Furthermore, after spending seven years of study, suddenly this 90 days is rushed as well over the Christmas and New Year's holidays. While February 4th is the "deadline", cities and towns have only until January 12th to withdraw. Why the rush when so much is at stake? MUTA and CARE believe that the contract which you have provided to the cities and towns lacks the real terms that are necessary for any meaningful decision making. It does not identify the electricity supplier, despite the fact that Barbara George of Women's Energy Matters announced at the Ross Town Meeting on December 101h, that you, Damon Connelly, Dawn Weitz and two Navigant Consultants were delayed from attending that meeting and because you were detained in the airport in Houston, arfter meeting with the CEO and others at Shell Energy North America, a wholly owned subsidiary of Royal Dutch Shell. Why not name Shell in the contract, when it obvious that Shell is your choice? And why not at least provide tentative prices, even though the actual pricing, we are well aware, is the very day and minute you enter the contract. Why not also reveal that only 20% of Marin's load, the cities and towns' governmental electrical needs are to be "nailed down with certainty" for five years, that those of us who are citizens do not have such certainty as our contract will have to be negotiated at the time the "80%" of MEA's load enters into a contract one year hence? Therefore both MUTA and CARE believe that without including such basic terms, i.e. as naming Shell Energy and at least providing some tentative even ball park pricing, you are asking the cities and towns to sign a blank - fill in the spaces - document. MUTA and CARE are aware that other members of the public as well as the Marin Civil Grand Jury have questioned whether the document sent out by MEA contains sufficient information for adequate review and evaluation. We request that MEA provide Marin towns and cities with the full required 90-day review period including the above requested information. Thank you for your consideration. Brademan, Esq t.917.952.4312 and my accountant Ray Gee, Acct. t.510.524.9068 before writing this letter. Also know that Harbor Oak Properties has broken the Settlement Agreement, which is therefore now null and void, which I signed and dated on 12/1/09 - based on the legal assurance that a check for $2000. for me would be received by your office by December 3rd 2009 - by not complying by the agreed upon terms set out in this Agreement. HOP failed to meet a key condition of the Agreement I therefore want/need to re-negotiate the Settlement Agreement. As I have stated previously I am out of town on business in January 2010 and will be back February 1 S` or close there after for an out of state business commitment which cannot be altered. I received your letter dated November 25`h 2009 before you left town and am expecting and hoping for a call from you early Monday December 21 sc 2009 when you return to your office to find resolve. I need your help and an extension as I have not yet found a new place to live. Most all of the places available for rent have the same problems as Harbor Oak Properties: Deadly 2nd hand tobacco smoke and toxic chemical laundry soap scents (phosphorus) on the property. Alice Fredericks outgoing Mayor of Tiburon spoke with me last week and said a non-smoking ordinance will be coming up for vote at the Town Council Meeting the first art of the year and invited me to come. I will go and hope to speak up about my difficult experience at 30 Harbor Oak Drive and subsequently with HOP. As per information in your letter on December 8`" 2009 I called Susan Sheftel your District Administrator at 510.622.2962 to see if indeed HOP had sent the check. Not only had they not sent the check but/and Ms Sheftel was confrontive, argumentative, extremely unprofessional, unkind really, towards me. She did not even say Hello but as soon as she heard it was me said `You are supposed to me calling me to tell me when you are moving out!" I responded with "Excuse me?" Ms Sheftel continued with berating verbiage and I replied with `I will not let you talk to me this way. I am the one who has been wronged here and calling to ask for help and this is, again, classic behavior on HOP'S part to again NOT comply with legally written contracts." Ann P Meredith's Letter to Jeremy Fong HUD re: HOP December 181" 2009 1 I was very upset by the phone call and do not appreciate Ms Sheftel-no matter what her position there may be-treating me with such disrespect and disregard. I expect and am entitled to more from someone I am turning to for help in an already painful and difficult situation. That being said, I told her `No Check-No Move." As per usual I am the only one playing by the rules with HOP again not doing so. She said she would make a call and get back to me which she did on December 10t' - 8 days AFTER the deadline for your office to receive the check for me from HOP was due and informed me that a check arrived only after she contacted their office and prompted them to send the check. This is typical of HOP to not honor their legal written agreements with me ie. Not providing me with a quality of life that was promised and paid for by me at $1850. per month for Apt#22. The $2000. they have eventually sent is a paltry sum of what I am entitled to receive in redemption for the thousands of dollars I paid out to HOP for services I never received and for the medical expenses I incurred because HOP was not willing to help regulate tobacco and drug use at their property at 30 Harbor Oak Drive and the lack of paid for services from both Michael Parker manager and HOP owners since September 25"' 2008. The Agreement also included the lie that HOP had `done nothing wrong.' I am the one who is disabled; I am the one who has been wronged here. I am still looking on a daily basis to move out of apt#22 as soon as possible. I do not and cannot afford to be homeless/out on the street with no place to live. The HILARITA RESIDENTS ASSOCIATION REPORT Meets emy third Monday of the month at 7.30 PM in the Esther Whitman Community Center Nuria (bars reported that at a recent HRA meeting: a) preparations for the Election Committee were made; b) received and processed nomination forms for the Election Committee; c) deadline for nominations is November 16, 2009. < 1 > 6. SECRETARY'S REPORT Barbara Garcia-Romero advised that on behalf of the Board of Directors, a get well card has been sent to Director Michael Peters. We have heard that he is recovering nicely. 7. TREASURER'S REPORT Dennis Leary: (absent). From the Treasurer's e-mail, the Board's Bank of Marin checking account is $3,777.28. There are no outstanding payables or receivables. 8.,-The-JOHN STEWART COMPANY PROPERTY MANAGEMENT REPORT A - Linda Tilton, Director of Property Management, reported that: 1. an application has been sent to HUD regarding the Green Retrofit Program. We expect to have a response within a few weeks. 2. the waiting list is open and applications are available November 18, 19, and 20 at The Hilarita. This data has been submitted to The Ark Newspaper and the Independent Journal in Marin County. All completed applications are to be sent to JSC in San Francisco. Ms. Tilton answered Board member questions as to how applicants are selected, and the documentation requirements to be submitted with an application. 3. Charles Quick and Linda met with the Lancers, uphill neighbor of The Hilarita, regarding their request to reduce the height of the eucalyptus trees. New bids have been received based on recommenda- tions from the Buildings & Grounds Committee, and the costs are being analyzed. 4. the `going away party' for the CLC Coordinator Phuong Lam went very well. B - Cherry Reilly, Property Manager, reported that: 1. we are pleased with Michelle Valmont, Assistant Property Manager. She is an asset to the Management office. 2. the Residential Management software system, 'Boston Post', has been installed. 3. 48 low-flow toilets have been installed by Marin Municipal Water District at no charge. 4. the Reed and Del Mar schools are looking into recreation programs that The Hilarita children could take part in. 5. C. Ford, resident, has been helping with the children's play area on-site. 6. the annual holiday party for the residents is slated for December 17, 2009 at 5:30 P.M. B. Garcia-Romero, resident, is adding her efforts to this event. And, we invite the Directors of the H-TEA Board to join in the festivities. 9. ON-SITE COMMITTEE REPORT Meets foudh Thursday of the month at 600 PM or as needed. Committee: Anne Brown, -c. Nuria (bars„ Richard Leonards Anne Brown asked for clarification of the President's request to ascertain the correctness of the Grievance Procedure. President Lester asked that this document be scrutinized for its effectiveness should there be any submitted resident requests for assistance in complaint resolutions. Linda Tilton, JSC, explained the < 2 > steps that are available now to anyone with a grievance, In this order : Management, JSC, On-Site Committee, Marin County Arbitration. 10. BUILDINGS & GROUNDS COMMITTEE REPORT Meets the last Friday of the month at 7.30 AM or as needed Committee: Charles Quick-c, MaryAnn Alvarado„ Joyce Larsen, Dorothy Larson, Michael Peters Charles Quick (absent). Linda Tilton, JSC, reported that: 1. she and Charles Quick met with the Lancers who have requested removal of or trimming of trees that are blocking views. She read the Town ordinance relating to view obstructions. It is the Committee's recommendation that the eucalyptus trees in question be topped by 30%, and that four Blue Gum trees be removed and replaced with trees that are acceptable for the site. Following discussion on what type of trees and maintenance, it was: M/S/P (D. Larson/B. Garcia-Romero) that the Board approve the recommendations of the Buildings & Grounds Committee to top the eucalyptus trees and remove the Blue Gum trees and to plant replacement trees. 9 ayes 11. COMMUNITY TRAINING & SERVICES COMMITTEE REPORT-- CLC Meets the first Friday of the month at 6:00 PM or as needed. Committee: Barbara Garcia-Romero-c„ Dennis Leary Barbara Garcia-Romero reported that: 1. the H-TEA Computer Learning Center began this term's tutoring program on October 15 2009 with 30 hours a week with four tutors. It is going very well and Brian Meyer who replaced Phuong Lam as Coordinator is doing well. 2. the Committee submitted the Tutoring Program progress report to the Tamalpais Pacific Board of Trustees at its November 3, 2009 meeting. 12. FINANCE COMMITTEE REPORT - This report is pro notary and not to be discussed outside of this meeting Meets as needed. Committee: Dennis Leary-c, Dorothy Larson, Dennis Leary, Michael Peters Dennis Leary (absent): from an e-mail report of November 9, 2009: 1. the Accounts Receivable balance is up, are there any collection issues? 2. the landscape improvement costs are significantly lower than budget? 3. the costs for plumbing and water are over budget. 4. the Committee will re-examine the surplus cash item at the 6 month point to see if we project sufficient surplus that may allow some special projects in the back half of the year.
