Town of Tiburon I'm happy to report the Wayne family has agreed to settle their lawsuit against the Town consistent with your direction. The Town and the Waynes signed the Settlement Agreement and Release of Claims earlier this week. The Agreement contemplates the creation of a permanent public trail from Hacienda Drive. The Wayne family will assist in creating this trail by granting the Town a public recreation trail on a portion of Hacienda Drive, from the end of the public road to approximately 139 Hacienda. The remainder of the private road will not be part of the public trail, but will ultimately be replaced by another route. More details will be forthcoming shortly in a press release. TIBURON POLICE DEPARTMENT 1155 Tiburon Boulevard Tiburon, CA 94920 MEMORANDUM Date: May 7, 2009 To: Mayor and Members of the Town Council From: Michael Cronin, Chief of Poli Subject: Blackfield & Cecilia Pedestrian Crossing In April, Town Staff made the decision to install crosswalks and "Pedestrian Crossing" signs at the intersection of Blackfield Drive and Cecilia Drive without a stop sign. In the last week of the month, we notified 560 neighborhood households of our decision via U.S. mail, and another 71 individuals via e-mail. The letter was included in the April 24 Digest. These 560 households were the same group from which we sought input before making the decision. The e-mail recipients were people who had either expressed interest at some point or were on the original petition sent to the PD. a* We have received a number of responses, which are attached for you information. I noticed that many people who signed the petition don't live close to my neighborhood at all. I'm opposed to adding another cross-walk on Blackfield Dr. but can live with it. However, I'm opposed to a paddle sign in the middle of Blackfield Dr. It is unwarranted due to the lack of traffic. It will be an eye-sore and will have an extremely negative, visible impact on the neighborhood that can not be mitigated. Furthermore, this paddle sign will have no effect on weekends, holidays, the summer months, etc. as well as all day when there is no traffic at all. As it is now, I can walk down the middle of the street with my dog most any time of day and not even see a car on the road. The only time there are cars of any significance is when school gets out in the afternoon. There is a line of cars for about 5-8 minutes at the most, at that time . Living in the neighborhood and being in my house during the day, I rarely see any kids crossing at that corner. So, I'm very surprised that this issue is even being discussed. There is already a stop sign on this corner too. So, I am opposed to a paddle sign on Blackfield Dr. I live here to enjoy the wooded, natural view of my street for over 20 years now, and don't want to look at an ugly plastic sign in the middle of the street. All of my neighbors agree with me as well. Two critical items should be considered by the town: • The traffic study was flawed in that it did not take into account the number of vehicles traveling East on Cecilia Way. This street is a major thorough fare for residents living on Karen Way, resulting in cars speeding East, turning the corner to speed up Leland towards Karen. In addition, the Bel Aire school requires drop off (morning) and afternoon (pickup) traffic to travel East on Cecilia, turning left onto Leland, and then to Karen. • The percentage of letters in opposition is minuscule compared to the 500 residents directly impacted. Specifically 7% objected. Since many of the residents did not receive the original letter, that 7% is a small percentage. In addition, we will be contacting the Safe Routes to school who regularly encourage school children to walk or bike to school. It will still be unsafe to cross Blackfield unless something is done to slow the traffic down that speeds north from Tiburon Blvd. and south from the surrounding communities. You are welcome to come and stand in my driveway and watch the resulting traffic and speed. The recent pedestrian sign that was installed was hit by a car (speeding) and dragged down Cecilia. Thankfully, it was not a pedestrian or biker. You mentioned that the study looked at traffic flowing in the direction of the proposed stop sign. That is not correct. The study did not measure traffic flow entering or leaving the intersection for the proposed new stop signs. The counters were installed and measured traffic traveling towards an existing stop sign and only in one direction. The stop sign stops traffic for an existing marked pedestrian crossing. Traffic traveling West on Cecilia Way towards the intersection was counted. Traffic traveling East (which the morning and afternoon car traffic to/from Bel Aire School is required to travel) was not measured. It is important to note that the Town of Tiburon is installing markings for a pedestrian crossing without implementing any means to slow that traffic down. Considering that traffic flows over 30 miles per hour in both directions, this will be a dangerous crosswalk to maneuver. Blackfield has developed into a major thoroughfare. The existing pedestrian crosswalk has inadequate signage. Although the existing traffic stop sign stops traffic from Cecilia Way, traffic turning from Blackfield onto Cecilia (Northbound turning to Eastbound) Way regularly swings around this corner, with horns honking to move any pedestrian already within the crosswalk. The few cars that do stop to allow pedestrian crossing are then honked at by traffic wanting to continue along Blackfield from Tiburon Blvd. towards Karen Way. Occassionally, these speeding honking vehicles swerve into the oncoming lane to continue their journey. Vehicles wanting to turn left from Cecilia Way onto Blackfield must enter the intersection to see on coming traffic in either direction. This traffic is traveling so fast that there are many near misses. If vehicles are parked on Blackfield on either side of Cecilia, the turning car must venture even further into the intersection. Just last year there was accident involving just such a scenario. The pedestrians are being put in danger by the Town allowing a pedestrian crosswalk without adequate protection from speeding traffic. I am sure there are guidelines for the installation of pedestrian crosswalks and whether signage is required to allow pedestrian crossing. It is interesting to note that the existing pedestrian stripping includes a stop sign to allow crossing. Why is the proposed crosswalk going to receive the same protection for pedestrians? The foot traffic across this intersection is so minimal that since notification of interest in putting a stop sign there several months ago, I have only once, and that was three days ago, seen any pedestrians crossing the street there. Placement of a stop sign at that location is not only not needed or justified but would be a great inconvenience to all of us who travel that street several times a day. Truthfully I was more than surprised to learn that anyone ever had an issue since there is no pedestrian traffic (with some exceptions) at that exceedingly open intersection. I note that you are intending to place a crosswalk and pedestrian crossing sign as a compromise. Even this is overkill given the lack of pedestrian crossings but it is certainly more acceptable than a stop sign. Thank you for being practical and pragmatic in reaching your decision to deny the request for the stop sign, which would have been an unnecessary obstruction to traffic flow in our neighborhood. Again, Bel Aire Estates is being inconvenienced so that we may babysit children of parents who do not live here, and who do not pick their children up after school. If I understand the source of your pending actions correctly, the parents who support all this unattractive signage want these eyesores here.....in Bel Aire so their children may wander away from school, while we must slow to a crawl, and parents of students are free to continue their personal activities in lieu of picking up their children after school at the properly designated time, via the route specifically outlined to them by Bel Aire School for the safe collection of their children. I ask you, is it really to anyone's benefit to have eight, nine, and ten-year-old children, who do not live here, wander blocks away from their school, unsupervised? By adding more signage, you are luring students away from school with a false sense of security for them, and their parents, by letting them think they are safe as long as they stay within the parameters of neon signs and crosswalks. Who will be the first one served, when a child is lost, or placed in harm's way, because parents thought by bringing this neighborhood to a halt it would allow their children free and safe reign of the streets? Will it be the school because they let the children leave school property, where they were safe, instead of turning them over to a parent? The school is liable for students until they reach the safety of parent/home. Will it be the City who lured absentee parents into thinking that many crosswalks, ped crossing signs, and paddle signs made it safe for their young children to amble away from school to anywhere they choose? Or will it be an unknown party who caused harm? My bet is the school and the City will be the first parties to be held accountable and liable. Again, as a teacher and a parent, I assure you these students are too young to be allowed to wander away from the safety of their school, whereabouts uncertain, just so their parents are relieved from picking them up - on time, from school. We do not want you to install permanent neon pedestrian crossing signs, or neon paddle signs, or even more crosswalks! Instead, tell these `concerned parents' to pick their children up after school and take them home. Insist the parents, not the City or this neighborhood, be responsible for their children. It states in the document that a merchant may reply anonymously, which I find most incorrect. I disagree with the person behind this letter whom ever it may be. The Town of Tiburon is not closing down Main Street to local traffic and leasing table space to foreign vendors setting up shop to directly compete short term with a merchant whom has taken the risk and invested substantially in creating a business here. Au contraire. This activity that this person is complaining about is way down the road and nowhere near Main Street. Furthermore, the company that owns this property is in the business of commercial leasing to the very same business's as Main Street represents. Additionally, it is privately owned land and has nothing to do with the Town of Tiburon 's control. Wherein lies the difference between a long term lease tenant at his shopping plaza- verses a short term table tenant at his shopping plaza? 'laza. There is no difference. The guy can do whatever he wants. Its his land and his commercial space. I think that in all fairness to this strip plaza landlord my sense is that the current vacant space at his plaza is as a result of his effort of intention to place the TOP GROCERY FOOD BUSINESS in Marin County in his building. Hence, he is holding the spaces over. By the same token the man has bills to pay operating his property. Woodland Market will be exceptionally well received here as the residents of Belvedere/Tiburon are very blessed to enjoy very fortunate lifestyles. Soon residents will be able to enjoy purchasing top of the line fresh fruit and vegetables, fish and meats at their immediate convenience. My understanding is that this marche takes place from 8:30 am until 10:3oam. This notion that this marche is competition to me is of no concern to me. He's far away from Main Street. At least there is no alcohol and he's not closing Main Street down. The "White Elephant Sale" should be limited to used items as originally purposed to the public (as a flea market) and not open to vendors that bring in similar items as our local shops. These vendor's sell "new" P roducts at_wholesale prices to our community. This directly competes with the tax paying merchants_p- Main Street who,_.are currently -challenged by is recession andhave overhead cost. and lease agreements. Belvedere Land Company brings in vendors that wholesale new merchandise (to include but not limited to): jewelry, rugs, paintings, tabletop products and glassware etc. who paMy_$So }per table and set up ortable stores in Tiburon. This is of great concern duringthese economic P times when the stores downtown , are currently _ challenged. We are asking Belvedere Land Company not to rent tables to vendors that directly compete with gpy stores on Main Street by selling "new" and similar products. The White Elephant Sale was intended to be a flea market for individuals selling and trading their household goods. We hope for the town councils support in our effort to keep our businesses profitable during this economy and request assistance from the Town of Tiburon with this situation. Mlller RE: Marin Green BERST (Green Building, Energy Retrofit and Solar Transformation) Collaborative Dear Mayor xxx: Last week prior to the MCCMC dinner several mayors had an opportunity to discuss San Rafael's proposal to spearhead a collaborative effort among Marin's cities, towns and the County to develop policy approaches and sample ordinances for 1) green building (affecting new construction and remodeling) and 2) energy efficiency retrofitting of existing buildings. This topic was also discussed and endorsed at last week's Marin City Managers' Association meeting. Our recently adopted Climate Change Action Plan identifies green building regulations and energy efficiency retrofits of existing buildings as two of the most significant areas in which local government can achieve meaningful reductions in greenhouse gas emissions towards meeting our A632 requirements. Several jurisdictions are presently working to complete their Climate Action Plans, and it is likely that these plans will also identify green building techniques and energy efficiency retrofits as two important programs for near term implementation. We believe that a joint investigation of policy and program options and adoption of guiding principles will be a more efficient and productive venture than each agency attempting to do so independently. Each agency may ultimately adopt regulations or programs that are tailored for their situation or choose to take no action, but we can each share initial information and consider alternatives. This type of cooperative process proved very successful in Santa Clara County. We would suggest that each city and the county appoint one member of the City Council, Planning Commission or Design Review Board and an alternate to sit on a Task Force for a likely duration of nine to twelve months, with meetings anticipated once monthly. The Task Force would be educated, consider regulatory or policy options, adopt a set of common principles or objectives and prepare sample ordinances for each agency to consider and modify as desired. San Rafael Community Development Director Bob Brown and Richard Schorske, the Executive Director of the Marin Climate and Energy Partners, would provide staff support. We would also propose to form a Technical Advisory Committee with representation by the Marin Builders Association, the Marin Association of Realtors, local architects, building officials and chambers of commerce to provide input to the Task Force. Green Building Ordinance: Consider existing green building requirements from Marin jurisdictions and elsewhere in the Bay Area, adopt a statement of principles for green building regulations that would be applicable to Marin jurisdictions, both for new construction and for remodeling of existing homes and non-residential structures, and endorse a sample ordinance that would be provided to each agency for consideration. The goal would be to achieve as much consistency and commonality among these green building regulations in Marin as possible. 2. Energy Retrofit Program: The more challenging issue will be consideration of a program to incentivize property owners to retrofit existing buildings to increase energy and water efficiency and possibly add renewable energy options, such as solar panels. The Task Force would examine other existing retrofit programs, which are few and far between at present, options for the type of financing package allowed under AB 811 (to eliminate up-front costs and make the annual financing costs equal the annual energy savings), means of marketing such a program and means of creating a workforce to audit building systems and perform efficiency upgrades. There will be many policy issues to address, including whether to make such a program voluntary or mandatory to achieve our greenhouse gas reduction targets. A summary of the Task Force and Technical Advisory Committee composition and the initial scope of work are attached. The intention of this collaborative approach is to spare each jurisdiction the necessary staff time to perform such analysis and policy development independently.
