Good morning everyone, Governor Schwarzeneggerhas decided thathe could save taxpayer money by eliminating the State Department of Boating and Waterways (DBW) and moving their workload into Parks and Rec. Since DBW is a boater-funded program totally independent of the State's budget crisis, this action amounts to a pillaging of boater programs and delivers California boaters into the arms of an already overloaded Parks and Rec department. DBW needs to remain a stand-alone agency! Without DBW's support, the RBRA would not be able to carry out its mission to keep the waterways clear and pollution-free. The grant programs administered by DBW provide approximately 1/2 of the RBRA's annual budget and these programs are absolutely crucial to our success as an agency. Please read over the attached letter (from CA Association of Harbormasters and Port Captains) and send a letter of support for DBW. This is a critical issue for the boaters of California and the communities and businesses that benefit from our nautical heritage. DBW is completely self-funded by boater's dollars. DBW does not rely on the State General Fund for one penny to pay for the many construction projects, programs, staff or any of its operating expenses. Eliminating the Department WILL NOT help with the State's financial problems. . Boating is an economic powerhouse: Recreational boating contributes approximately $16.5 billion to the gross state product, which represents about 1.2 percent of the State's economy and generates about $1.6 billion in state and local taxes. There are more than 8,500 recreational boating-related businesses. Recreational boating also creates over 284,000 direct and indirect jobs. The noise from these chippers is deafening. Closing the windows and drawing the curtains does not keep it out. It seems to me that the trees could easily be hauled away and ground up at some industrial location, not in the heart of a residential area. What can be done about this? Right now there is no prohibition on noise emanating from residential property unless it is associated with work pursuant to a town-issued permit. Trees can be altered or removed without a permit unless they are oaks, heritage trees (60" circumference) or specially designated trees. When a permit has been issued, there is no noise limit per se but there are day and hour limitations when the work can occur. I'm guessing that tree service companies find it more economical to chip on site to make the debris more compact and more easily handled or, in some cases, left on the property as mulch. I think one reason tree trimming a1'\d removal does not generally require a permit, or the noise otherwise regulated, is the relatively transitory nature of the work. Unlike a construction project that can endure for months and even years, tree trimming or removal usually happens over hours or a few days, after which the activity moves elsewhere. I do not know if the Town Council is interested in creating new rules to limit what is usually a temporary annoyance. The subject of noise regulation is, however, tentatively slated for the next Town Council retreat, which will be held later in the winter or early spring. CALL TO ORDER The meeting was called to order at 6:05 P.M., Tuesday, November 18, 2008, in the Town Hall Conference Room, 1505 Tiburon Boulevard, 1 st Floor, Tiburon, California. ROLL CALL Present: Feldman, McMullen, Leighton, Winkler, and Sperber Absent: nla Ex-Officio: Director of Public Works Nguyen ORAL COMMUNICATIONS None COMMISSION AND STAFF BRIEFING · Director Nguyen' updated the commission on the progress of the Cypress Hollow Park improvement. He indicated that he has been meeting with members of the neighborhood and would develop a plan that would be in agreement by all. · Director Nguyen briefly updated the commission on the status of the Open Space Management Plan. He indicated that the contract with consultant is being worked on and that once substantial work has been prepared the POST subcommittee will be engaged. COMMISSION AND STAFF BRIEFING · Commissioner Leighton introduced a memorandum of issues the Bicycle Subcommittee wanted to address collectively. He had 4 key items: The County bike route signs need to be enhanced, the Upper multi-use path above Richardson Bay Sanitary plant should be reviewed for multi-modal use, bike Sharrow stenciling should be reviewed for use, and a Bay Trail Grant should be reviewed for possible development of path along Tiburon Blvd. · Commissioner Leighton raised a couple of issues he had with the MUP path including restriping at San Rafael A venue and the one mentioned above. A motion (5-0) was passed to direct staff to look into and review Commissioner Leighton's issues. · A motion of 5-0 was passed to assign Commissioner Leighton to attend and represent POST at the California Bicycle Advisory Committee in Sacramento. Chair's Report No comment. 2. BTLF Report The Teddy Bear Tea was a successful event despite rainy weather. The Nominating Committee will have the names of potential new directors for the upcoming year which will be voted at the March meeting. In order to facilitate fundraising for the expansion, a Leadership Committee is being formed. At this time there are four prominent individuals who have agreed to serve on the Committee. A replacement has been chosen to fill Anne-Marie Bonfilio's position as Development Director. Hopefully the position will be filled in the next month. 3. Library Director's report - Deborah Mazzolini The custodial service the library has used for the past 11 years has been terminated. The individual who has been performing this service has been negligent for some weeks. Director Mazzolini spoke with the Town of Tiburon and their custodians have been hired on an interim basis until the library decides to hire them permanently or recruits another firm. The book drops, which were damaged by an errant driver in the parking lot in September, were replaced in October. However there have been several issues pertaining to defective quality in the manufacturing. One patron experienced a minor cut from a sharp edge on the door flap. Some employees have complained that the retractable bottom in the cart can stick and the springs cause the bottom to fly up unexpectedly. The Director requested a nod from the Board to close on Friday, December 26th so that fulltime employees may have a full 4 days off in a row. The Trustees were happy to grant this request. 4. Financial statement for November 2008 Five months into the fiscal year, expenses are right on target at 410/0. The Board Clerk announced that the City of Belvedere has reported on the amount of tax revenue the library will receive next week will be 60/0 greater than the amount received this time last year. The BTLA budgeted an increase of 50/0 so this was welcome news. 5. Committee Reports The Program Committee continues to fill the Tuesday and Thursday evenings with a variety of events. CONSENT CALENDAR: 6. Approval of minutes of November 17, 2008 7. Approval of warrants and in house check register November 2008 A motion to approve the minutes of November 17, 2008 and the November warrants and in house check register made by Trustee Beverlee Johnson and seconded by Trustee Kuhns passed. TRUSTEE CONSIDERATIONS: 8. Building Program Expansion Update Belvedere Tiburon Library Agency December 15, 2008 Minutes Page 2 Director Mazzolini submitted the Land Development Application for the building expansion with the Town of Tiburon and will copy Attorney Gary Ragghianti. She will set up a meeting with Glenn Isaacson and others regarding the EIR process. The EIR has not yet been started. The process, once begun, will open up a public discussion and input process. 9. Marketing, public relations and fundraising In an attempt to educate the community about the expansion, a description of the current departments and what each has to offer and what we would like the department to have with an expansion will be expanded on. The marketing firm is looking for persons that would consider being interviewed and photographed for the printed marketing materials. The Capital Campaign Consultant will be paid for by the BTL Foundation but contracted with the BTLA. A motion to move forward with hiring a Capital Campaign Consultant, made by Trustee Beverlee Johnson and seconded by Trustee Kuhns, passed. 10. CALPERS Contract Amendment During discussions on the sick leave bank it was recognized that other municipalities and agencies have a benefit in their CALPERS contract titled Credit for Unused Sick Leave. Unused accumulated sick leave at time of retirement may be converted to additional service credit at the rate of 0.004 year of service credit for each day of unused sick leave (i.e. 250 days of sick leave equals one additional year of service credit). A motion to ask CALPERS to make an estimate, not to exceed $200.00, of the cost to incorporate a contract change titled Credit for Unused Sick Leave, made by Trustee Beverlee Johnson and seconded by Trustee Kuhns passed. 11. Personnel policy According to Gary Ragghi'anti's office there have been many legal changes to the laws governing personnel policies and the library's is very out-of-date. Director Mazzolini is working with the legal staff to amend the policy. A draft should be available for Board review in January. 12. Audit of Financial Statements for FYE 6/30/08 Treasurer Tom Perot reviewed the draft audit and made suggested changes which were considered by the auditors and corrected for the final version. Perot recommended acceptance of this version. A motion to accept the audit of financial statements by Odenburg, Ullako, Muranishi, for fiscal year end 6/30/08, made by Trustee Kuhns and seconded by Trustee Johnson passed. COMMUNICATIONS 12.
