the City Has now in receipt of an offer to sell to the City the
reversionary rights to the right-of-~'1ay of the Northwest Pacific Railroad paral-
leling Tiburon Blvd., the offer being that of Mr. Frank Newton and others.
After further discussion, it was moved by Fanning, seconded by B~emer to endorse
the bond issue. Before the motion was put, it was moved by Fanning, seconded by
Bremer to amend the main motion to make the endorsement suuject to a commitment
by the Board of Supervisors to adjust revenues accruing to the City of Tiburon
consistent with the official population figures of the City. The motion on the
amendment carried.

The matter of approval by the Planning Commissiqn of an application of
18 April, 1966, Phillippe Mutrux, a tentative subdivision map and certain
variances, having been referred to the Committee on Lands and Development,
the Chair called for a Committee report. Fanning reported for the Committee
their recommendations that the property should be rezoned RP-2 in order that
the City might be able to approve a binding development plan. The Committee
further recommended that the City initiate the rezoning of the property.
Hoffmire protested the recommendation of the Committee, proposing instead
that the Council should approve and confirm the action of the Planning
Commission, in order that the applicant not be unduly burdened by further
procedures, having complied \~ith all requirements of the City to this time.
After further depate, Hoffmire now acceeding in the proposals of the
Committee, Mr. Brian Chapman as representative of the applicant \~as asked if
the applicant \-lou1d consent to Hithdra,o]ing his applications for tentative
map approval and variances, in order that the matter might be taken up anew

The City Engineer reviewed the application for reduction in front setback
requirements for Assessor's Parcel 59-160-10 which had been approved by
the Planning Commission 2 May, 1966 and Hhich came on nou for approval
and confirmation. Motion of Fanning to approve and confirm the action of
the Planning Commission on the application Has seconded by Bremer and
carried unanimously.
HlNUTE ORDERS
BUS STOP - TIBURON BLVD. & REED RANCH ROAD
Bremer introduced for the Committee on Public Services a bill containing
findings that the State Division of Hight'lays Hould not participate in a
joint undertaking to reinstate a bus stop facility on Tiburon Blvd. opposite
Reed Ranch Road at an expected cost of $3,000 and recommending that the
matter be referred to the Committee on Finance and Administration for
possible inclusion in the budget for the fiscal year 1966-67.
The recommendation of the Committee was that the bill not be adopted because
the cost Has prohibitive in relation to the number of people who might use
the facility. Fanning expressed objections to the arbitrariness of the State
Division of Highuays and its un't-lillingness to provide for pedestrian safety.
Motion of Bremer, seconded by Fanning to table the question of the bus stop
and to instruct the City Manager to investigate an alternative of construct-
ing a footpath bordering the highway carried:

ACCEPTANCE OF BUS PASSENGER SHELTER

Tiburon Peninsula Chamber of Commerce
Bremer introduced the bill on behalf of the Committee on Public Services
finding that the City's insurance carrier had advised there was no objec-
tion to the City accepting the offer of the bus passenger shelter from the
Tiburon Peninsula Chamber of Commerce and recommending that the City
thereofore accept the facility. Motion of Bremer, seconded by Fanning to
accept the shelter and congratulate the Chamber of Commerce on their
initiative in providing this public facility carried unanimously.
The question of a proper formal dedication and acceptance Has referred to
the City Manager.

Authorization to Expend $2,300
Bremer submitted a bill on behalf of the Committee on Public Services
recommending the resurfacing of Beach Road from Tiburon Blvd. to the
Belvedere City Limits at a cost of $2,300 and moved its adoption. The
mot ion 'Has seconded by Fanning and carried unanimous ly.
EXTENSION OF INTERIM ZONING 7 -
Provisions of Ordinances 22 and 40
Fanning introduced a bill on behalf of the Committee on Lands and Develop-
ment recommending the extension of interim zoning Ordinances 22 and 40 for
one year and moved adoption. The motion Has seconded by Bremer and carried
unanimously.

Interim Zoning Administrator
Eoffmire introduced a bill on behalf of the Committee on Finance and Admini-
stration mal::ing adjustments in the current budget in the total amount of
$2,200 to provide added funds for the retainer of the City Engineer until
such time as the position of Development Administrator was filled and moved
adoption. The motion 'Has seconded by Bremer and carried unanimously.
ADMINISTRATIVE AIDE
Authorization to Employ
Hoffmire introduced a bill on behalf of the Committee on Finance and Admini-
stration providing that the City Manager might hire an Administrative
Assistant for the summer months ~Jith an allocatlon not to exceed $1,800
and moved adoption. The motion was seconded by Bremer and carried unanimously.
MOSQUITO ABATEMENT DISTRICT
Appointment of Elmo Di Martini
Hoffmire introduced a bill on behalf of the Committee on Finance and
Administration recommending confirmation of the appointment by the Mayor
of Mr. Elmo Di Martini as representative of the City of Ti~uron in the
Marin County Mosquito Abatement District for a term expiring December 31, 1967
and moved adoption. The motion uas seconded by Fanning and carried unanimously.
QUESTIONS
Notification of State Agencies - It ~~as proposed by the Mayor and ordered that the
the City Manager draft a letter to Governor' Brown asking that all State
agencies Hhich might be concerned be advised that Angel Island lies within
the limits of the City of Ti~uron.
Final l1ap, Tiburon Knolls Unit No.3 - Mr. Rampton Harvey was recognized and
addressed the Council on the question of early approval of the final map of
Tiburon Knolls Unit No.3, in order that through traffic might be accom-
modated by construction of the roadway in the subdivision.

FLOODING PROBLEMS - TIBURON FIRE PROTECTION DISTRICT 5 FIREHOUSE,

The City Council received a bill prepared by the City Engineer ar1s1ng
from a request on 25 April, 1966 from the Secretary of the Tiburon Fire
Proctection District for assistance in the elimination of flooding prob-
lems at the firehouse. The bill contained the findings of the City
Engineer that relocation of the firehouse, raising it on its foundations
or diking of the property were the only possible solutions. The bill
carried no recommendations.

Rrince_~~arlie In~ Bremer put the question of complaints about acts of dis-
turbing the peace allegedly occurring at Prince Charlie Inn on Tiburon
Blvd. The City Manager responded that on Saturday, 11 June, he had by
letter personally delivered to Hr. Eric Hodgeman, proprietor of the Prince
C~arlie Inn, advised him that there was information he was permitting t~~
preni~es to be o~2rated in a fashion in violation of local ordinances
with resp2ct to dancing and the use of sound amplifying equipment, and
that such violations should cease forthwith. The City Manager further
responded that Mr. Hodgeman had apparently ignored the communication an~
that he intended to caution him once again; that if he continued to ignore
the admonition the City Manaser wished authorization for the City Attorney
to proceed with appropriate action which migh~ entail litigation.
The City HanRger also suggested that the City Council ask the City Attorney
to exa:nine local noise ordinances and propose to t'lhat extent they might be
further amended. The City Attorney advised the City Council on the various
steps he might take to insure compliance 'vith local regulations.
Fanning put the question of a citizen's arrest made by John G. McChesney
on 12 June, 1966 and asked if the City was involved in this action. The
City Attorney responded negatively.
Motion of Bremer, seconded by Strawbridge, to authorize the City Manager
to proceed on the course of conduct he had proposed as circumstances might
warrant, including authorization to the City Attorney to seek injunctive
or other relief in the Courts, and further to report on local ordinances
as proposed, carried:

which Councilmen Bremer and Strawbridge had assisted. The Mayor received the flag
with the thanks of the City and ordered that it should thereafter be displayed in
the Council Chamber and for other appropriate occasions.

Fanning introduced on behalf of the Lands and Development Committee
an urgency ordinance entitled "EXTENSICN CF INTERIM ZCNING TO A-2 ZONE"
and moved its adoption. The motion was seconded by Bremer.
Fanning reported that the urgency arose from an application for a
building permit on Tideland property in Richardson Bay zoned A-2.

The City Engineer explained that the- City had jurisdiction and must
act on the application before the Bay Conservation and Development
Commission could consider the matter.

was introduced and its adoption recommended by the Public Service
Committee~ The ordinance was read in full.

Fanning introduced a bill dated 23 June 1966 on behalf of the Lands
and Dev2lopmcnt Comlllittee 't-Jhich recommended tabling of a proposal
approved by the City Council on 13 June 1966 to attempt to lease a
certain State Right of Hay on Tlburon Blvd- near Lyford Dr ive and
moved its ad-option, since the State was unable to negotiate a lease.
The motion was seconded by Strawbridge and carried unanimously.

Advice on Utility Construction - Fanning put the questions of why the City

companye The response of I~. Conrad was that the telephone company was
not transferring exIsting overhead lines to the new conduits, but was
merely increasing capacity"
The Chair instructed the City Attorney to investigate methods of compelling
utility companies to advise the City beforehand of construction projects.
Ee~sonnel Ordinance - Strawbridge put the question of enacting personnel'
regulations based on the model ordinance of the League of California Cities.
The response of the Chair was to instruct the City Attorney to proceed.

City Seal - Bremer put the question of adopting a City Seal based on the
heraldry of the new city flag. The response of the City Attorney was
that Ordinance No. 1 would have to be repealed. The Chair ordered
the drafting of 'such an ordinance and instructed the City r1anager to
investigate preparation of decals and other devices representing the
city seal to be used for municipal purposes.
Motorcycle Trespassin9 - Fanning put the question of motorcycle riders tres-
passing on private properties, and the processes by which such trespass
might be controlled. Bremer responded that the City might not have
jurisdiction. The Chair ordered the matter referred to the City Attorney
for a report to. the City Hanager.,
Internal Road Circulation System ~ Strawbridge put the question of endorsing
as a matter of policy the planning of an interior road circulation system
and moved thatt~.eCity Engineer and City 11anager propose policy considera-
tions for further examination by the City Council. The motion was
seconded by Bremer and carried unanimously.
