TOWN OF TIBURON LEASE OF PARKING SPACES TO~~~1Jg~~7J~~g~rcE
AT 1525 TIBURON BOULEVARD
This lease is entered into this first day of March, 2001, by and between the TOWN OF
TIBURON, a municipal corporation (hereafter "Lessee") and BARBARA Z. ABRAMS,
EDWARD G. ZELINSKY and LALEH S. ZELINSKY (hereafter collectively "Lessor").
RECITALS:
A. Lessor is the owner of certain real property situated in the Town of
Tiburon and located at 1525 Tiburon Boulevard in Tiburon, CA ("Parking Lot"). The
Parking Lot is adjacent to Lessee's Town Hall, which is located at 1505 Tiburon
Boulevard.
B. Lessee has found that its on-site parking facilities at Town Hall are
inadequate to serve normal demand and therefore wishes to lease spaces for
employee parking at the Parking Lot. Lessor has agreed to provide such parking under
the terms and conditions therein.
NOW, THEREFORE, THE PARTIES HEREBY AGREE AS FOLLOWS:
1. Lease of Spaces. Lessor will lease to Lessee a total of twenty-five (25)
standard size parking spaces in the Parking Lot, Monday through Friday
only, subject to the terms and conditions set forth herein.
A. Lessee shall not leave any automobile in parking lot overnight
without express written permission to do so.
B. This license is personal to Lessee and is not transferable to any
other person or entity.
C. Lessee shall adhere to all rules and regulations of the parking lot.
Lessor has the right to refuse parking privileges to any individual
who does not adhere to rules and regulations of parking lot.
2. Term of Lease. The Initial Term of this lease shall be one (1) year
commencing with the effective date of this agreement. After the expiration
of the Initial Term, the lease shall be on a month to month basis unless
otherwise extended or terminated by the parties.
3. Termination. During the Initial Term, the Lessee may terminate this lease
for any reason after giving thirty (30) days prior written notice to Lessor.
Thereafter, either party may terminate the lease after giving thirty (30)
days prior written notice to the other party.
4. Rent. Lessee agrees to pay rent to Lessor in the amount of three
hundred fifty dollars ($350.00) per month, which shall be due by the
fifteenth of each month.
5. Use of Premises. Lessee shall use the leased spaces only for parking
purposes, Monday through Friday, of employees' private vehicles-no city
vehicles permitted. Lessee will provide name of parking pass holder and
make, color and license number of vehicles used. Lessor will provide
monthly permit which must be visible on dash, driver's side or driver must
pay daily fee. Permit holder may park one automobile in lot at his own risk
of fire, theft or damage to auto or contents of the same.
6. Entire Agreement. This r~se constitutes the entire agreement between
the parties and may be modified only by a writing signed by both parties.
7. Binding on Successors. This lease shall be binding on the heirs,
legatees, devisees, administrators, executors, successors and assigns of
both parties.
8. Governing Law. The laws of the State of California shall govern this
Agreement. In the event of litigation between the parties relating to this
Agreement, the proper venue therefor is the Marin County Superior Court.
9. Notices. Any notices required to be sent to Lessee shall be sent to the
Town Manager at 1505 Tiburon Boulevard, Tiburon, CA 904920. All
notices required to be sent to Lessor shall be sent to Edward G. Zelinsky
at Main Street Properties, 130 Main Street or P. O. Box 1043, Tiburon, CA
94920.
