Dear Sir: We are deeply concerned about the continued illegal dumping of fill and debris on the railroad marsh adjacent to the drainage creek near the pipe that crosses Mar West. This is sensitive wildlife habitat that is supposed to be protected in perpetuity. Only recently a large pile of what appears to be construction debris has been dumped in this area. There are also two large piles of dirt dumped within the past few weeks. Also, somebody is cutting a trail from Mar West road into the heart of the habitat. The city of Tiburon should continue to protect and properly manage the rare fresh water marsh and Zelinsky park. Work was performed last Tuesday at the club marsh area. In September 2008 the Town of Tiburon and the County of Marin requested that we create pathways to the marsh to enable County Vector Control to spray for mosquitoes. Subsequently the work was done by the County. The County also rented a wood chipper and disbursed of the chippings on our property. I am unaware of any dirt that was dumped into the marsh. I am copying the Town ofTiburon on this letter. Please let me know if you have additional questions. This report is to provide the context for the legislative/policy review by the American Lung Association (ALA) known as the "State of Tobacco Control Report Card" that was issued, statewide for 297 California cities and 30 of the 58 counties in California. The local grades cover three key policy areas including: smoke-free outdoor air, smoke-free housing, and reducing sales of tobacco products. An overall tobacco control grade was awarded to each of these municipalities. The Town of Tiburon received an overall score of F, according to the American Lung Association report. Marin used to be a leader in tobacco control during the 1990s- our tobacco control ordinances were emulated by other counties, states and even some countries. On the positive side, three Marin jurisdictions received higher scores (in the ALA annual report released in early January), since they joined over 100 California communities that updated their local tobacco control legislation as a response to the California Air Resources Board which identified secondhand smoke in the same category as the most toxic automotive and industrial air pollutants by categorizing it as a toxic air contaminant for which no safe level of exposure exists. This much respected scientific report, showed that even in quasi-outdoor settings, secondhand smoke presents serious health risks to all populations. The County's Tobacco Related Disease Control Program has collaborated with the Town of Tiburon for the past 18 years on the implementation and enforcement of tobacco control laws. This partnership included: (1) helping with business education kits including building entrance decals to inform businesses of compliance duties, (2) responding to complaints about businesses in Tiburon (3) resolving complaints so that your staff would not have to investigate the complaint or issue a citation, (4) enforcement operations provided by the Marin County Sheriff, under contract with our office, to help lower tobacco youth access rates in your community. We also provide treatment to smokers in your community.
