HomeMy WebLinkAboutAgr 1985-09-05 (Innisfree Companies)INDEMNITY AGREEMENT For and in consideration of the issuance by the Town of Tiburon ("Town") of a certificate of occupancy for Unit No. 155, Bayside Condominiums, Point Tiburon, Tiburon, California, The Innisfree Companies agrees to hold harmless, defend with competent counsel satisfactory to Town and indemnify Town and its representatives and agents from all liability, losses, damages, costs, expenses (including attorney's fees and expert's fees), causes of action, claims and/or judgments arising by eason of the occupancy and/or use t (2 r rrF E: y itrr :S,4, !J ' i } s of said condominium unit i'suiting from any cause or causes limited to, claims by whatsoever including, but not ROBERT and CAROL WOLFE and/or any other occupant, person or party arising out of any claim of right to purchase or occupy said condominium unit. This indemnity shall extend to, but is not limited to, any claims by ROBERT AND CAROL WOLFE against Town that Town interfered with or prevented consummation of the WOLFE's agreement to purchase said condominium unit. The Innisfree Companies further agrees that close of escrow for sale of condominiums located at the Point Tiburon project, Tiburon, California, including, but not limited to, Unit No. 155, shall not occur until Town has approved Covenants, Conditions and Restrictions for said project.
