HomeMy WebLinkAboutAgr 2000-07-23 (CCC/PHHA)MLY REVISED DRAFT )/00 ,11IL 2 8 2000 iVAfEASOFFICE MEMORANDUM OF U°"'°P°" between the THE COMMUNITY CONGREGATIONAL CHURCH and the THE PILGRIM HEIGHTS HOMEOWNERS ASSOCIATION PREAMBLE This Memorandum of Understanding ("Agreement") is entered into by and between the Pilgrim Heights Homeowners Association (PI-IHA) and the Community Congregational Church (CCC). 111E wv The ~1 and +.i't and C'C'r.i h a ' .,-e :net and conferred in good faith have shared information, opinions and proposals, and have endeavored to reach mutual agreement on matters relating to CCC's programs and activities and their impact on the neighbors. CCC has successfully taken action to resolve a number of problems and issues as detailed in its letter of February 25, 1999 to PHHA (see attachment). The parties have also met with representatives from the Town of Tiburon to discuss the issues and resolve the problems. Both the CCC and the PHHA intend to live in harmony within the neighborhood. To maintain a good relationship of open communication and trust is a prime concern. When problems arise between the neighborhood and the Church, it is understood by both parties that they will be dealt with in a prompt and reasonable manner through direct communication This Agreement shall be presented to the PHHA Board of Directors and to the CCC Governing Board as the joint recommendation of the respective subcommittees of each. TERM OF AGREEMENT This Agreement shall become effective when approved by the PHHA Board of Directors and the CCC Governing Board. It will remain in effect for a minimum of one year, beginning «7 ;1-h the date of final execution of this agreement. The one: year will be used as a trial period to evaluate the implementation of agreed upon conditions, /and will remain in effect thereafter until notification and recision in writing by one of the parties to the other. SCOPE OF AGREEMENT 1) CCC will continue to provide education to its membership and CCC facility users of neighboring property owners' concerns relating to: Parking, speeding, noise, size of events, supervision and monitoring of activities, through the Church newsletter, signage and announcements of Church activities, and in agreements with facility users. s:%/dcrane,M0UBetween PHHA & CCC -8.doc Page 1 REVISED DRAFT - 7i 1100 2) All weddings and rental events of 75 participants shall have a supervisor onsite during each event who will be available by the CCC's direct phone line, pager, or cellular phone, the numbers of which will be made available to the PIMA. 3) PHHA will notify the CCC co-pastors or event supervisor of PIMA problems, complaints or issues with that event. 4) PIH-IA will likewise notify the CCC Neighborhood Liaison of specific problems, complaints or potential issues. The CCC Committee will respond and notify the PF HA of its actions within one week. 5) CCC has adopted the following wedding and rental event policies: ♦ Weddings will be limited to 150 people, and other rentals of church facilities will be limited to 75 people; ♦ Weddings and rental events will end by 9:30 p.m. and clean-up/lock-up . by 10:00 p.m.; ♦ Shuttle service will be used for all weddings and rental events attended by over 100 people. 6) CCC will continue to inform and communicate with the neighbors by forwarding copies of its newsletter, and posting its activities calendar. 7) The issue of outdoor amplification shall be deferred until after expiration of the one-year trial period on July 1, 2001, and reconsidered only if requested by either of the parties to the Agreement. BREACH OF AGREEMENT Any repeated breaches of the terms and conditions of this Agreement should be initially discussed between the subject parties. If, after that discussion, there is still no satisfactory resolution of the issue(s), the matter will be submitted to the, Town Manager for review and recommendations, which may include mediation services.
