On behalf of each sworn employee, the Town will pay the 90/0 employee
contribution. This shall only be applicable for the current 20/0 @ age 50
benefits and pending 30/0 @ age 55 benefits. Should the Association elect to
add the Single Highest Year benefits option as outlined in the MOU, then the
language found in the MOU shall prevail.

As with so many memoranda of understanding, sometimes the language within
these agreements can be as critical as the salary and benefits that the language
provides. As Sergeant Hutton rightfully points out in his September 30, 2001
memorandum to you, some issues require clarification. However, since none of
the items appears substantive in nature, you and I agreed that a side letter would
suffice in lieu of an amendment to the agreement.
Section 6 - Cafeteria Benefits Plan
Thank you for meeting with me to share your concerns with some of the
approved language found in the current Tiburon Police Association memorandum
of understanding (MOU) between the Town of Tiburon and the Tiburon Police
Association.

clarifications help your membership in better understanding the MOU
There were two additional sections that Sergeant Hutton's memo addressed, but
in reviewing these items with him, he has agreed that the language as it exists in
the current MOU is sufficient

Effective January 1, 2002, each full-time classification represented by the
Tiburon Police Association shall become eligible for vacation cash-out after
the usage or scheduled usage before the end of the calendar year of
eighty (80) hours of vacation leave in a calendar year

The Town has always had the practice of cashing out sick leave in an amount
not to exceed 500/0 of up to 960 hours (or 480 hours). The Town will continue
to follow its past practice in determining the maximum number of hours an
employee may cash in upon retirement or separation from the Town
