A RESOLUTION OF THE TOWN COUNCIL OF THE
TOWN OF TIBURON ADOPTING A MITIGATED NEGATIVE DECLARATION
FOR THE PARADISE DRIVE PREZONING AND TIBURON GENERAL PLAN
AMENDMENT PROJECT (FILES GPA 2008-01 AND R 2008-01)9
ADOPTING MITIGATION MEASURES, AND
ADOPTING A MITIGATION MONITORING PROGRAM
WHEREAS, the Town of Tiburon has initiated amendments to the Land Use
Element and the Downtown Element of the Tiburon General Plan (File GPA 2008-01),
and is processing applications for prezoning of unincorporated territory in the Tiburon
Planning Area (File R 2008-01); and
WHEREAS, in April 2009, the Tiburon Community Development Department
released an Initial Study and Draft Mitigated Negative Declaration for the project; and
WHEREAS, the Town of Tiburon Community Development Department
determined that based upon the Initial Study, a Mitigated Negative Declaration was
required and appropriate for the project pursuant to the California Environmental Quality
Act (CEQA); and
WHEREAS, in April 2009, notice of the availability of the Initial Study and Draft
Mitigated Negative Declaration was posted, mailed, and advertised in The Ark newspaper
to announce a 30-day public review period for review and comment on the Initial Study
and Draft Mitigated Negative Declaration and the project; and
WHEREAS, following closure of the 30-day public comment period on May 20,
2009, the Planning Commission held a public hearing on May 27, 2009 to receive public
testimony on the project; and
WHEREAS, the Planning Commission reviewed and considered the information
contained in the Initial Study and the Draft Mitigated Negative Declaration, and adopted
Resolution No. 2009-04 recommending that the Town Council approve the general plan
amendments and prezoning; and
WHEREAS, the Town Council has reviewed and considered the information
contained in the Initial Study, the revisions to the Initial Study, and the Draft Mitigated
Negative Declaration and has received and considered the recommendation of the
Planning Commission; and
WHEREAS, the Town Council finds that re-circulation of the Initial Study,
pursuant to CEQA Guidelines Section 15073.5, is not required.

NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of
Tiburon does hereby make the following findings:
1. Notice of the public comment period and notice of the project public
hearing was given as required by law and said hearing was conducted
pursuant to Sections 15073 and 15074 of the State CEQA Guidelines and
pursuant to provisions of the Town's Local CEQA Guidelines.
2. All individuals and groups desiring to comment on the Mitigated Negative
Declaration were given the opportunity to address the Town Council.
3. The Mitigated Negative Declaration for the project consists of the Initial
Study document dated April 2009, the Draft Mitigated Negative
Declaration form dated April, 2009, and any supporting information which
may be referenced therein.
4. The Mitigated Negative Declaration was completed in compliance with
the intent and requirements of CEQA, the State CEQA Guidelines, and the
Town's Local CEQA Guidelines.
5. The Mitigated Negative Declaration reflects the Town Council's
independent judgment and analysis
6. The Custodian of Documents for the project is the Director of Community
Development for the Town of Tiburon, whose offices are located at
Tiburon Town Hall, 1505 Tiburon Boulevard, Tiburon, California, where
the record for the project may be viewed during normal Town of Tiburon
business hours.
7. The Town Council has made CEQA findings relating to the project as set forth in
Resolution No. 13-2009.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Town Council
hereby adopts the Mitigated Negative Declaration as complete and adequate for the
purposes of approving the project.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Town Council
does hereby adopt and impose as conditions of its project approvals the mitigation
measures set forth in Exhibit "A" attached hereto and incorporated herein. Any
development within the Prezoning Project Area must comply with those mitigation
measures.

NOW, THEREFORE, BE IT FURTHER RESOLVED that the Town Council
does hereby adopt a mitigation monitoring program for the project, set forth in Exhibit
"A" attached hereto and incorporated herein. Said project includes the general plan
amendments (File GPA 2008-01) and also includes the associated prezoning (File R
2008-01) adopted by ordinance of the Town Council.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Tiburon held on June 17, 2009, by the following vote:

PARADISE DRIVE PREZONING & GENERAL PLAN
AMENDMENTS PROJECT
MITIGATION MONITORING PROGRAM
The California Environmental Quality Act (CEQA) requires that a Lead Agency establish a program to
monitor and report on mitigation measures adopted as part of the environmental review process to avoid
or reduce the severity and magnitude of potentially significant environmental impacts associated with
project implementation. CEQA (Public Resources Code Section 21081.6 (a) (1)) requires that a mitigation
monitoring or reporting program be adopted at the time that the agency determines to carry out a project
for which an Initial Study has been prepared, to ensure that mitigation measures identified in the Initial
Study are fully implemented.
The Mitigation Monitoring Program (MMP) for the proposed Paradise Drive Area Prezoning and General
Plan Amendment project is presented in Table 1 and includes the full text of project-specific mitigation
measures identified in the Initial Study. The MMP describes implementation and monitoring procedures,
responsibilities, and timing for each mitigation measure identified in the Initial Study, including:
Mitigation Measure: Provides full text of the mitigation measure as provided in the Initial Study.
Implemented by: Designates responsibility for implementation of the mitigation measure.
When Implemented: Identifies the stage of the project during which the mitigation action will be taken.
Monitoring Action: Specifies procedures for documenting mitigation implementation.
The Town of Tiburon may modify the means by which a mitigation measure will be implemented, as
long as the alternative means ensure compliance during project implementation. The MMP below
identifies the project-specific mitigation measures from the Initial Study in addition to the General Plan
Mitigation Measures that would apply to this project. The General Plan Mitigation Measures applicable
to this project have been considered as part of the analysis of the Initial Study.
