SUBJECT: Romberg Tiburon Center Master Plan Study

The Romberg Tiburon Center for Environmental Studies (RTC) is starting preparation of a
Master Plan Feasibility Study for its 35-acres of land area. The San Francisco-based firm of
Flad Architects appears to be the top choice as the consultant to prepare the Master Plan study.
The study seeks to focus on facilities planning that would further the goals and mission of RTC,
which is a blend of research, education and community outreach. The study would include text
and graphics addressing, among other things, site constraints, infrastructure, existing buildings,
quality of life issues, and opportunities for upgrade of facilities.
As a "field station" of the San Francisco State University (SFSU), RTC is not eligible for campus
development funds that typically pay for planning, improvements, and upgrades on regular and
satellite campuses of the California State University system. Funding for RTC planning efforts
such as this is difficult to come by, and one purpose of the study is to create a vision document
that will attract future funding for RTC physical improvements.
As the Town Council is aware, the RTC site is replete with dilapidated former military structures
and suffers from inadequate infrastructure throughout. The once robust deep-water pier is gone
except for many of the original piers which remain in place but whose suitability for pier
replacement is not known. Most of the buildings on the site are unsuitable for human
occupation at the present time.
The study is not a "project" under CEQA and will not require environmental review, but cannot
therefore be relied on as any form of project approval for future improvements; any future
improvements identified in the Master Plan study would require CEQA review when proposed
for construction. However, as RTC is on state-owned land, the local role in any CEQA or
decision-making process would be limited to commenting on proposals and any level of
participation deemed appropriate by SFSU.
Town staff will provide the Town Council with periodic updates as this exciting process moves
forward.

At the May 13, 2009 Tiburon Planning Commission meeting, the Commission voted Jeff Slavitz
Councilmember
to modify the conditional use permit for the Hawthorne Nursery School, which is a
tenant at your church property. During that meeting, the status of compliance with the
separate Community Congregational Church (CCC) conditional use permit was
repeatedly raised by a Pilgrim Heights Homeowners Association (PHHA) Margaret A. Curran
neighborhood representative. While the Planning Commission was disinclined to re- Town Manager
open the CCC conditional use permit at that time, the Commission directed Town staff
to contact CCC to discuss the concerns raised by the PHHA.
To summarize, at this time, the Town does not intend to reopen the existing use permit
for review by the Planning Commission, but wishes to work with CCC to ensure
compliance with the Memorandum of Understanding between CCC and the PHHA
that was reached in July 2000. Our goal for this meeting is to confirm that practices
and procedures are in place for successful adherence to the MOU provisions such that
a public review and re-opening of the CCC conditional use permit is not necessary.

In early to mid-July, Team Ghilotti Inc will begin the installation of a new pipeline in Blackfield Drive
in Tiburon.
Your service may be interrupted for short periods during construction. The District will notify you 24
to 48 hours in advance of each shutdown by hanging a tag on your FRONT GATE or, if you do not
have a gate, on your FRONT DOORKNOB. If a medical condition exists which requires that you
receive continuous water service, please notify me at the number below as soon as possible.
During construction, please be aware of heavy equipment and construction personnel, and follow the
instructions of the contractor's flagmen and signs. Also, reduce your travel speed to maintain safe
conditions within the construction zone. The Contractor's normal work hours are from 8:OOAM -
5:OOPM, with setup and cleanup activities possibly occurring just outside this time window. We
expect work to be completed around September 8, 2009 assuming no unforeseen difficulties or
inclement weather.
Thank you in advance for your cooperation in this matter. The Contractor will take all measures
possible to minimize inconveniences associated with construction operations, including excessive
noise and unnecessary traffic delays.

Lyford House, the yellow Victorian on the shores of Richardson Bay at the
Richardson Bay Audubon Center & Sanctuary, will be open for visitors on the second
Saturday of the month for four months beginning July 11, 2009.
Lyford House was originally the home of Dr. Benjamin Lyford and his wife
Hilarita and was located at Stawberry Point on land that Hilarita had inherited from her
father, John Reed, holder of the Mexican Land Grant that included the Tiburon Peninsula.
In 1957, local conservationists saved the house from demolition and had it transferred by
barge from Strawberry to its current location on Greenwood Beach Road in Tiburon. It
was deeded to the Audubon Society in 1961 and was added to the National Register of
Historic Places in 2000.

2. BTLF Report - Deborah Mazzolini
Petrocelli Luncheon tickets are still selling. The event is on June 9t" at the SF Yacht Club.
The Governance Task Force has invited 501 C3 attorney Gene Takegi to the BTLF meeting on June 2nd
to describe the legal aspects of non-profit boards and answer questions about the restructuring of the
Board. Local attorney Jason Kuhns recommended Mr. Takagi for this purpose.
3. Library Director's report - Deborah Mazzolini
Director Mazzolini will be on vacation beginning June 3 and returning on June 22, the day of the next
BTLA meeting. She and Mary Vella will prepare the agenda for the meeting prior to her departure and
Mary will distribute the Board packets beforehand as usual. Chair Steger Johnson and Vice Chair
Epstein will also be away during this same period. In case of any urgent matters Mary Vella is the
contact on the staff.
The increase in library circulation and statistics was reiterated.
4. Financial statement
With only two months remaining in the budget year, overall expenses continue to be on budget.
5. Committee Reports
Trustee Beverlee Johnson reported on the Program and Film Committees. Both are running smoothly.
Vice Chair Epstein reported that the Art Committee will jury for the calendar year 2010 in September.

TRUSTEE CONSIDERATIONS
8. Building Program Expansion update
The Planning Commission of the Town of Tiburon met on the topic of the EIR. Director Mazzolini
distributed three letters written by the public in response to this meeting. One was concerned about
potential traffic issues, another was a letter to the editor of the Ark, and the third was from a former
mayor who questioned several misunderstandings by the Commission. The Board felt it would be
beneficial to begin educating the community about expansion facts again. The Library Director reported
that a Community Engagement Committee has been formed and their goal will be to organize
neighborhood meetings again. It was suggested that Director Mazzolini perhaps prepare regular articles
for Ark publication to inform and education the public concerning libraries and their future.

9. Marketing, public relations and fundraising
The library's marketing consultants are amenable to preparing a shorter simpler concise brochure for
distribution at home meetings which will reduce costs.
10. Draft Budget FY09/10 discussion
Four different draft budgets were presented. One included a 2% increase in basic tax revenue; the
second reflected this increase plus a COLA for staff; the third included an 8% cut in basic tax that
may be taken by the state if the propositions fail in the upcoming election, but includes a 2% COLA for
staff; the fourth reflects the 8% cut with no COLA. If the 8% is taken by the state this would occur for
one year only and would be repaid with interest within three years.
Given these scenarios, the options include: budgeting the library's ERAF reimbursement, which is the
intention of the Town and the City, or using undesignated reserves to cover the shortfall. To date the
library has not budgeted ERAF. The available cash at the end of the year will approximate $1.8 million.
After discussion, the BTLA's preference is to use reserves but will also review the budget quarterly
relative to the economy. The final draft will be presented for approval in June.
11. Resolution No. 180-2009 Pre-Tax Payroll Deduction Plan for Service Credit Purchases
A motion to approve Resolution No. 180-2009 was made. All trustees were polled individually and the
resolution passed unanimously.
12. Personnel Policy Update
The Director and assistant met with the Library attorney to review the draft Personnel Policy. A few
changes will be incorporated before the draft is brought before the BTLA for review and approval.

Chair O'Donnell called the meeting to order at 7:30 p.m.

ORAL COMMUNICATIONS: None
COMMISSION AND STAFF BRIEFING:
Planning Manager Watrous stated that the June 24, 2009 meeting would include a CUP
amendment for Kol Shofar, a review of the CUP for 46 Main Street and a precise plan
amendment for 9 Cecilia Court. He noted that there are no items scheduled for the July 8, 2009
meeting.
Chair O'Donnell reported that he will be absent from the first meeting in August and
Commissioner Frymier reported that she will be absent for both meetings in July.
Commissioner Fraser stated that he and Chair O'Donnell will recuse themselves from Agenda
Item 3 and requested it be moved to the end of the meeting.
DISCUSSION ITEM:
1. GREEN BUILDING PROGRAM SIX-MONTH REVIEW
Planning Manager Watrous presented the staff report, reviewing the history and current status of
the Town's green building program which has been in effect since November 3, 2008. He noted
that since the green building ordinance went into effect, five design review applications subject
to the ordinance have received approval but only two projects have submitted for building
permits, and neither has been issued. He stated that the launch of the green building program has
been smooth and problem free but the Town had received some feedback indicating that the
points required under the program are too low and probably need to be increased in the future.
He recommended that the Planning Commission accept the six-month status report of the

implementation of the green building program and direct staff to return with an additional report
on the program in approximately another six months.
Commissioner Frymier requested clarification on the difference between the green building
program and LEED certification and what is now in place for the Town. Mr. Watrous said that
the Town uses its own green building program and explained that both residential and
commercial projects wishing to attain a much higher certification than is currently offered
through the Town can choose to apply for LEED certification. '
Commissioner Corcoran said that the limited number of applications do not provide enough
information to determine what, if any, adjustments to the program are necessary but he did agree
with staff that an increase in the points requirement would most likely be appropriate.
Commissioner Fraser concurred and recommended the Commission reserve judgment until there
is enough information available to assess the program's success.
Chair O'Donnell agreed and said time will reveal the true impacts of the program. He said that
feedback from applicants who are currently embroiled in the planning and inspection phases of a
project may be guarded and not always the clearest representation of those impacts.
Vice-Chair Kunzweiler said projects such as the house at 5035 Paradise Drive that is attempting
to be certified LEED platinum make a strong economic argument in favor of LEED certification.
He said that interest in the LEED program seems to be increasing and he suggested that the
Town keep an eye on the standards its own program demands.
Commissioner Corcoran asked if the Town's green building program guidelines provide any
guidance for a residential applicant wishing to utilize the LEED rating system instead of the
green points rating system. Mr. Anderson said the ordinance states that any project obtaining
LEED certification automatically meets the green building program requirements.
Chair O'Donnell said people make best building practice decisions which include being
environmentally responsible. He cautioned that a bureaucratically-dictated program is not
necessarily "green" and reiterated concerns that the program may saddle applicants with undue
burden and cost.

Planning Manager Watrous presented the staff report, describing the work done so far to update
the Zoning Ordinance. He said that most of the changes have been made to create more useable
documents that are up to date with current industry practices and legal requirements. He noted
that a redline version of the document has been requested but staff feels that it would be nearly
impossible to provide an accurate version, adding that the draft ordinance contains footnotes
cross-referencing the original document.
Chair O'Donnell questioned if any changes had been made beyond those 13 outlined in the staff
report. Mr. Watrous explained that the staff report only highlighted the substantive changes, but
that the updated ordinance also contains many new definitions and updated language. He said
that the development standards have been mostly left alone. He stated that said that most of the
changes not listed in the staff report are primarily small text changes scattered throughout the
document and have not altered the intent or spirit of any other sections.
Commissioner Fraser stated that the Zoning Ordinance provides the Planning Commission with a
base of authority and responsibility and, as Commissioners, they are being asked to approve the
document's language, content, and impact on the community. He said he used the cross-
referencing system provided as well as met with staff and found himself truly challenged to
grasp the scope of the changes being proposed. He acknowledged that many of the changes may
be slight but said he is unable to approve them until he is able to read them, compare them to the
original document and understand their impact. He said that staff offered to review the document
in sections, similar to the General Plan review, and suggested this may be similarly beneficial.
Chair O'Donnell agreed and he said that he only reviewed the sections outlined in the staff report
thinking there were no other changes.
Vice-Chair Kunzweiler concurred and seconded Commissioner Fraser's recommendation to
review the document in segments. He cautioned against taking on too much at once and
suggested the Commission approach the document in smaller portions each meeting until the
entire ordinance is evaluated.
Commissioner Frymier stated that she looked for the term "play structure" in the discussion
about sports courts and found no mention of that in the draft ordinance. She said the time
provided only allowed her to focus on the document's format and aesthetics which she found
much more user friendly and easier to navigate. She noted the ordinance does not contain a
definition for a CUP and explained that the issue was raised by parents during the Belvedere
Nursery School CUP review. Mr. Watrous agreed that it would be helpful to include a definition
for conditional use permits.
Commissioner Corcoran asked whether it would be more appropriate to review the zoning
ordinance by major changes or one article at a time. It was the consensus of the Commission to
review the draft ordinance on an article-by-article basis, perhaps beginning with Articles I and II.
Chair O'Donnell questioned if the updated ordinance was crafted as a Microsoft Word
document. Mr. Watrous stated that the consultant used the old ordinance document to cut, paste,

reformat, and reorganize it into a new document rather than modifying the old so that changes
could not be easily tracked.
ACTION: It was M/S (Kunzweiler/Fraser) to continue the hearing to the June 24, 2009 meeting.
Vote: 5-0.

5. PLANNING COMMISSION MINUTES - Regular meeting of May 27, 2009.
Chair O'Donnell requested the following amendments to the minutes:
• Page 4, final paragraph - "He said that the proposal calls for transferring the zoning of
these parcels to the Town in an use up-zoned fashion that clearly benefits property
owners. He thanked Mr. Keil for his presentation and said that as a community, the
positive aspects of this potential annexation far outweigh any negative impacts
Vice-Chair Kunzweiler requested the following amendments:
• Page 4, 3rd paragraph - "...the General Plan discusses the annexation of unincorporated
Paradise Drive as a general afe concept... He noted that in addition to Planning
Commission and Town Council hearings, fliat the General Plan and..."
Commissioner Corcoran requested the following amendment:
• Page 4, 5th paragraph - "Based on that limited role, he said he can support what is a
request from citizens who, but for an arbitrary line, would already be a part of the town."
ACTION: It was M/S (Kunzweiler/Corcoran) to approve he minutes of the May 27, 2009
meeting, as amended. Vote: 5-0.
Chair O'Donnell and Commissioner Fraser both recused themselves from the following item and
left the meeting.
PUBLIC HEARING:
3. 1600 MAR WEST STREET: REVIEW OF A CONDITIONAL USE PERMIT
GRANTED TO EXPAND A PRIVATE RECREATIONAL FACILITY (TIBURON
PENINSULA CLUB; FILE #10406; Southern Marin Recreation Center, Inc.,
Owner; Assessor's Parcel Nos. 058-171-17, 76 & 84 and 058-240-21
Mr. Watrous presented the staff report, stating that at its last review the Commission concluded
that TPC was in substantial compliance with its conditional use permit and directed staff to
schedule an additional review of the conditional use permit in approximately one year and
reviewed issues of note associated with the club's activities. He noted that Town had received
complaints regarding noise over the past year, but these issues appear to have been resolved
since the coach for morning swim practices was replaced by the club and the club agreed to
prohibit outdoor amplified sound at any future social events. He stated that the new pervious
parking surface has eliminated complaints about dust or mud and that the Town has received no

complaints about 'parking issues since the installation of the new parking surface system. He
noted that TPC has not yet installed the bollard light fixtures in the parking lot that had been
previously discussed. He reported that a grate that had been installed above the cement-lined
ditch located adjacent to the Judge Field tennis courts to keep tennis balls out of the ditch had
been removed at the request of the mosquito vector control district and needed to be replaced.
He said that Staff found that the Tiburon Peninsula Club appears to be in substantial compliance
with most of the conditions of approval of its use permit and has made considerable efforts to
limit possible parking and noise impacts on other properties in the vicinity.
Vice-Chair Kunzweiler opened the public hearing.
Peter Winkler, TPC President, summarized the staff report noting that with the exception of the
grate, there do not seem to be any concerns with the Club's compliance. He thanked staff for
offering to assist in working with the vector control district. He acknowledged that the next
outdoor event would be the Del Mar School graduation ceremony on Friday, June 12.
Commissioner Corcoran questioned and confirmed there were no other outdoor social events
scheduled or planned for the coming summer at this time.
Commissioner Frymier referred to a condition of approval related to pedestrian safety and shared
concerns over the safety of two doors at the club that she believed could allow someone to enter
the club without going past club security or allow children to access the pool from the cafe. She
referred to a requirement that signs be posted encouraging members and guests to be courteous
of neighbors when exiting the club following events that end after 9:00 p.m. Mr. Watrous
explained that those are intended for outdoor social events ending after 9 p.m. Jerry Pang,
General Manager of TPC, confirmed that the Friday night social events end at 8:30 p.m. and that
signs are not required for that event. Mr. Winkler added that the TPC has adopted a reactive
approach in the sense that it will respond to any problem or complaint registered, even if the
Club is not required by the CUP to do so.
Commissioner Frymier asked what program the Club uses to retrieve tennis balls before they
enter the Railroad Marsh. Mr. Winkler explained the club's efforts to pick up the balls but that
once balls go into the ditch, they exit into the marsh and cannot be retrieved.
Commissioner Frymier asked if the club has any intention of installing the additional bollard
light fixtures in the parking lot. Mr. Winkler explained that at this point the club has a long list of
capital expenditures, including lighting, but they are taking things in order of necessity and the
benefit those improvements would provide.
Mr. Pang spoke to Commissioner Frymier's concerns over unsecure entry and access points at
the club with details about the doors and gates at the club.
Vice-Chair Kunzweiler closed the public hearing.
Commissioner Corcoran thanked the applicant for their patience tonight and acknowledged their
efforts to work with the community on alleviating the many issues associated with the club's
activities. He said the parking issue has been well addressed, noise is an ongoing discussion, and

he would support'. leaving the fence issue to the County Open Space District. He asked staff and
the Commission what it would recommend with respect to the next review period.
Vice-Chair Kunzweiler suggested that the CUP undergo one more 12-month review. He
acknowledged that no members of the public attended tonight's hearing to share any complaints,
but reminded the Commission that there has been a lot of activity associated with this CUP over
the last few years.
Commissioner Corcoran questioned if the review would be extended to every 24 months
following this next one. Vice-Chair Kunzweiler said there is no set formula and the Commission
is responsible for determining a suitable timeframe.
Commissioner Frymier stated strong support for the Club and their efforts to coordinate with
Town staff but reiterated her safety concerns that she felt should be addressed. Planning Manager
Watrous suggested that Staff would be happy to meet with representatives of TPC to review the
concerns and provide direction on how best to address them.
Vice-Chair Kunzweiler said the parking lot may be an underappreciated improvement and
acknowledged the work that must have gone into it, adding that it is a real compliment to the
Town.
ACTION: It was M/S (Corcoran/Frymier) to find TPC in substantial compliance with its use
permit and direct Town staff to work with TPC to address the issues identified by Commissioner
Frymier and to schedule another review in approximately one year. Vote: 3-0.
