("SSLP") Owner : The Town of Tiburon Property Address ' 1155 Tiburon B! vJ is t ro n / r Tiburon, California 94920 Commencement Date of PCS Site Agreement Friday, June 25,1999 (the "Agreement") Current Rent : 24,000 Per Year Additional considerations for Growth Cabinet(s) use : 61000 Per Year Owner and SSLP hereby agree that Exhibit B-1 of the Agreement is hereby : Supplemented by Exhibit 1 hereto, if Exhibit 1 reflects only the additional lease area to include the addition of a Growth Cabinet(s); ("Owner") SSLP is granted additional lease area which is hereinafter included within the [Site/Premises /Lease Premises] under the Agreement for the purpose of SSLP installing and operating additional growth cabinet(s) (radio equipment), the installation, operation, repair, replacement and removal of which is to be governed by the terms of the Agreement, and is hereby approved by Owner. When SSLP completes construction of its PCS facility, now and in the future, there will be a total of 4 equipment cabinets. Commencing on the first day of the month following the installation of the growth cabinet(s), SSLP will increase the Annual rent paid under the Agreement by $ 69000 Per Year . If rent is paid annually, SSLP will make a pro-rated payment for the balance of current lease year. SSLP may terminate this Amendment and remove the growth cabinet(s) at any time by notice to Owner. Upon such a termination, all sums paid under this Amendment will be retained by Owner (unless termination is due to Owner's failure to have proper ownership of the Property or authority to enter into this Amendment), and the Agreement will remain in full force and effect pursuant to its original rent, terms and conditions. Except as is specifically set forth herein, all of the terms and conditions of the Agreement shall remain unchanged and in full force and effect. This Amendment is effective on the later execution date of either party, as set forth below. Such replacement description shall be deemed a part of this Agreement and shall be binding on Owner and SSLP. ("Sprint PCS") as follows: Owner consents and agrees that the Authorized Parties may make and file applications on Owner's behalf to such local, state and federal governmental entities whose approval Sprint PCS may consider necessary or advisable to have the Property approved as a tower or antenna site, including, but not limited to, governmental approvals for zoning variances, rezoning applications, building permits and wetland permits. Owner hereby agrees that a copy of this Agreement is as effective as the original. However, if requested by the Authorized Parties, Owner agrees to execute such other and further documents as may be required by the governmental entity in question to evidence Owner's consent to the action which is proposed to be taken.
