The Public Works Department commissioned a warrant study of the proposed stop sign. A warrant study is a standardized analysis used to evaluate proposed traffic management measures. The study was conducted by a traffic engineering firm and considered several criteria contained in state and federal traffic safety and engineering guidelines including collision history, vehicle and pedestrian volume and vehicle speed. The study concluded that a stop sign was not warranted. In most cases, the outcome of the study would have decided the issue. But because there was significant public interest evidenced by the petition we sought further neighborhood input before finalizing our decision. In January of 2009 we sent out a letter to over five hundred residents that would be directly affected by a stop sign at that location. We received about thirty five responses. The respondents were against placement of a stop sign at the intersection by about five to one. There was however, significant support voiced for placement of crosswalks and "Pedestrian Crossing" signs. After considering all factors we have concluded that placement of a stop sign on Blaclcfield Drive is not warranted at this time. However, we do believe that placement of a pedestrian crosswalk on Blackfield Drive from the northwest corner of the intersection to the northeast corner and on Cecilia Way from the southwest corner to the Northwest corner is appropriate. Pedestrian crossing signs will be placed at appropriate locations on Blaclcfield Drive and a yellow "paddle" style sign will be placed in the crosswalk on Blackfield Drive on the center line. The proposed project includes prezoning of approximately 230 acres of land, comprised on 85 assessor parcels located at the southeast end of the Tiburon Peninsula in unincorporated Marin County (see map). In addition, the Tiburon General Plan would be amended to change the land use designations of 22 parcels (totaling approximately 3.4 acres) within the prezoning area to better correspond to existing Marin Countywide Plan and Marin County Zoning Map designations in order to avoid the creation of non-conforming uses. The project proposes other miscellaneous Tiburon General Plan amendments including correction of text and mapping errors. The role of the Planning Commission is to make a recommendation to the Town Council on these applications. The prezoning applications were filed by property owners Chapman, Hynes, Drever, Hart, King, Seaman, Browne, and Keil and expanded by the Town of Tiburon to include the general plan amendments and prezoning of additional parcels. The Planning Commission will also consider a Mitigated Negative Declaration for the project. The Tiburon Planning Division is recommending that a Mitigated Negative Declaration be adopted by the Town for the project pursuant to Section 21080 of the Califomia Environmental Quality Act (CEQA). The adoption of a Mitigated Negative Declaration would indicate that the project-would have a less than significant impact on the environment with mitigation measures incorporated into the project. The Draft Mitigated Negative Declaration & Initial Study, as well as other project materials, is available for review at the Planning Division, Tiburon Town Hall, 1505 Tiburon Boulevard, Tiburon, CA, 94920, and at the Belvedere-Tiburon Public Library located at 1501 Tiburon Boulevard in Tiburon. The document, which contains a detailed project description and listing of all parcels by address and assessor parcel number that are proposed for prezoning and/or general plan amendment, is also available for viewing on the Town's web site at www.ci.tiburon.ca.us. The project revisions involve the creation of a new road connector across the site, linking the "MMWD water tank" lots (Lots 25-34) accessed from Paradise Drive with the bulk of the proposed project lots accessed through Hill Haven neighborhood (see attached drawing). The revisions describe the road as a "temporary construction road" that would enable project construction traffic to enter and exit the property without passing through Hill Haven neighborhood streets, or any Old Tiburon streets other than Paradise Drive. Once the project is complete, the road would be closed to normal traffic and would be used only for emergency access purposes. Nevertheless, the roadway and its construction impacts would remain, so the term "temporary" is somewhat misleading. These project revisions are apparently intended to address construction traffic impacts in the Hill Haven and Old Tiburon neighborhood streets such as Solano Avenue, Centro West Street, Diviso Street, Ridge Road, and Mountain View Drive. The segment of Paradise Drive between Solano Street and the "MMWD water tank" lots apparently would absorb most if not all of the diverted construction traffic. The proposed new roadway would be located on a portion of the site not previously proposed for disturbance or studied for such disturbance. It would roughly follow and would cross (three times) a significant ridgeline identified in the Tiburon General Plan. Mayor & Members of the Town Council FROM: Scott Anderson, Director of Community Development SUBJECT: Permit-Tracking System Update DATE: April 24, 2009 During the prior fiscal year, the Town Council authorized funding for a state-of-the-art computerized permit tracking system. The Town selected the PermitSoft program after a thorough review of software packages appropriate for the Town of Tiburon's size and characteristics. The Planning Division module of the PermitSoft program became operational last fall; the Public Works module followed in early 2009, and the Building Division module is set for test- launch next month. The PermitSoft program will be run in parallel with the Town's Excel-based spreadsheet for a test period of at least 30 days, during which any debugging or necessary fixes can be addressed. Staff anticipates that the Building Division module will "go live" in June. This would complete the authorized phases of the permit tracking project. More sophisticated permit-tracking system enhancements, such as remote public access and voice-activated system interaction, can then be considered for future acquisition and installation. The current system is designed to accommodate these more complex functions in the future. COMMISSION AND STAFF BRIEFING: Director of Community Development Anderson provided the following preview of likely future items and dates: • April 22, 2009 - Parente Vista Precise Development Plan, Annual Capital Improvement Budget review, and St. Hilary's annual CUP review; • May 13, 2009 - The Town Library Expansion Project EIR Scoping Session and a CUP Amendment for an existing nursery school; • May 12 - Public Workshop on the Housing Element Update. PUBLIC HEARING: 1. CONSIDER RECOMMENDATION TO THE TOWN COUNCIL TO ACCEPT THE ANNUAL GENERAL PLAN IMPLEMENTATION STATUS REPORT FOR CALENDAR YEAR 2008 Associate Planner Tyler provided the staff report, noted that staff has identified three programs for abandonment since the last review in March 2008, and stated that Housing Element programs will be reviewed at a later date. Chair O'Donnell opened the public hearing. There were no public speakers and immediately closed the public hearing. TIBURON PLANNING COMMISSION MINUTES - APRIL 8. 2009 MINUTES NO. 978 PAGE I Commissioner Fraser thanked staff for the detailed report and asked if there was any forecast on the completion of Land Use Element Implementation Program LU-f. Mr. Anderson said this is an active pursuit; the Town has retained an economic consultant to evaluate the impacts of possible property tax shifts and Town staff will review those findings this week before determining the next step. Chair O'Donnell asked if the program includes all of Paradise Drive or only the pre-annexation portions. Mr. Anderson confirmed that the Town's vision has always included the whole of Paradise Drive and that any agreement reached would have to provide for the gradual annexation of its entire length. Commissioner Frymier echoed Commissioner Fraser's comments and said she would arrange to obtain clarification on language with Mr. Anderson. Chair O'Donnell referred to Housing Element Program DT-e and questioned the zoning status on the housing overlay at Tiburon Boulevard and Beach Road. Mr. Anderson confirmed that the former Delano's Market site and some of its neighbors are in an affordable housing overlay district. There has been considerable interest from developers and architects who are working to pull a plan together, and that staff anticipates reviewing and possibly increasing the density potential on the former DeLano's Market site as part of the Housing Element update. Chair O'Donnell questioned whether the overlay district would extend all the way to Town Hall. Mr. 'Anderson responded that the affordable housing overlay extends to the private parking lot adjacent to Town Hall and includes the Chase Bank building site. Chair O'Donnell thanked staff for the detailed report. ACTION: It was M/S (Fraser/Frymier) to recommend acceptance of the Annual General Plan Implementation Status Report for CY 2008 to the Town Council. OPEN FORUM: No Comment STAFF, BOARD AND COMMITTEE REPORTS: 1. Chair's Report Vice Chair Epstein noted that Chair Steger Johnson would be late this evening and she would preside over the meeting until his arrival. 2. BTLF Report Director Mazzolini reported for Carol Kurland in her absence. There has been a very positive response from the Library Society members who attended the Academy Night party on February 22nd. Tickets for the Petrocelli Luncheon on June 9th are on sale and have been selling. The BTLF annual meeting was held March 2nd. There was discussion about the impact the economy may have on fundraising. The Governance Task Force continues to meet, reviewing the structure of the BTLF regarding engagement, term limits and other issues. 3. Library Director's report - Deborah Mazzolini Library use statistics indicate a continuous rise in activity. This is also noticeable while walking through the library. More volunteers are helping to keep on top of the shelving. The staff is considering the idea of eliminating "hold" fees. 'A meeting with counsel is scheduled to discuss the Personnel Policy. 4. Financial statement for January 2009 Tom Perot is anticipating that Interest Income may be 20% less than budgeted this fiscal year. Director Mazzolini also noted that the payroll tax expense was calculated incorrectly and will be greater than indicated on the budget report. The Workers Comp category is over budget because the audit for the 2008 fiscal year necessitated a payment in this fiscal year. (FYI the previous year's budget was substantially under.) The fourth page of the Statement of Revenues and Expenditures reflects the new layout as discussed at the February meeting with the expansion budget separated from the operating budget. Good news from the State of California: the budget was recently approved with no further cuts to libraries. 5. Committee Reports The Program Committee is so busy it is scheduling events into July. The members are focusing on new ideas to promoting the events. The Film Committee has selected a film for March called Bottle Shock which will be of local interest. The producers will attend the screening. The committee has also chosen a film for April. An art reception will take place tomorrow evening for the new display of paintings by Malcolm McVickar, St. CONSENT CALENDAR: 6. TRUSTEE CONSIDERATIONS 8. Building Program Expansion update The EIR contract has been settled and work is scheduled to begin. The process will take between nine months to a year. The civil engineer's assignment will take place under the purview of EHDD. The marketing brochure galleys have been drafted and were displayed to the Trustees. Trustees Lobdell and Beverlee Johnson will edit them for content. It was suggested that the library's web site include some interesting library facts and one-line blurbs for patrons that might browse the home page. April 13th is the 13th birthday of the library. Despite this numerological coincidence it may be better to wait two years and celebrate the 15th birthday. 9. Marketing, public relations and fundraising The first draft of the case statement is still being reviewed and edited by staff and others asked to comment. When complete this brochure will be used for fundraising. An abbreviated version will be printed to begin to engage the community. 11. Volunteer Waiver, Release and Indemnity Agreement The Board was not prepared to discuss the agreement yet and decided to table this topic until the April meeting. COMMUNICATIONS 12. Monthly calendar The library will be closed on Friday, March 20th to work on the inventory of the collection. 13. Schedule of 2009 meeting dates There were no recommended changes to the schedule. The JPA supports efforts that increases plastic and paper bag recycling and reduces the use of single use carryout bags. Each year, approximately 19 billion plastic carryout bags are consumed in California. At the same time less than 5 percent of those bags are recycled, with the remainder disposed in landfills or ending up littered on our beaches, waterways, parks and roads. As a result, local and state governments are left financially responsible for litter prevention, cleanup, and enforcement activities. Communities throughout California are grappling with this issue and are searching for ways to reduce the impact that littered bags have on their quality of life. Tiburon: Experience has shown that imposing a fee at the point of sale on single- Margaret Curran use bags can significantly reduce the consumption of these bags. AB 87 would help reduce environmental impacts at the source, while providing local governments with additional resources to further mitigate the impacts of this issue. Each year, San Anselmo: approximately 19 billion plastic carryout bags are consumed in Debbie Stutsman California.
