On May 17, 2017, the Council held a special meeting as follows: CALL TO ORDER AND ROLL CALL Councilmember Doyle, Councilmember Fredericks, Councilmember Tollini, Vice Mayor O'Donnell, Mayor Fraser CLOSED SESSION 1) Conference with Legal Counsel —Anticipated Litigation Significant exposure to litigation pursuant to paragraph (2) of subdivision (d) of Section 54956.9: (One potential case) ADJOURNMENT—to reQulur meeting REGULAR MEETING—7:30 P.M. CALL TO ORDER Mayor Fraser called the regular meeting of the Tiburon Town Council to order at 7:30 p.m. on Wednesday, May 17, 2017, in Town Council Chambers, 1505 Tiburon Boulevard, Tiburon, California. ROLL CALL PRESENT: COUNCILMEMBERS: Doyle, Fraser, Fredericks, O'Donnell, Tollini PRESENT: EX OFFICIO: Town Manager Chanis, Town Attorney Stock, Director of Public Works/Town Engineer Barnes, Director of Community Development Anderson, Director of Administrative Services Bigall, Town Clerk Stefani ORAL COMMUNICATIONS There were none. PRESENTATION P-l. Presentation of Annual Arts Educator Award—Dana Lomax,Arts Educator,Del Mar Town Council Minutes 410-2017 May 17, 2017 Page I School (Heritage & Arts Commission) Daniel Amir, Heritage & Arts Commissioner, introduced Dana Lomax, award recipient. He gave a brief history of her background as a teacher and a poet, and said she was being honored for her ability to connect the work she does at school with the local and greater community. Ms. Lomax thanked the H&A for the award, and read two of her student's poems to the crowd. Vice Mayor O'Donnell said his son was taught by Dana Lomax, and commended her for being a great educator. Mayor Fraser said the Council is proud to have teachers like Dana Lomax,and said he is grateful for all she and her colleagues do for the community. INTERVIEWS FOR INTERIM VACANCIES ON TOWN COUNCIL (Tiburon Town Council —Two vacancies for interim appointment) Mayor Fraser said the Council would be interviewing 21 candidates over the course of three meetings for the two interim vacancies on the Town Council. He said tonight was the first meeting, and gave a brief outline of the interview format. The following individuals interviewed before the Town Council: • Jon Welner, 24 Juno Road • Jack Ryan, 757 Hawthorne Drive • David Kulik, 2310 Mar East Street • Daren Wein, 291 Cecilia Way • Angela McInerney, 60 Mount Tiburon Road CONSENT CALENDAR CC-1. Zoning Text Amendments—Adopt ordinance making various zoning text amendments relating to regulation of marijuana, including marijuana related-commercial activity and marijuana cultivation and delivery; Title IV, Chapter 16 of the Tiburon Municipal Code (Community Development Department) CC-2. Municipal Code Amendments—Adopt ordinance making various amendments relating to smoking and tobacco regulation-, Title VI,Chapter 28 of the Tiburon Municipal Code (Community Development Department) CC-3. Municipal Code Amendments — Adopt ordinance making various amendments to regulations regarding view and sunlight obstruction from trees; Title IV, Chapter 15 of the Tiburon Municipal Code (Community Development Department) Town Council Minutes #10-2017 May 17, 2017 Page 2 CC-4. Investment Summary — Adopt report for month ending March 31, 2017 (Director of Administrative Services Bigall) CC-5. Investment Summary — Adopt report for month ending April 30, 2017 (Director of Administrative Services Bigall) CC-6. Community Development Block Grant Cooperation Agreement—Adopt resolution authorizing the Mayor to execute a three-year Community Development Block Grant Cooperation Agreement with the County of Marin (Office of the Town Manager) CC-7. Local Town Boards and Commissions — Consider amendments to membership requirements for Town Council appointed Boards and Commissions(Office of the Town Manager) A member of the public, George Landau, requested Item No. CC-3 be removed for discussion. Motion: To adopt Consent Calendar Items 1-2, and 4-7, as written. Moved: Fredericks, seconded by Doyle VOTE: AYES: Unanimous CC-3. Municipal Code Amendments — Adopt ordinance making various amendments to regulations regarding view and sunlight obstruction from trees; Title IV, Chapter 15 of the Tiburon Municipal Code (Community Development Department) George Landau, Sugarloaf Drive, said he felt strongly that the definition of primary living areas be broadened in the ordinance and that the trees on land owned by the Town should not be exempt from the ordinance. Vice Mayor O'Donnell believed that the primary living area spaces were well defined in the ordinance because architecture is constantly evolving. He said he would not agree with further changes because this definition has suited the Town well in the past. O'Donnell agreed that perhaps Town-owned trees should be included in the ordinance, if they were blocking someone's view. Councilmember Fredericks asked if there was recourse for an individual's view was blocked by a Town-owned tree. Director of Community Development Anderson said there was, and in fact, the Parks, Open Space and Trails Commission is reviewing requests currently. Mayor Fraser asked if the recourse was complaint-based,or if the Town maintains the trees.Director of Public Works Barnes said Public Works trims trees to maintain the health of the tree and for safety, but trimming for view purposes is complaint-based. He said trees in parks are valued for aesthetic purposes. He further clarified that there was an application process in place if an individual Town Council Minutes#10-2017 May 17, 2017 Page 3 wishes to submit their request for consideration. Motion: To adopt Consent Calendar Item No. 3, as written. Moved: O'Donnell, seconded by Fredericks VOTE: AYES: Unanimous PUBLIC HEARINGS PH-1. Subdivision Ordinance — Consider repeal of current Subdivision Ordinance and adoption of comprehensively updated regulations—Introduction and first reading of ordinance Director of Community Development Anderson said the current ordinance was adopted in 1993,and has not been updated since. He said that while the ordinance has served the Town well,it is in need of an update to reflect changes in state laws and to more accurately reflect Town policies and standards. He said some articles within are tailored specifically to the Town of Tiburon. He said this ordinance is an important element of municipal land use, but the general public seldom refers to it. Mayor Fraser opened the floor for public comment. There was none. Motion: To introduce the ordinance and read by title only, waiving further reading, schedule for adoption at the next regular meeting and motion to hold a roll call vote on the introduction of the ordinance, as written. Moved: Tollini, Fredericks VOTE: AYES: Unanimous Mayor Fraser read"An Ordinance of the Town Council of the Town of Tiburon Repealing Municipal Code Title IV, Chapter 14 (Subdivision of Land) and Adopting a New Title IV, Chapter 14 (Subdivision of Land) of the Tiburon Municipal Code". ROLL CALL VOTE: AYES: Doyle, Fraser, Fredericks, O'Donnell, Tollini ACTION ITEMS AI-1. Recognition of Departing Town Councilmember Frank Doyle—On the occasion of his final Council meeting,the Council is invited to share their thoughts with Councilmember Doyle, and Councilmember Doyle is invited to share his comments as well (Mayor Fraser) Mayor Fraser said Councilmember Doyle had a great sense of humor, and he brought a sense of reality, pragmatism and laughter to Council meetings. He said the Doyle family had made great contributions to Tiburon, and the Town is lucky to have had him. He thanked him for all he has done for Tiburon. Town Council Minutes #10-2017 May 17, 2017 Page 4 Councilmember Fredericks said Doyle brought good-sense to the Council, and acknowledged him for his service to the Town and the Council. She thanked him for his contributions and his creativity. Councilmember Tollim said she had greatly enjoyed her time serving on the Town Council alongside Doyle. She said he had contributed creativity,common sense and a great sense of humor to projects and meetings. Vice Mayor O'Donnell said Doyle has a creative genius,and recalled their years of service together on various Town boards, commissions, and the Council. He said Doyle has a talent for facilitating compromise, and brought energy and humor to meetings. He said the departure of the Doyle family was a great loss for Tiburon. Councilmember Doyle thanked the Town staff and his fellow Councilmembers for their patience, dedication,intelligence,and friendship. He also acknowledged his wife,Leslie,for her dedication to the community. TOWN COUNCIL REPORTS There were none. TOWN MANAGER REPORT There was none. WEEKLY DIGESTS Received.
