Dear Property Owner:
The Federal Emergency Management Agency (FEMA) has adopted new flood
insurance rate maps (FIRMs) for all of Marin County, including the Town of Tiburon.
The new maps will become effective on May 4, 2009.
The primary purpose of this letter is to inform you that the parcel or parcels
identified at the top of this letter may now be mapped into a Special Flood Hazard
Area (SFHA) by FEMA. The SFHA is shown as stippled blue dots and is
designated as "AE" on the FIRM map (see enclosed excerpt from the FIRM map
for Downtown Tiburon).
The new maps depict the bulk of Downtown Tiburon as being in a SFHA. This is a
change frOln the prior maps, dating to 1977, which did not show the Downtown area in
a SFHA. Using technology not available in the 1970's FEMA, has determined that
during a 1 DO-year stonn event water froln Richardson Bay would overtop the San
Rafael Avenue seawall and flood the Belvedere Lagoon area and much of Downtown
Tiburon. FEMA also identified low points along Beach Road in Belvedere where water
from San Francisco Bay would likely cause flooding in the Downtown area during a
100-year storm event. Properties along the water side of lower Main Street would be
subject to flooding directly from San Francisco Bay during a 100-year storm event,
according to the new flood insurance rate Inaps.
You may already have flood insurance coverage for this property, but in the event that
you do not, federal law may require that you obtain flood insurance coverage. For
example, if you have a mortgage from a federally-regulated lender, and the building or
buildings on this parcel are within the SFHA, then by federal law, your lender must
require you to carry flood insurance when these flood maps becon1e effective. Flood
insurance is available through the National Flood Insurance Progrmn (NFIP), a federally
underwritten prograln provided by nearly 100 insurance companies and written through
licensed insurance agents. Contact your insurance agent to learn about lower-cost

while a portion of your property may be Inapped in the SFHA, the building or buildings
on the property may not be considered within the SFHA by your insurer because they

A FEMA representative has inforn1ed Ine of the approxin1ate current flood insurance
rates if you secure flood insurance prior to May 4,2009, as follows:
A) $350 for the first year~s coverage (covers building and contents).
B) $900 for the second year's coverage and subsequent years (subject to
allliual adjustInent for inflation, etc., in subsequent years). This rate
would cover the building only, not contents.
If you fail to secure flood insurance prior to May 4, 2009, the annual rate for flood
insurance would approxiInate $1,800, covering the building only.
If you do not have a mortgage that requires flood insurance, it is still recomlnended that
you purchase flood insurance. For mon~~ information on flood insurance, call your
insurance agent or visit the National Flood Insurance Program's website at
www.floodslnart.gov.
Please be advised that any tenants in the building Inay also desire to secure flood
insurance for contents that they Inay own. Please alert your tenants accordingly.
The Town ofTiburon and City of Belvedere are planning to host an informational
n1eeting after the New Year on the new flood insurance rate maps and related issues, at
which FEMA representatives will n1ake a presentation and be available to answer your
questions. When a meeting date has been arranged, the Town will send you a separate

The following is a status report on major development applications on the Tiburon Peninsula.
Applications currently being processed or in the stages of pre-submittal in the Town of Tiburon
are as follows:
· Aychuck (formerly Amerippon/Parente Vista): 10 acres off Antonette Road
· Tiburon Glen (a.k.a. Xanadu): 3 lots proposed on 26 acres off Paradise Drive
· Ling (a.k.a. Stony Hill Development): 5.6 acres off Stony Hill Road
· Kol Shofar Synagogue Expansion, 215 Blackfield Drive
· Caprice Restaurant, Expansion, 2000 Paradise Drive
· Alta Robles (a.k.a. S.O.D.A./Rabin): 50 acres above Paradise Drive near Seafirth Estates
· Tiburon Court (a.k.a. Upper Trestle Glen): 3 homes on 13 acres of Trestle Glen Blvd.
· Lower Trestle Glen: 14 acres off Trestle Glen Boulevard near Tiburon Blvd.
· Belvedere- Tiburon Library Expansion
· Harbor Light Building
· Paradise Drive Prezoning
In addition, several development applications are currently being processed or were recently
being processed by the County of Marin Community Development Agency for large properties
on the Tiburon Peninsula that are not within the Town of Tiburon's corporate limits. These
projects are as follows:
· Easton Point (a.k.a. Martha Company): 43 units proposed on 110 acres
· Sorokko: 5 lots proposed on 16 acres below Paradise Drive near Seafirth Estates
· Salvatore-Swahn: 1 home and a secondary dwelling unit proposed on 15 acres near Keil
Cove
· Pan Pacific Ocean (a.k.a. Habitat for Humanity): 7 units proposed on 17 acres above Bay
Vista Drive near North Knoll Road
This report summarizes the current status of the above-listed applications. A map of the project
locations is attached as Exhibit 1.

Status of Projects being (or to be) processed by the Town of Tiburon
Aychuck (formerly Amerippon/Parente Vista)----lO acres off Antonette Drive
In 2004, the Town Council certified an EIR for this property based upon a 5-lot project. The EIR
found significant unavoidable impacts would result from that project design. The applicants then
submitted a re-designed and scaled-back plan calling for four (4) homes. The property was
purchased by a new owner who has submitted revised drawings for two (2) homes on the site.
The project application was recently revised and refilled to address water pressure and fire-flow
issues raised by the Fire District. A draft addendum to the certified EIR is being completed for
the revised project. Staff anticipates that this project will come before the Planning Commission
for action early in 2009.

Tiburon Glen (a.k.a. Xanadu)----26 acres off Paradise Drive near Norman Way
The Town Council approved a Precise Development Plan for three (3) homes on this site in April
2006 and a Tentative Subdivision Map application was approved in March 2007. Off-site tree
mitigation plans were approved by the Town Council in 2008. The applicant is currently
preparing to submit the Parcel Map application and Subdivision Improvement Drawings,
including the off-site tree replacement/invasive plant species mitigation work.

Ling (a.k.a. Stony Hill Development)----5 lots on 5.6 acres at the end of Stony Hill Road
A Precise Development Plan application for three (3) lots was approved by the Town Council in
March 2008, and is valid for three years. Staff believes that a Tentative Subdivision Map
application is being prepared by the owner, but is not aware of any time frame for submittal.

Kol Shofar Synagogue Expansion
The Town granted Design Review approval for this expansion project in March 2008. A building
permit application was recently submitted and is currently in plan check. Staff anticipates that a
building permit will be issued early in 2009.

Caprice Restaurant Expansion. 2000 Paradise Drive (Conditional Use Permit)
The Planning Commission heard this application on December 10, 2008 and directed Staff to
prepare resolution denying the project as submitted. The Planning Commission had denied a
somewhat similar application in 2005. An appeal of the Commission's decision to the Town
Council is possible.

Alta Robles (a.k.a. S.O.D.A./Rabin): 50 acres above Paradise Drive near Seafirth Estates
In March 2007, applications for prezoning and Precise Development Plan were filed for 14 new
homes on the 50-acre property. The draft Environmental Impact Report is underway for this
project and is expected to be released in the first quarter of2009.
Town Project Planner: Contract Planner Diane Henderson & Scott Anderson
Tiburon Court (a.k.a. Upper Trestle Glen): 3 homes on 13 acres of Trestle Glen Blvd.
The Town approved a Parcel Map for this project in September 2008. Economic difficulties have
delayed the start of subdivision improvements and there is no known timetable for the
commencement of work on the site.

Lower Trestle Glen: 14 acres off Trestle Glen Blvd near Tiburon Blvd.
The owners of this property filed a Precise Development Plan for three (3) homes on this site in
December, 2008. The drawing shows one home of Trestle Glen Boulevard, deriving access from
a new driveway that would form a 4-way intersection at Juno Road and Trestle Glen Boulevard,
and two homes served by an extension of Silvera do Drive from the Little Reed Heights
subdivision. The Precise Development Plan application is being reviewed for completeness.
Belvedere- Tiburon Public Librarv Expansion
In December 2008, the Library Agency submitted applications for an approximately 18,000
square foot addition to the existing Belvedere- Tiburon Public Library. The application is being
reviewed for completeness. An EIR will be required for the project.

Harbor Light Building Replacement. 20/22 Main Street
All planning and zoning approvals are secured for this project, which entails the demolition of the
current building and its replacement by a slightly larger new commercial building. An
application for building permit was submitted on December 11,2008.

Paradise Drive Prezoning Applications
The Town has received applications filed by nine property owners in the Old Tiburon and
Paradise Drive unincorporated area for prezoning of their properties by the Town. The Planning
Commission designated for study a larger pre zoning area encompassing approximately 85

assessor parcels and 230 acres of territory. Environmental review is currently underway for this
application. The prezoning process would establish which Town of Tiburon zoning district (e.g.,
R-l, R-2, RPD) would apply to properties in the event that they were eventually annexed into the
Town of Tiburon by the Marin Local Agency Formation Commission (LAFCO).

Status of Projects being processed by the County of Marin

Peninsula
The owners of this property filed applications for a 43-unit project in December 2008, subject to
an amended Stipulated Judgment reached with the County of Marin in 2007. The applications
are currently being reviewed for completeness by the County of Marin. An EIR will be required
for this proj ect.
County Proj ect Planner: Christine Gimmler
Sorokko----5 lots proposed on 16 acres off Paradise Drive
The Board of Supervisors approved this 5-10t project in October 2008. Next steps would be for a
Parcel Map approval, subdivision improvements, and design review for the individual homes.
County Proj ect Planner: Tom Lai
Salvatore-Swahn (a.k.a. Martha shore)----2 units on 15 acres off Paradise Drive
A Design Review application was filed with Marin County earli~r this year for a very large single
family dwelling and a secondary dwelling unit on this property. The application has been
deemed "complete" and is currently in the environmental review process with an initial study
underway.
County Project Planner: Jeremy Tejerian
Pan Pacific Ocean (a.k.a. Habitat for Humanity)----7 homes on 17 acres above Bay Vista Drive
Master Plan, Tentative Map and Precise Development Plan applications were filed with the
County of Marin for this parcel some years ago, and have been revised numerous times. The plan
proposes three (3) large homes near the upper reaches of the property (adjacent to the Tiburon
Crest Subdivision at the end of Via Los Altos), and four small affordable units (sponsored by
Habitat for Humanity) near the intersection of North Knoll Road and Eagle Rock Road. The
project is currently under review by the Strawberry Design Review Board and has generated
considerable neighborhood controversy in the Bay Vista/Eagle Rock area.

invited to attend a forum for presentation and discussion of regional planning issues
hosted by the Marin County Local Agency Formation Commission (LAFCO). The meeting

The Commission's agenda will focus on two presentations:
Association of Bay Area Governments: ABAG staff will discuss provisional targets for the
reduction of greenhouse gas emissions required by AB 32jSB 375 and two alternative land
use forecasts under a proposed If sustainable communities strategy" which will achieve the
emission reduction targets. ABAG is seeking input on the two alternatives.
Marin Municipal Water District: MMWD staff will present water supply issues and
alternatives, including desalination, to address the District's projected water supply
shortfall. MMWD is seeking input on its water supply alternatives and its ability to
communicate the implications of those alternatives to the public.

Subject: Coating Maintenance Work at - Mt Tiburon Tank #1, Tiburon
Dear Resident:
This letter is an update for the tank coating project scheduled forolder of two steel water storage
tanks located in your neighborhood at the end ofMt. Tiburon Rd. The work is being done as part
of our ongoing tank coating maintenance program. Our previous letter described noise and
possible minor inconveniences. This letter addresses the type of work to be performed and the
precautions being taken, as a portiCJl of the work involves removal of potentially hazardous
materials.
The existing coating on the Mt. Tiburon Tank, and on many other older steel tanks, contains
three parts: a two layer exterior coating and a single layer interior coating. The existing exterior
coating system consists of a lead containing undercoat and an alkyd enamel top coat.Alkyd
enamel is a polyester resin. The existing interior coating is coal tar enamel. Coal tar is a
proprietary mix of hydrocarbons. Both the interior and exterior s}Stems have reached the end of
their useful life and require complete removal and replacement. The removal process will
produce fine particulate matter as a result of the abrasive blasting process.
Long term exposure to lead containing dust is a potential health hazard; and exposure to fine
particulate matter resulting from the removal of the alkyd enamel and coal tar can cause
respiratory irritation. To mitigate potential exposure, thecontract specification requires that
stringent coating removal and worler protection procedures be followed The contract
specification also requires the tank to be fully enclosed within a negative pressure tent structure
while coating removal is being performed to prevent particulate matterfrom escaping to the
surrounding area. The contractor will be required to follow all Federal, State and local
regulations pertaining to worker safety, environmental protection, and waste disposal for projects
involving the removal of lead containing paint.
The District requires the contractor to submit written plans describing his methods for complying
with Federal, State, and local regulations as defined in the technical sr;Ecifications. These plans
address:
1. Worker protection
2. Environmental protection- protection of ambient air, soil and water
3. Testing and handling of debris generated from hdustriallead removal projects
4. Worker safety - confined space, emergency procedures etc
The contractor is also required to provide qualified personnel to perform air and soil monitoring during
surface preparation operations; verify the contractor's compliance with the worker protection
requirements; and monitor waste testing and disposal throughout the project

The District reviews the written plans priorto the start of work and verifies compliance with
specification requirements. The District also provides on-site inspection to ensure the contractor
performs work according to the written plans and to ensure compliance with the specification
and regulatory requirements.
Our intention is to make this project as safe, clean, and quiet as possible. Based on our
experience with tanks in similar locations, we believe that thesafety precautions and
engineering controls will provide a safe work site and protedion of the surrounding environment.
We also believe the sound levels will not be unduly disturbing and we appreciate your
understanding during the period of our work. When the project begins, currently estimated to be
January 5, 2009, we will maintain a wrrent schedule of work on our website a

Dear Mayor Slavitz:
The Marin County Civil Grand Jury is exploring some homeless issues, and would
appreciate your answering the questions below, in writing.
We would like to have your response by Friday, Jan. 16.
1. Do you have homeless people living within your community and, if so, how many?
2. What municipal services are provided for them, and at what cost?
3. Do you perceive a need for more homeless services in your community and, if so,
which ones?
4. Do you expect the economic crisis to add currently at-risk residents to the homeless
rolls next year, and do you have plans to deal with that increase?
5. How does your municipality cope with known homeless encampments or homeless on
the streets within your borders?
6. Have you encountered any local objections to services for the homeless?
7. Many service providers believe homelessness is a countywide problem, and that it is
crucial for county and local governments to join in an effort to end it. Would your
municipality favor a county-coordinated endeavor similar to the Major Crimes Task Force?
