To: Mayor and Members of the Town Council From: Community Development Department Subject: T' ron Greenhouse Gas Inventory Report and Presentation Reviewed By: SUMMARY In May 2009, Tiburon completed a Greenhouse Gas Inventory report using the baseline year 2005. In April 2011, the Tiburon Town Council approved a Climate Action Plan (CAP)that lays out a path to achieve greenhouse gas reductions in local government operations and throughout the community. The Town's CAP states that the greenhouse gas reduction target is 15% below 2005 levels by the year 2020, which is comparable to the state goal at the time the report was completed. In 2012, the Town completed a second inventory report with help from Marin Climate and Energy Partnership (MCEP), which measured the progress the Town had made on greenhouse gas reductions between 2005 and 2010. Since the 2010 report was completed, the state goal has changed to a new target of 40% reduction below 1990 emissions by 2030. An update to the report has been completed (see Exhibit 1), with new measurements and reviews the Town's progress on greenhouse gas reductions through 2014. Between 2005 and 2014, Tiburon has reduced 18% of greenhouse gas emissions; therefore, the Town has met the reduction goals for 2020. The next step is to continue to implement policies and programs that further reduce emissions to achieve the new state target goal by 2030. RECOMMENDATION Staff recommends that the Town Council hears the presentation by Christine O'Rourke, Sustainable Coordinator for MCEP. The Takeaway Tiburon's community greenhouse gas emissions dropped 18% between 2005 and 2014, meaning the Town has met local and statewide reduction goals for 2020. The largest reductions were due to decreases in electricity and natural gas use and emissions. Decreases in waste disposal and water use also played a part. Although Tiburon has achieved its target to reduce emissions 15% by 2020, new State legislation has set longer- term goals to reduce emissions 40% below baseline emissions by 2030. Introduction 2016 was an historic year for climate change. Not did our planet beat the 2015 record for warmest year in the modern temperature record, carbon dioxide levels have officially passed the symbolic 400 parts per million mark. On the good news front, California has set another milestone to reduce greenhouse gas emissions with the adoption of SB 32 in 2016. This landmark legislation builds on the reduction targetestablished for the year 2020 under AB _.._..__...._._.._..-_..-...._.._.__.__..........._...................._._..-_...-..._.__.....__._.._.__......_..._.... 32 and now requires the State to reduce Global Annual Temperatures greenhouse gas emissions to 40% below 1990 1.2 levels by 2030. But at least we're making E -0.6 progress, and both California and Tiburon are ~ 1880 1900 1920 1940 1960 1980 2000 2020 on track to meet their 2020 targets. source:NASA Beginning in 2016, Tiburon will publish annual community greenhouse gas (GHG) emissions estimates through the Marin Climate & Energy Partnership (MCEP). Annual inventories will help the Town to more closely monitor its progress in meeting its local goal to reduce community emissions 15% below baseline (2005) emissions by 2020. Annual inventories are intended to supplement the full emissions inventories that are conducted every five years and were last prepared for 2010 emissions. This report reviews emissions generated from the community from 2005 through 2014 (the most recent year data is available). The inventory shows that the Town has achieved this target, with emissions 18% below baseline emissions in 2014. Emissions dropped from about 51,530 metric tons CO2e (MTCO2e) in 2005 to 42,280 MTCO2e in 2014. The emissions trend and targets are shown below. The Town of Tiburon is a member of MCEP and works with representatives from the County of Marin and all of the other Marin cities and towns to address and streamline the implementation of a variety of greenhouse gas reduction measures. Funding for this inventory was provided by the Marin County Energy Watch Partnership which administers public goods charges collected by PG&E. The annual inventories will be available on the MCEP website at rriarinclimate.or and will be used to update the Marin Sustainability Fracker. Emissions Reductions by Sector This annual assessment tracks emissions in the seven sectors identified in the 2010 emissions inventory. • The Residential and Commercial sectors represent emissions generated from the use of electricity, natural gas and propane in Tiburon homes and commercial and governmental buildings and facilities. • The Transportation sector includes tailpipe emissions from vehicles travelling on roads within the town limits. • The Off-Road sector represents emissions from off-road vehicles and equipment used for construction and lawn and garden maintenance. • The Water and Wastewater sectors represent emissions from energy used to pump, convey and treat water and wastewater, as well as fugitive greenhouse gasses that are created during the wastewater treatment process. • The Waste sector includes fugitive methane emissions that are generated over time as organic material decomposes in the landfill. The greatest reductions have occurred in the Residential (-5,968 MTCO2e), Transportation (-1,334 MTCO2e), and Commercial (-1,058 MTCO2e) sectors, although there have been significant declines on a percentage basis in the Waste and Water sectors. The likely reasons for the largest emissions decreases are described in further detail in the remainder of this report. Whenever possible, each section discussion includes the change in emissions from previous years and the likely influence of state and local programs or policies and external factors on reducing emissions. Electricity use in homes and businesses in Tiburon declined 3% between 2013 and 2014 and dropped 12%since 2005, from about 45.5 million kWh in 2005 to 40.0 million kWh in 2014.The Residential sector,which uses 70%of all electricity in Tiburon, has reduced its electricity use by 13%since 2005. Electricity use declined 11%in the Commercial sector over the same period. Improved energy efficiency, conservation, and solar installation are responsible for the declines in electricity use. PACE programs provided just over$51,000 in funding to Tiburon property owners by the end of 2015. Electricity-related greenhouse gas emissions in the Residential and Electricity Emissions, 2005-2014 Commercial sectors decreased 7% 14,000 - between 2013 and 2014. The tax credit will drop to 26%in 2020 and 22%in 2021. EXHIBIT NO. I 4 carries about 73% of the electricity load in Tiburon. In 2014 and 2015, about 0.7% of the electricity purchased by Tiburon MCE customers was Deep Green. Natural gas is used in residential and commercial buildings to provide space heating and power equipment. Use of natural gas is highly variable depending on the weather conditions in a given year. This variability has led natural gas use consumption in Tiburon to fluctuate from year to year, from a high of 3.4 million therms in 2011 to a low of 2.6 million therms in 2014. Emissions from natural gas consumption fell 17% between 2013 and 2014, most likely due to a warmer year than usual. The chart below compares natural gas usage in Tiburon to regional heating degree days, a measure of how much energy is required to warm the interior of a building relative to the outside temperature. Warmer days result in fewer heating degree days. As shown below, natural gas consumption is highly correlated to heating degree days. Reduction in energy use may also be attributed to energy efficiency programs and rebates, local green building ordinances, and State building codes. California's goal is to require all new residential buildings to be zero net energy by 2020 and all new commercial buildings to be zero net energy by 2030. Vehicle miles travelled on local roads are estimated to have decreased 3% since 2005 based on countywide data. Emissions have decreased 6% due to more fuel-efficient and alternatively fueled cars. The California clean car fuel standards and regular turnover of the vehicle fleet have lowered emissions from 1.05 pounds per mile in 2005 to 1.01 pounds per mile in 2014. While it is difficult to pinpoint exactly how each land use and transportation policy affects emissions,the Town has undertaken many efforts to reduce emissions from transportation, including amending the municipal code to permit class 1 and class 2 electric bicycles on the old rail trail, and supporting the Yellow School Bus challenge with the Reed Union School District to help reduce school related congestion on Tiburon Boulevard. cj Waste disposal from the communitydeclined Waste Disposal, 2005-2014 32% between 2005 and 2011, but has since 12,000 --._._ increased as shown in the chart. Nonetheless, it is encouraging to see that disposal tonnage 10,000 has held on to most of the declines despite a 8,000 strong local economy. Source:CalRecycle EXHIBITNO. 6 IUV � Water conservation efforts not only save water but reduce demand for electricity to pump, treat and convey water from the water source to water users in Tiburon. Water use declined 15% between 2013 and 2014, and 11% since 2005. Emissions, which are based o.n an estimate of electricity used to pump, treat and convey water to users in Tiburon, dropped by 39% between 2005 and 2014 due to the lower carbon intensity of the electricity. The Marin Municipal Water District began purchasing MCE Light Green electricity in 2010 and plans to begin using MCE Deep Green electricity in July 2017. In January 2014, the Governor declared a drought state of emergency and asked all Californians to reduce water consumption 20%. Water use reductions became mandatory in 2015. Recent local actions to reduce water use include adoption of more stringent water-efficient landscape regulations in 2015. The Marin Municipal Water District (MMWD) provides rebates and programs to reduce water use. Rebates are available to replace fixtures with high-efficiency toilets and clothes washers, and to purchase pool covers, hot water recirculating systems, organic mulch, laundry-to-landscape system components, and rain barrels. MMWD also provides rebates for irrigation improvements for commercial and multi-family customers. MMWD provides free high-efficiency shower heads and faucet aerators, and free home, business, and landscape water use evaluations. Outreach and Coordination In addition to the programs and actions described above, the Town pursued a range of outreach activities and participated in several multi-agency efforts, including: • Utilized the Town's newsletter,social media, and press to promote sustainability efforts. • Supported and promoted lectures, workshops and activities. EIIIT NO. 7 • Participated in and supported the Marin Climate and Energy Partnership. • Partnered with Resilient Neighborhoods to enroll Tiburon households in a program to learn about sustainability and take actions to reduce household greenhouse gas emissions. Summary, Priorities and Next Steps Tiburon has made significant progress in reducing GHG emissions since 2005. However, the Town will need to continue to implement policies and programs that further reduce emissions to achieve the new 2030 statewide target for a 40% reduction below 1990 emissions. S.); File MCA2016-06 Reviewed by: BACKGROUND The Town Council held first reading of this ordinance following a public hearing at its meeting on January 18, 2017, and waived additional readings. The ordinance now comes to the Town Council for consideration of adoption. PROCEDURE This is a consent calendar item. The Council's motion to adopt this item on the consent calendar will constitute a motion to confirm the waiver of second reading from the previous meeting and adopt the ordinance. Each Councilmember's vote on the motion to approve this item on the consent calendar will constitute the equivalent of a roll call vote and will be recorded within the ordinance. Should any Councilmember choose to vote differently on this item than other items on the consent calendar, then the vote on this item should be taken separately from other items appearing on the Consent Calendar such that individual votes may be properly recorded. Should the Council wish to discuss the item, it must be removed from the Consent Calendar and voted upon separately. FINDINGS. 13 14 A. On December 13, 2016, the Planning Commission adopted Resolution No. 2016-XX 15 recommending to the Town Council that various text amendments be made to Title IV, 16 Chapter 16 (Zoning) of the Tiburon Municipal Code. 17 18 B. The Town Council held a duly noticed public hearing on January 18, 2017 and has heard 19 and considered all public testimony on the proposed Ordinance. 20 21 C. The Town Council finds that all notices and procedures required by law attendant to the 22 adoption of this Ordinance have been followed. 23 24 D. The Town Council finds that the amendment actions made by this Ordinance are 25 necessary for the protection of the public health, safety, and welfare. 26 27 E. The Town Council has found that the amendments made by this Ordinance are consistent 28 with the goals and polices of the Tiburon General Plan and other adopted ordinances and 29 regulations of the Town of Tiburon, and further the intent and purposes of General Plan 30 goals and policies. 31 32 F. Applications for 59 accessory dwelling unit permit shall be acted upon by the director ministerially 60 without discretionary review or a public hearing. Said action shall occur no more 61 than 120 days following submission of the application. Courtesy notice shall be 62 provided to owners of property within one hundred feet of the subject property, 63 as set forth on equalized county tax assessment rolls, at least ten days prior to a 64 decision by the director. 65 C. Grant of accessory dwelling unit permit. 66 1. In order to grant an accessory dwelling unit permit for an accessory dwelling 67 unit created through construction of or additions to a detached accessory building 68 or by construction of or additions to a single-family dwelling, the director shall 69 find that the accessory dwelling unit would comply with all of the standards set 70 forth in the current Standards for such accessory dwelling units as adopted by 71 council resolution. 72 2. In order to grant an accessory dwelling unit permit for an accessory dwelling 73 unit created exclusively through conversion of existing floorspace in a primary 74 unit or a detached accessory building, the director shall find that the accessory 75 dwelling unit would comply with all of the standards set forth in the current 76 Standards for such accessory dwelling units as adopted by council resolution. 77 D. Building permits. A building permit shall be required in conjunction with the 78 issuance of an accessory dwelling unit permit if repair, rehabilitation, or other 79 work otherwise requiring a building permit is necessary. 80 E. Approved conditional use permits still valid. Any secondary dwelling unit legally 81 established with an approved conditional use permit prior to July 1, 2003 and in 82 continued existence shall be deemed a legal, conforming dwelling unit. 83 Secondary dwelling units established by any such conditional use permit shall 84 continue to comply with all conditions of the permit approval, and with zoning 85 requirements for secondary dwelling units in effect at the time of permit 86 approval. 87 F. Approved secondary dwelling units still valid. Any secondary dwelling unit 88 legally established with an approved secondary dwelling unit permit between 89 July 1, 2003 and January 1, 2017 and in continued existence shall be deemed a 90 legal, conforming dwelling unit. Secondary dwelling units established by any 91 such permit shall continue to comply with all zoning requirements for secondary 92 dwelling units in effect at the time of permit approval. Any Town-assigned street address number for the 94 accessory dwelling unit shall be plainly visible and legible from the street 95 fronting the property as required by the applicable building code. 96 H. Accessory dwelling unit permits issued in compliance with this 97 section shall expire and become null and void three years after issuance unless a 98 certificate of occupancy has been issued by the building division. 99 I. Revocation. Upon written notice to the holder of an accessory dwelling unit 100 permit or a secondary dwelling unit permit, and a hearing before the director,the 101 director may revoke or modify any accessory dwelling unit permit or secondary 102 dwelling unit permit on any one or more of the following grounds: 103 1. That the approval was based on false information submitted by the applicant; 104 2. That the use for which such approval was granted has ceased to exist or has 105 been suspended for one year or more; or 106 3. That the permit granted is being or recently has been exercised contrary to the 107 terms or conditions of such approval, or in violation of any statute, ordinance, 108 law or regulation. 109 J. Periodic update. The director shall maintain a record of all legal accessory 110 dwelling units and all legal secondary dwelling units and shall review and update 111 the record every two years. 112 K. Reporting of violations. All reporting of accessory dwelling unit permit or 113 secondary dwelling unit permit violations shall be submitted in writing to the 114 director. The director shall notify the owner of record of the property that a 115 complaint has been registered, within ten calendar days from receipt of any such 116 complaint. The director shall investigate and issue a written report to the 117 complainant within thirty days from the date of the issuance of the notice 118 outlining the current status of any alleged violation and the steps that have been 119 requested of the owner of record to remedy the situation. 120 L. Violations considered an infraction. Violations of this section shall be punished 121 as infractions or by administrative citation, in the discretion of the director and 122 shall be subject to the provisions of section 16-56.030 (violations and penalties) 123 and/or chapter 31 (enforcement of code). This subsection also applies to 124 violations of conditions of approval or requirements of operation issued in 125 association with any accessory dwelling unit permit or secondary dwelling unit 126 permit. 127 M. Violations—Additional remedies—Injunctions. As an additional remedy, the 128 existence and/or maintenance of any accessory dwelling unit or secondary 129 dwelling unit in violation of any provisions herein, or of any conditions of 130 approval or requirements of operation placed thereon, shall be cause for 131 revocation and shall be deemed and is declared to be a public nuisance and may 132 be subject to summary abatement (i.e., including, without limitation, 133 administrative abatement in compliance with chapter 31 [enforcement of code]), 134 and/or restrained and enjoined by a court of competent jurisdiction. In the event 135 legal action is instituted to abate said violation, the town shall be entitled to 136 recover its costs and reasonable attorney's fees incurred in prosecuting said 137 action. 138 N. Appeals. The decision of the director granting or denying an accessory dwelling Tiburon Town Council Ordinance No. 568 N. S. Adoption Draft --1--12017 3 139 unit permit is a ministerial decision as required by state law, and not subject to a 140 public hearing. Pursuant to California Government Code Section 68552.2, no accessory 146 dwelling unit approved under these provisions shall be considered in calculating 147 the density of the lot allowed by the land use designation contained in the land 148 use element of the Tiburon General Plan, and accessory dwelling units are 149 deemed a residential use that is consistent with the existing general plan and 150 zoning for the lot. 151 152 (D) Section 16-52.105 is amended in its entirety to read as follows: 153 154 16-52.105 Junior accessory dwelling unit. 155 156 This section provides for the establishment and reasonable regulation of junior accessory 157 dwelling units in order to encourage housing opportunities for all segments of the 158 population while ensuring the public health, safety and welfare. 159 A. Zoning permit required. No junior accessory dwelling unit shall be established or 160 used unless a junior accessory dwelling unit permit has been issued by the town. 161 B. Application and fee. Application for a junior accessory dwelling unit permit shall 162 be made in compliance with the provisions of division 16-50 (application filing 163 and processing) and shall be accompanied by the appropriate filing fee. 164 C. Director of community development as review authority. Applications for junior 165 accessory dwelling unit permit shall be acted upon by the director without 166 discretionary review or a public hearing. Said action shall occur no more than 120 167 days following submission of the application. Courtesy notice shall be provided 168 to owners of property within one hundred feet of the subject property, as set forth 169 on equalized county tax assessment rolls, at least ten days prior to a decision by 170 the director. 171 D. Grant of junior accessory dwelling unit permit. In order to grant a junior 172 accessory dwelling unit permit, the director shall find that the proposed unit would 173 comply with this section and with the current Standards for Junior Accessory 174 Dwelling Units as adopted by council resolution. 175 E. Building permits. A building permit and a certificate of occupancy shall be 176 required in conjunction with the installation of a junior accessory dwelling unit. 177 Any repair, rehabilitation, or other work associated with the installation of the 178 junior accessory dwelling unit shall also obtain building permits where required 179 by law. 180 F. Premises identification. Any Town-assigned street address number for the junior 181 accessory dwelling unit shall be plainly visible and legible from the street fronting 182 the property as required by the applicable building code. 183 G. Expiration. Junior accessory dwelling unit permits issued in compliance with this Tiburon Town Council Ordinance No. 568 N. S. Adoption Draft --1--12017 4 184 section shall expire and become null and void three years after issuance unless a 185 certificate of occupancy has been issued by the building division. 186 H. Revocation. Upon written notice to the holder of a junior accessory dwelling unit 187 permit and a hearing before the director, the director may revoke or modify any 188 such permit, on any one of the following grounds: 189 1. That the approval was based on false information submitted by the applicant. 190 2. That the permit granted is being or recently has been exercised contrary to 193 the terms or conditions of such approval, or in violation of any statute, 194 ordinance, law or regulation. 195 4. For other good cause. 196 I. Periodic update. The director shall maintain a record of all authorized junior 197 accessory dwelling units and shall review and update the record every two years. 198 At the review, the owner of record shall verify in writing under penalty of perjury 199 that the junior accessory dwelling unit is in compliance with the standards for 200 junior accessory dwelling units and with all operating requirements of the permit 201 as set forth in applicable ordinances and regulations. 202 J. Reporting of violations. All reporting of junior accessory dwelling unit violations 203 shall be submitted in writing to the director. The director shall notify the owner of 204 record of the property that a complaint has been registered within ten calendar 205 days from receipt of any such complaint. The director shall investigate and issue a 206 written report to the complainant within thirty days from the date of the issuance 207 of the notice outlining the current status of any alleged violation and the steps that 208 have been requested of the owner of record to remedy the situation. 209 K. A Precise 243 Development Plan approval shall become effective on the 31" day following date of 244 application approval by the Town Council. 245 246 (F) Section 16-54.040 is amended to read as follows: 247 248 After the denial of an application for, or the revocation of, a Site Plan and Architectural 249 Review approval, Variance, Conditional Use Permit, Condominium Use Permit, 250 Accessory Dwelling Unit, Junior Accessory Dwelling Unit, or Tidelands Permit, no 251 application for the approval of the same or a substantially similar project on the same site 252 shall be considered by the Review Authority within one year after the date of its action on 253 the original application, unless it is established that there has been a substantial change in 254 the circumstances under consideration in the original proceedings, or that the denial was 255 made without prejudice. 256 (G) Section 16-100.020(A) is amended by adding the definition of"accessory dwelling unit" 257 to read as follows: 258 259 "Accessory dwelling unit". An attached or a detached residential dwelling unit 260 which provides independent living facilities for one or more persons. It shall 261 include permanent provisions for living, eating, sleeping, cooking, and sanitation 262 on the same parcel as the single-family dwelling is situated. An accessory 263 dwelling unit also includes an efficiency unit as defined in Section 17958.1 of the 264 Health and Safety Code, and a manufactured home as defined in Section 18007 of 265 the Health and Safety Code. (See also "Secondary dwelling unit"). 266 For the purposes of Section 16-52.100, the following defined terms are used in 267 association with an accessory dwelling unit: 268 1. "Attached accessory dwelling unit" means an accessory dwelling unit that 269 shares a common wall with the primary unit, either by being constructed as 270 a physical expansion (i.e., addition) of a primary unit, conversion of an 271 existing garage attached to a primary unit, or installation of a new 272 basement underneath an existing primary unit. 273 Tiburon Town Council Ordinance No. 568 N. "Detached accessory dwelling unit" means an accessory dwelling unit that 275 is constructed as a separate structure from the primary unit, or is created 276 through conversion (full or partial) of an existing lawfully-constructed 277 detached accessory building into an accessory dwelling unit. 278 279 3. "Floorspace"means the gross floor area as measured to the outside surface 280 of exterior walls, including its living area. 281 282 4. "Living area" means the interior habitable area of a dwelling unit including 283 the basement and attics but not including a garage or any accessory 284 building or structure. 285 286 5. "Primary unit" means the building (or portion of the building in cases of an 287 attached accessory dwelling unit) in which the principal residential use of 288 the lot takes place. An accessory dwelling unit cannot constitute the 289 primary unit. 290 291 6. "Public transit" means a signed and designated bus stop,train stop, ferry 292 terminal or other public transit station. 293 294 7. "Passageway" means a pathway that is unobstructed clear to the sky and 295 extends from a street to one entrance of the accessory dwelling unit. 296 297 (H) Section 16-100.020(A) is amended such that the definition of"accessory building or 298 structure" reads as follows: 299 300 "Accessory building or structure". A building or structure that is subordinate to 301 the main building on the same site, or the use of which is incidental to the use of 302 the site or the use of the main building on the site. A building that shares a 303 common wall with a main building shall be deemed a part of the main building. 304 (I) Section 16-100.020(A) is amended such that the definition of"accessory use" reads as 305 follows: 306 307 "Accessory use". A use customarily incidental, related, and subordinate to the 308 principal legal use of the parcel or lot and located on the same. 309 (J) Section 16-100.020(J) is amended such that the definition of"junior accessory dwelling 310 unit"reads as follows: 311 312 "Junior accessory dwelling unit". A unit that is no more than 500 square feet in 313 size and contained entirely within an existing single-family structure. A junior 314 accessory dwelling unit may include separate sanitation facilities, or may share 315 sanitation facilities with the existing structure. 316 317 (K) Section 16-100.020(S) is amended such that the definition of"secondary dwelling unit" Tiburon Town Council Ordinance No. 568 N. S. Adoption Draft 4--/2017 7 318 reads as follows: 319 320 "Secondary dwelling unit". The predecessor to an accessory dwelling unit under 321 local zoning laws. Secondary dwelling unit permits were issued under local 322 zoning laws in effect after February 3, 1984 and prior to January 1, 2017. 323 324 (L) Section 16-100.020(L) is amended to delete the definition of"Legal non-conforming 325 secondary dwelling unit". 326 327 328 SECTION 3. SEVERABILITY. 329 If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this 330 Ordinance, or its application to any person or circumstance, is for any reason held to be invalid 331 or unenforceable, such invalidity or unenforceability shall not affect the validity or enforceability 332 of the remaining sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases of 333 this Ordinance, or its application to any other person or circumstance. To reflect the Council's evaluation, I have prepared a draft First Amendment to the Employment Agreement (Exhibit 1) to reflect recommended adjustments to the Manager's compensation package as communicated to me by the Mayor. The Town's compensation policy provides that Town salaries shall be competitive with comparable positions in the market. Accordingly, we recommend a 2.5% increase in the Manager's base salary. In addition, it is my understanding that the Town believes the Town Managers performance will be enhanced if he resides in Tiburon. Accordingly, we recommend adding Section 4.9 of the Town Manager Employment Agreement to provide a $750 per month Housing Assistance Allowance. This proposed allowance is contingent on the Manager maintaining his primary residence in the Town of Tiburon. FINANCIAL IMPACT The financial impact of the proposed amendment would be approximately $7,000 in the current fiscal year. RECOMMENDATION 1. The Act requires the Town to annually approve the TTBID assessments and the activities funded by those funds. The Town has taken the first two steps in that process: • On January 11, 2017, the TTBID Advisory Board approved its Annual Report, which included information on the TTBID's past and projected revenues and expenditures and the proposed TTBID Program for the upcoming year. • On January 18, 2017, the Town Council adopted Resolution No. 03-2017 ("Resolution of Intention"), declaring its intention to levy and collect assessments within the TTBID and to use those assessments to fund the TTBID Program. The Resolution of Intention set these actions for public hearing on February 1, 2017. The draft report recommends the Town use the TTBID assessments to continue and expand upon the initiatives begun during the past fiscal year. The Town would use the TTBID assessments to fund a marketing program, in consultation with the TTBID beneficiaries—the Town's lodging establishments—and other interested parties. The TTBID program will consist of the following activities: • Develop a multi-channel communications plan designed to reach Meeting Planners at all relevant touch points. • Create marketing materials for Meeting Planner target: Website (MeetInTiburon.com), Tip Sheets, White Papers, Photography, Video, Trade Show presence, Collateral, Print Advertising, eBlasts, Blog strategy and content, Instagram strategy and content, Cinema advertising. • Bring together a Tiburon Experience Network, a group of local service and experience providers who can provide services to meeting participants. In addition to assessment revenue, the TTBID anticipates receiving $30,000 from the Town of Tiburon, which is a portion of the Transient Occupancy Tax collected by the Town. Staff anticipates expending approximately $315,000 in Fiscal Year 2016- 17, with any surplus funds carried over to the next fiscal year (2017-18). Tonight's action is the last step in that process. The Act requires the Council to hold a public hearing on the proposed assessments and hear any protests from interested parties. In the absence of a protest from businesses that would pay a majority of the proposed assessments, the Council can move forward and adopt the Resolution attached to this staff report, continuing the TTBID assessments for the upcoming year. As directed by Council at their meeting on January 18, 2017, staff has arranged for Dianne Admire, Director of Marketing for Destination Tiburon, to provide a brief presentation to Council on the TTBID program. As of this date, the Town has received no protests. I would also note, the assessed parties, the Town's two lodging establishments, have been very supportive of the TTBID program and are represented on the TTBID Advisory Board. FINANCIAL IMPACT Staff does not expect any significant financial impact as a result of Council approving staff's recommendations. The Town will continue to fund the TTBID program from the TTBID assessments and a portion of the Transient Occupancy Tax received by the Town. The total budget appropriated approximately $13.99 million and consisted of: Operating Program $10,838,457 Capital & IT Outlay 425,300 Capital Improvements 1,962,000 Debt Service 762,713 Total Appropriation $13,988,470 Since adoption of the budget, the Town Council has approved $64,680 in budget amendments. These amendments include $32,000 to replace a police vehicle one year earlier than planned and a $32,680 increase in the appropriation for the design and engineering of the New Morning Cafe street frontage improvements. As amended, the total appropriation for FY 2017 totals $14,053,620. The following analysis will concentrate on the Operating Budget, which focuses on the Town's ability to fund and provide the ongoing day-to-day services to the residents of the Town for the year. ANALYSIS Schedule 1 of the attached statistical information provides the highest summary level of the Town's Operating Budget for FY 2017. At mid-year, operating revenues are at 46.8% of budget and operating expenditures are at 46.5%. It is normal for revenue to lag below the 50% mark at mid-year due to the timing of certain larger revenue sources which are received after the December 31 reporting period. It is also common for operating expenditures to be near or exceed the 50% mark due to the payment of large, one-time expenditures early in the fiscal year, such as premiums for workers' compensation and liability insurance along with JPA dues. The adopted budget called for an operating surplus of$253,850 and at mid-year staff projects the Town will complete FY 2017 with an operating surplus of approximately $547,371. As this report is prepared on a cash basis, it should be noted that there may be some timing issues in the receipt of certain revenues that may skew year-to-year actual figures. One notable change this fiscal year is the remittance of sales tax. The State is once again remitting to each agency its monthly portion of sales tax, as opposed to the past 10+ years where the State withheld 0.25% and the Town was then reimbursed twice a year (January and July) by the County through a property tax shift. Staff projects this change adds an additional $80,000 towards the actual receipts through December 31, 2016, compared to December 31, 2015. In addition, in August of 2016 the Town received administrative fees of approximately $100,000 from the refinancing of the various Town assessment district bonds. Operating expenditures are tracking $87,701 ahead of the previous fiscal year at December 31 and is consistent with the adopted budget. Operating Revenue Schedule 2 of the financial statements provides budget to estimated year-end figures for FY 2017 at the category level of detail. Overall, the revenue forecast for FY 2017 is projected to exceed budget by $293,521. This projected increase is due to greater than budgeted revenue from property taxes, other taxes, investment earnings, fines and forfeitures and other revenue. Property Taxes are the Town's largest revenue source and include Secured, Unsecured, ERAF and In-lieu of Vehicle License Fees. Secured property taxes account for approximately 70% of total property tax revenue. Overall property taxes are projected to exceed budget by $80,295, or 1.6%. Secured property taxes were budgeted to increase 4.35% over FY 2015-16 actual receipts. Based on December's remittance from the County, Staff is projecting that secured property taxes will exceed budget by $61,820, which is a 5.5% increase over last year's actual receipts. Other Taxes include sales, transient occupancy and property transfer taxes and is the Town's second largest revenue category. Staff is projecting that Other Tax revenue will exceed budget by $32,386, or 2%. Based on receipts at mid-year, sales tax is projected to exceed budget by $30,000, while all other revenue sources are performing at budgeted. Transient Occupancy Tax appears to have leveled off after several years of significant increases. All revenue sources in this category are highly dependent on the local, state and national economy and normally will be the first affected by any negative impacts in the economy. _.........._................_.....................__T___.___.__.._._._..____ Page 2 of 5 Town Council Mc_cting Fchruar)l i.2017 Franchise Fees include PG&E, cable and refuse collection. PG&E fees are received annually in April, so it is too early to determine any variance from budget. Cable and Refuse fees are remitted on a quarterly basis and are performing as budgeted. Fines & Forfeitures include vehicle code, parking, false alarm and building related fines. Revenues within this category are projected to exceed budget by $50,500. This increase is due to greater than budgeted fines related to building permit extensions. Investment Earnings include all interest income earned on general funds that are either invested in money market accounts or with the State Local Agency Investment Fund (LAIF). Investment earnings are anticipated to exceed budget by $38,650, or nearly 93%. LAIF interest rates have increased steadily since adoption of the budget and accounts for the projected increase. Intergovernmental and Agency category includes miscellaneous reimbursements from local agencies for fuel purchased at the Town pumps, State reimbursement for police personnel training, and fees received by the Town for abandoned vehicles and general grants. Staff projects this revenue category will meet budget by fiscal year end. Licenses and Permits is the Town's third largest revenue category and include fees related to business licenses, building permits, design review, parking permits and several other small revenue sources. This revenue category is projected to meet budget by fiscal year end even though revenues are at 43.4%. This is due to business license renewals which are not due until after the reporting period. Charges for Services consist of plan checking fees, residential building inspection reports, cost recovery for staff time that can be billed to others, and several other small revenue sources. Overall this revenue category is projected to meet budget. Other Revenue includes rent received for the cellular tower at Town Hall, settlements and other reimbursements or administrative fees. Staff projects this revenue category will exceed budget by $91,690. This increase is due to revenue received from the refinancing of the various assessment district bonds. Use of Other Fund Sources accounts for restricted fund, other than the general operating revenues, that are charged directly for certain operating expenditures. At mid-year these revenue sources are projected to meet budget at fiscal year-end. Operating Expenditures The FY 2017 budget appropriated $10,838,457 in operating expenditures. At mid-year, operating expenditures are slightly above $5 million, or 46.5% of budget. All operating divisions, except Non-Departmental, are running below the 50% mark at mid-year. Staff does not project any divisions will exceed budget at year-end. The Non-Departmental division budget is running above the 50%mark because many of the expenditures are made at the beginning of the fiscal year, such as insurance premiums and JPA dues. These projects are outlined in Schedule 3 A-C. At mid-year expenditures are well below budget due to the timing of construction projects which are normally designed during the first half of the fiscal year and construction taking place during the second half. Capital Equipment and Outlay Resources The FY 2017 budget appropriated $425,300 in capital equipment and information technology purchases. At mid-year expenses are at 36.9% of budget and are expected to be at budget by the fiscal year end. Statement of Fundinlz Resources Schedule 4 of the attached statements provides an overview of activity for each of the various Town General and Restricted Funds. General Fund Designated Reserves The Town's policy-restricted General Fund Reserves began the fiscal year with $6,524,952 in fund balance and is projected to end the year with $5,545,604, a decrease of$979,348. Within this group of reserves, the General Fund Operating account is projected to end the year with a balance of$3,547,471, which is an increase of$547,371. Pursuant to the Town Council's direction, $1,252,019 was transferred from the General Fund Other Post Benefits Reserve to the PARS Irrevocable Trust during the reporting period, thereby reducing the Reserve's fund balance to zero. The Capital Equipment Replacement Reserve is projected to end the year at $382,713 or $25,800 less than the beginning balance. This Reserve will still be well above the policy minimum funding level of$132,000. The Technology Reserve will end the year with a fund balance of$343,693, or $248,900 below the beginning balance. This is due to the Town's larger than normal investment in software for a new financial reporting system and additional modules to the building permit tracking system. The General Fund Discretionary Reserves will begin the year with $4,903,219 in fund balance and end the year at $3,911,219. This decrease of$992,000 is due to budgeted Capital Improvement Projects programmed from these reserves. The larger projects include the Undergrounding of Utilities from Lyford Drive to Ned's Way, McKegney Green playfield design, and storm drain improvements. The General Fund Unallocated Reserve begins the year with a balance of$3,658,627 and there are currently no Capital Improvement projects programmed from this reserve, therefore the ending balance is projected to be the same. Restricted Fund Reserves Restricted Funds have legal constraints on their use imposed by outside entities or by legislation of the Town. The Town began the year with $6,095,387 in Restricted Funds and is projected to end the year with $6,212,476. This represents an increase in fund balance of$117,089. Key revenues are performing slightly better than budgeted and staff will continue to monitor revenues that may show signs of softness and control operating expenses to stay within budget. The normal rate is paid based upon a percentage of payroll for each plan. The unfunded accrued liability payment is an annual lump sum payment. Staff will first attempt to address the impact to the Town's normal costs. The normal cost generally represents the portion of the cost of projected benefits allocated to the current plan year. The employer normal cost equals the total normal cost of the plan less employee contributions. Using the table above, staff has used the high-end of projected increases to its plans (worst case scenario). Staff is also using a constant payroll of$3,784,881, split $1,419,357 for Safety and $2,365,523 for miscellaneous employees, which reflects the projected payroll for the current fiscal year (FY 2017). The 5-year ramp up means that the payments in the first four years of the amortization schedule are 20 percent, 40 percent, 60 percent and 80 percent of the ultimate payment, which begins in year five. The 5-year ramp down means that the reverse is true and the payments in the final four years are ramped down by the above percentages. A new ramp is established with each change to the discount rate. There will be three ramps established in the first three years. As a result of the 5-year ramp up and effective date of the increase, it will be seven years until the full impact of the discount rate change is completely phased in. The shaded rows above are the expected increases beyond the five year projection quoted in your June 30, 2015, valuation report. Page 2 of 3 Circular Letter:200-004-17 January 19,2017 To illustrate how this table can be used as a guide to include the change in the discount rate in the calculation of pension contributions, a Miscellaneous plan with a current normal cost of 15 percent of payroll can expect an increase to 15.25 percent to 15.75 percent of payroll in the first year (Fiscal Year 2018-19), and 16 percent to 18 percent in the fifth year (Fiscal Year 2022- 23). For the UAL payment, a plan with a projected payment of$500,000 in Fiscal Year 2018-19 and $600,000 in Fiscal Year 2022-23 can expect the revised payment to be $510,000- $515,000 ($500,000x2.00%/$500,000x3.00%) for Fiscal Year 2018-19, and $720,000 - $750,000 ($600,000x2O%/$6OO,000x25%) for Fiscal Year 2022-23. These estimated increases incorporate both the impact of the discount rate change and the ramp up. Please keep in mind the above table is a tool for you to calculate broad estimates and should only be used as a general guide. Although I know this item is not on the agenda for action or discussion, as I am out of town at the Passenger Vessel Association Conference, I am submitting written comments on behalf of Blue & Gold Fleet. Blue & Gold Fleet and has had the pleasure of providing commuter, weekday and weekend ferry service to Tiburon for the past 20 years. My father originally founded Blue & Gold Fleet as a passenger tourist service in 1979. After the Loma Prieta Earthquake in 1989, Blue & Gold Fleet provided much needed ferry service to stranded commuters in the East Bay and started its ferry commuter service with the city of Alameda and Oakland in 1991. We contracted with the city of Vallejo in 1994. Over the years, the Water Emergency Transit Authority (WETA) has taken responsibility for the provision of commuter ferry service on our former routes, with Blue & Gold Fleet providing contract services to WETA. The exception to this model is the Tiburon commute service, which remains a private service with no available public funds. In 2015 it became clear to us that we could no longer keep up with the rising costs of servicing the MV Zelinsky. We made a difficult business decision to get out of the commute service. We began discussions with Golden Gate Ferry to take over the service in 2015. We knew then and still believe today that Golden Gate Ferry is well positioned and has the resources to provide the level of commuter service the Town deserves. So we began discussing the transfer of service to Golden Gate Bridge District, who already provides service from Marin County. We also decided to sell the MV Zelinsky when a deal appeared to be close to being finalized. We know the commute service is appealing because of the transit time on a faster vessel. Using a slower backup vessel was never part of a long term plan. We used the MV Bay Monarch until she needed to go into the ship yard for repairs, preventative maintenance and a regulatory United States Coast Guard dry dock inspection. The District's ferries are nearly the same size as our backup vessel the MV Bay Monarch. The MV Bay Monarch and its sister ships have been used on the Tiburon commute service many times before. I speak from experience since I was the Tiburon Captain that operated these larger vessels in 1997 when the MV Zelinsky was repowered and out of service for 9 months. The District has the safety record and capability to provide the same level of exemplary ferry service to Tiburon as it does throughout Marin County. We greatly appreciate the time and effort spent by the District and our landlord, AC Ventures to work through the numerous issues we encountered in negotiating the lease documents necessary to successfully transfer the commute service to the District. After many months, we reached what appeared to be a successful resolution for all parties and, most importantly, the community of Tiburon. The last step needed was approval by the District's Board of Directors, which was originally scheduled for last Friday. As you know, action was not taken due to last minute issues raised just prior to the meeting. One of these issues was the fact that the Tiburon fire boat would not be able to leave the dock. We spoke to the Tiburon Fire Department and they do not foresee this as being an issue. We were and remain prepared to execute all documents to transfer our commute service, upon approval by the District Board of Directors. We believe the transfer, as proposed, will meet the needs of the community of Tiburon and will ensure safe and efficient ferry commute service. In the meantime, we will continue providing commuter service to and from Tiburon and are taking the following steps to improve service: 1) We have accelerated the preventative maintenance cycle to get the MV Bay Monarch back into regular service by doubling up on our labor schedule. We hope to have the vessel back in service by February 8. 2) We will work with the WETA staff to use a WETA vessel when one becomes available. Unfortunately, without the MV Zelinsky the backup choices are not sufficient to keep the old commute schedule. We knew this two years ago, which is why we planned the transfer then. Upon approval of the transfer, we look forward to continuing to provide our existing mid-day and weekend service to and from Tiburon. These excursion services have traditionally been utilized by the slower excursion vessel adequately. Thank you for your time and service to the Town of Tiburon. In February 2016, the Golden Gate Bridge, Highway and Transportation District Board of Directors voted to establish weekday, Tiburon-San Francisco commuter ferry service provided by Golden Gate Ferry. In summer 2016, Blue &amp; Gold Fleet sold its high-speed ferry, the MV Zelinsky. In the meantime, commuters have been subjected to inconsistent service, increased transit time, and altered schedules that makes it difficult for many to meet work, family, and personal commitments. The failure of Golden Gate Ferry to assume the Tiburon-San Francisco commuter ferry service is negatively impacting us, our families, and our community. On January 27, the Golden Gate Bridge, Highway and Transportation District Board of Directors declined to vote on the long-awaited agreement that would allow Golden Gate Ferry to assume Tiburon-San Francisco commute service from Blue &amp; Gold Fleet. According to Golden Gate Ferry, "it is uncertain if or when Golden Gate Ferry will assume service." Ferry Assume Tiburon Commuter Ferry Service Blue &amp; Gold Fleet announced in September 2015 its intention to discontinue commuter ferry service between Tiburon and San Francisco. In February 2016, the Golden Gate Bridge, Highway and Transportation District Board of Directors voted to establish weekday, Tiburon-San Francisco commuter ferry service provided by Golden Gate Ferry. In summer 2016, Blue &amp; Gold Fleet sold its high-speed ferry, the MV Zelinsky. In the meantime, commuters have been subjected to inconsistent service, increased transit time, and altered schedules that makes it difficult for many to meet work, family, and personal commitments. The failure of Golden Gate Ferry to assume the Tiburon-San Francisco commuter ferry service is negatively impacting us, our families, and our community. On January 27, the Golden Gate Bridge, Highway and Transportation District Board of Directors declined to vote on the long-awaited agreement that would allow Golden Gate Ferry to assume Tiburon-San Francisco commute service from Blue &amp; Gold Fleet. According to Golden Gate Ferry, "it is uncertain if or when Golden Gate Ferry will assume service." The undersigned petition the Golden Gate Bridge, Highway and Transportation District Board of Directors to vote as soon as possible to (1) approve any and all agreements necessary to allow Golden Gate Ferry to assume the Tiburon-San Francisco commute service; (2) provide a high-speed ferry equivalent in size and power to the boats that Blue Gold Fleet used until summer 2016 (such as the MV Del Norte); and (3) offer a schedule equivalent to that offered by Blue &amp; Gold Fleet in February 2016 (when the Board approved the transfer of service). ("AITF"),which owns and operates from the dock and float of the 21 Main Street property. •Business Events I am deeply concerned about the current and future impact of the Blue and Dances Gold and San Francisco Bay Area Water Emergency Transportation Authority (WETA)fleets that are docking,or will be docking, at the Zelinsky float. •Fantily Reunion Those vessels far exceed the intended and historical capacity and design of vessels using the Zelinsky float. The Zelinsky float and the AITF dock extend from the land in acute angles toward each other, forming a triangle with the entrance at the top point. I have attached an aerial photo for your reference. There are several areas of concern: 1. The length and breadth of those vessels will impede the ingress and egress of my vessels from our facility. 2. Use of the larger vessels has already moved silt to increase shoaling around the AITF facility and the entrance to the Corinthian Yacht Torry Service Club. SightseolugTours 5. In rough weather, boats tied up at the Zelinsky float, and extending Ear beyond the end of the float, will not only pose a threat to AITF's Special Events facilities, but constitute a hazard to navigation. Historical Tours 6. When docked, the WETA boats(approximately 118 feet in length at the waterline)completely block our ingress and egress to east side of Banquets our dock. The wash from WETA boats forces our vessels that dock on the west side of our float (and our passengers) to stand off until they shat off Parties their wash. Sunset Cruises 7. WETA boats with midship loading doors present less of an intrusion; WETA boats with bow loading doors, however, mean that— Ceremonios similar to the Blue and Gold ferries—the WETA boats would hang outside the entrance to my dock, impeding access to the east side of our float and School Events limiting access to the west side of my dock. My father built our dock in 1946 and our family has operated the Angel-Island Tiburon Ferry at this location since Dances 1959 so we have seen a lot of change in the area. We would, however, like to avoid change that negatively affects our business and the safety of our vessels Rimily Reunions and passengers. In your letter, you expressed concerns about the ongoing and future operations of ferry service at the Zelinksy float owned by A&C Ventures and currently operated by Blue & Gold. While those issues you identify could potentially adversely affect your dock, the Town has no regulatory authority over the current Blue & Gold ferry operations, and likewise, has no authority over the proposed Golden Gate Bridge Highway& Transportation District ferry service. The Town suggests you reach out to these ferry operators and relay your stated concerns. If you would like the Town's assistance in facilitating a meeting between the ferry operators and the property owner, A&C Ventures,the Town would be willing to make our Town Hall available for any such meeting.
