Re: Chandler's Gate - Close of Escrow Under Dispostion and Development
Agreement
Dear Mr. Kleinert:
I write to confirm that Ned's Way Garden Homes, LLC ("Ned's") and the Tiburon
Redevelopment Agency (the "Agency") have agreed that the close escrow for Ned's purchase
from the Agency of the approximately 1.5 acres of real property at 1155 Tiburon Way, pursuant
to that certain Disposition and Development Agreement dated June 17, 1998 by and between
Ned's and the Agency, shall take place on Monday, July 31, 2000. The parties agree on this
date pursuant to Section 5.6 of the Disposition and Development Agreement.
I also confirm that the Agency and Ned's agree that therclose of escrow on July 31, 2000
is contingent upon the City of Tiburon's approval of the Final Subdivision Map on or before
July 24, 2000. If the City has not approved the Final Subdivision Map on or before July 24,
2000, then the parties agree that the close of escrow shall be delayed until seven (7) days after
the date upon which the City approves the Final Map.
