BACKGROUND Earlier this month, the Martha Company submitted modified application materials with the County of Marin in an attempt to respond to County direction provided earlier in the process, primarily involving the water tank elevation and location, resulting water/fire flow pressure issues, and biological resource mitigations. The revised materials request certification of the final EIR and decisions on the applications for rezoning and Master Plan approval, while postponing decisions on the Precise Development Plan and Vesting Tentative Map applications until a future time. A summary of the project revisions is set forth in the attached letter dated June 6, 2017 from Scott Hochstrasser, and in the attached modified project description prepared by County staff. The modified site plan (attached) still shows 43 lots, but they have been reconfigured somewhat. Also attached for comparison purposes is the original 43-lot plan analyzed in the Easton Point project EIR. A brief comparison of the two 43-lot plans appears to show the following principal changes: ➢ The modified plan shows a MERA antenna pad located near the proposed water tank site, which does not appear to have changed from the original plan. The water tank site is still shown at the highest elevation of the Martha Company property adjacent to the Old St. Hilary Open Space ridge-top. ➢ The two development clusters nearest Hill Haven subdivision (Lots 1 through 3 and Lots 4 through 6) have been eliminated or relocated, most likely for biological resource mitigation for Marin Dwarf Flax and serpentine bunchgrass impacts. No lots are now proposed at the end of Mountain View Drive and there is a wider separation between Hill Haven and the first lots proposed along the extension of Ridge Road. Proposed open space Parcel B (dwarf flax area) has been increased from 0.33 acres to 5.86 acres, also to the benefit of the special status plant species. ➢ The development cluster created by Lots 7 through 9, 20, 24, and 35 through 43 on the original plan (the upper ridge lots) has been reconfigured, reduced from 14 to 12 lots, and many of the lots moved below the ridgeline. These changes are almost certainly to address water pressure and fire flow concerns. Town of Tiburon MEMORANDUM . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . ➢ Ridge Road has been extended further down the so-called "nose" portion of the site and the number of lots on the nose increased from 10 on the original plan (lots 10 through 19) to 15 on the modified plan (lots 11 through 25). ➢ One lot has been added to the development cluster near Paradise Drive (Lots 21 through 23 on the original plan and Lots 40 through 43 on the modified plan). ➢ The 1 Not Forest Glen Court development cluster(lots 25 through 34 on the original plan) has been increased to 12 lots on the modified plan (Lots 28 through 39). ➢ The central open space parcel (Parcel A) has increased in area from approximately 60 acres to 69 acres. ➢ The temporary construction road concept remains intact. Master Plan (MP09-2), Precise Development Plan (DP09-4), Tentative Subdivision Map (SD09-1), Rezoning—Easton Point Modified Project Master Plan Submission 2017 Dear Curtis, As you know, at its March 11, 2014 meeting, the County Board of Supervisors voted not to certify the project EIR for the Easton Point Residential Development. At the time the Board found that project feasibility and project compliance with mitigation measures set forth in the Final EIR were not demonstrated to their satisfaction. Specifically the Board found that there were too many uncertainties, and that the Board needed a more specific project proposal before the Board would certify the EIR. As you know, the Martha Company as the project sponsor disagreed with that decision. Following a motion in federal court, the court directed the Martha Company and the County to agree to deadlines to achieve a final decision on the EIR for the proposed project. Those deadlines have been extended several times to facilitate discussions between County staff and the Martha Company's development team. The purpose of this letter is to transmit for County review and Board consideration a revised project plan, which has been developed by the Martha Company and its development team over the past 3 years, in consultation with County staff and in response to County comments. In Mr. Roberto's March 14, 2014 letter following the Board meeting, he noted that County staff needs to know how the applicant intends to proceed through the merits phase of the project review. This point has been discussed extensively by County staff and the Martha Company development team. After considerable additional work and discussions about project design,the client's project development team has developed a revised project plan for merits review. Additionally, in order to move the application process ahead and provide the project sponsor with assurances of a fair decision on the merits of the Master Plan, and before spending additional large sums of money to complete all of the "Precise Development Plan" details and the"Vesting Tentative Map"details, the project sponsor is seeking a phasing of the application process as follows. PHASE I—Final EIR Certification, Rezoning and Master Plan Merits Action At this time the project sponsor has elected to seek a first phase of approvals, including certification of the Final EIR, and a decision on the rezoning of the property and the merits of the modified Easton Point Master Plan, all to comply with the Court judgments governing this project. 1 This submission includes a modified site plan with a revised lot layout, roads, grading and utility plan. The package includes a modified landscape plan. Additionally, a project biological analysis of the modified plan is provided to demonstrate how the modified Easton Point Master Plan(MMP) will provide feasible mitigation in accordance with the EIR mitigation measures. Finally an updated review of the geology including an assessment of the modified site plan is also provided. Other than the general items noted above and listed specifically below; all of the remaining project information used by the County of Marin Community Development Agency to find the application"complete" for processing and used by the independent EIR Consultant(Nichols-Berman) to prepare the draft and Final "2008 Easton Point Residential Development EIR" are not changed and continue to inform the plan merits review process (See Page 6, 7 and 8 of the"2008 Easton Point Residential Development Draft EIR" for a comprehensive list of documents submitted previously.) Plan Modifications and Study Documents—Easton Point Modified Master Plan 1. "Easton Point Subdivision" prepared by Tiburon Fire Protection District, dated August 29,2014 (1 page) (10 hard copies each and one digital copy provided) PHASE II Precise Development Plan and Vesting Tentative Subdivision Map Once the Final EIR is certified, and the Rezoning and Master Plan are decided in Phase I of this process, the proposed Precise Development Plan and the Vesting Tentative Subdivision Map will be submitted for a following action. EASTON POINT MODIFIED MASTER PLAN—RESPONSE TO BOARD QUESTIONS As stated above, the modified Easton Point Master Plan (MMP)has been developed by the project sponsor and their development team over the past 3 years. The objective of the MMP is to provide the information requested by John Roberto, county contract planner, in his March 14, 2014 letter following the Marin County Board of Supervisors meeting, and the Board's concerns as described in that letter. a 2 I { Water Tank Elevation—Domestic Residential Service and Fire Flow In Mr. Roberto's letter, he states that the"Board found that there were too many unknowns regarding the final elevation of the proposed water tank" and that the final elevation of the tank has a direct impact on residential domestic water pressure and fire flow. Secondly, he notes that the Board noted that the mitigation to raise the water tank to elevation 590 which resolves the majority of the residential water and fire flow issues has not been designed,reviewed and approved by MMWD and although he has had several conversations with MMWD they have not approved (nor have they denied) the 590 elevation for a new water tank. Mr. Roberto's letter does go on to say that at 590 elevation the water tank is a"safety issue" for four reasons as follows: 1. The tank would be higher than the highest elevation on the project site, and 2. The tank would be located on a steep slope, and 3. The entire site is a seismically active area and could experience server ground shaking, and 4. The tank must cut into bedrock and the"the Board is not aware of any water tank in the MMWD system that is not cut into bedrock on sloping lands." Accordingly, the modified project site plan now includes a proposal to locate the water tank site at the 570 foot elevation. In response to the issues raised above; 1. The MMP lowers the tank elevation by 20 feet. 2. The MMP 570 tank elevation will be cut into the hillside and not on a steep slope. 3. The 570 elevation site for the water tank has been assessed in earlier geologic analysis. 4. When dropping the water tank to the 570 elevation the tank is at grade with a out into the uphill and into bedrock. Mr. Roberto's letter also noted the Board's concern that the 570 water tank elevation would not provide needed fire flow and domestic water pressure to serve the lots. The MMP includes modifications to the project road location and lot locations thereby allowing fire hydrants to be located to serve the subdivision with the fire flow and water pressure standards required by the Tiburon Fire Protection District as memorialized in their August 29,2014 letter to Michael Tarnoff, project engineer. The MMP has been transmitted to the MMWD for additional review and comment. Once they have confirmed that the project meets the required minimum standards for fire flow and pressure, MMWD's calculations and the MMP will be transmitted to Tiburon Fire Protection District for their additional review and comment. Receipt of the MMWD's comments is pending. Regarding domestic water pressure, in conversations with the MMWD it is apparent that the District has granted low pressure water service agreements for existing and newly created lots in the immediate area. The District continues to grant such agreements and it is expected that the District will continue their policy and practice and grant the Easton Point project low pressure water service agreements. Finally, although having fire flow is a safety issue, low pressure domestic water service for homes has not been identified by MMWD and/or the County and their independent consultants as a "safety issue". 3 Biological Resource Mitigation—Modified Easton Point Master Plan is a Feasible Project Alternative Mr. Roberto's March 14,2014 letter stated that the project as previously proposed did not fully avoid or mitigate impacts on special status plants and the red legged frog dispersal habitat. The EIR includes a mitigation measure that calls for relocation or removal of some of the lots as they are currently configured. The Board found that the project sponsors had not demonstrated to the County the feasibility of implementing Final EIR recommended mitigation measures. This is noted in the letter even though the Draft EIR contains a mitigated project alternative that shows it is feasible to locate 43 lots on the property and avoid or mitigate the impacts on federal protected species, (See Page 699 Exhibit 6.0-42 Alternative 44— Biological Resources Alternative). However, in the continued spirit of cooperation the project sponsor and the development team have prepared a MMP that demonstrates compliance with all of the Biological Resource mitigation measures contained in the Final EIR as follows: Mitigation Measure 5.6-1 Special--statzrs Plants Based on the MMP the lot layouts and landscape plan avoid all direct impacts on the Marin dwarf flax. And serpentine reed grass and other serpentine reed grass populations are in open space. (See the LSA report and maps dated June 1,2017—attached herewith.) Mitigation Measure 5.6-2 a & b) California Reel-Legged Frog(CRLF) Measure 5.6-2a provides an option to mitigate (rather than removing or substantially moving lots in the Forest Glen area) through creating a wetland habitat-on-site, or enhancement of the existing wetland near the top of Drainage way 42, such that these wetland habitats function as on-site breeding habitat for CRLF. This option is feasible as noted in the LSA report. Secondly, a 3:1 preservation ratio is specified in MM5.6-2b and the MMP provides a 3.66:1 direct ratio. (See the LSA report Table A attached herewith. Mitigation Measure 5.6-3 Serpentine funchgrass MM5.6-3 specifies a 3:1 preservation, the modified plan provides for a preservation ratio of 4.1:1. (See LSA Figure#1 attached herewith) Mitigation Measure 5.6-4 Coast Live Oak Woodland The MMP is similar to the original plan studies in the Final EIR and as noted in the draft and final EIR preservation can be achieved by construction management. Mitigation Measure 5.6-5 Disturbance to Jurisdiction Waters The MMP now shows no loss/impact to waters of the US as identified in the EIR. The MMP establishes 100 foot setbacks from all wetlands and drainages and also allows for "compensatory mitigation" for permanent and temporary encroachments. In summary the MMP avoids all direct impacts to the Marin dwarf flax and serpentine reed grasses and exceeds the EIR mitigation requirement for a minimum of 3:1 preservation impact ratio, exceeds the 3:1 preservation to impact ratio for overall serpentine bunchgrass community and complies with the mitigation measures for the CRLF. 4 Merits of the Modified Easton Point Master Plan Finally, it should also be noted that the MMP has been submitted as a revised project that demonstrates feasibility of the EIR mitigation measures. The level of specific design details is sufficient to demonstrate mitigation feasibility. The objective of the submittal is to secure certification of the Final EIR and approval of the Rezoning and Master Plan applications at this time, in accordance with the Court judgments. Once the EIR is certified and the Rezoning and Master Plan are approved, then further information will be provided so that the County can proceed to consider a Precise Development Plan and Tentative Map approval, also in accordance with the Court judgments. Summary & Conclusion- Modified Easton Point Master Plan The Modified Easton Point Master Plan project focuses on addressing the key issues the Board of Supervisors raised at their hearing on March 11, 2014 and specifically noted in Mr. Roberto's March 14, 2014 letter. Accordingly,the plan modifications address water service issues, lot layouts and biological impact mitigation measure feasibility. In conclusion, the water tank design uncertainties have now been worked out to the satisfaction of the MM)VD and the Tiburon Fire Protection District policies, standards and practices. The biological mitigation measures are all satisfied in compliance with the findings of the draft and final EIR. Accordingly,the Martha Company now seeks timely certification of the EIR and approval of the rezoning and master plan, in accordance with the Court judgments and the Martha Company's rights under those judgments. On June 6, 2017 the Martha Company submitted a modified project Master Plan and other technical documents for County of Marin review and Board of Supervisors consideration.The applicant's submittal letter states that the modified project provides an alternative master plan layout that addresses the key issues the Board of Supervisors raised at their March 11, 2014 hearing to consider certification of the Final EIR. The submission includes a modified site plan,with a revised lot layout, modified road alignments, and a preliminary grading and utility plan.The submittal package also includes a modified landscape plan,a biological analysis of the modified site plan,and an updated geology report that includes an assessment of the modified site plan. Other than the modifications included in the June 6, 2017 submittal all the remaining project information remaining on file and used by the Marin CDA to deem the Original Application Complete for processing remain unchanged. In addition, two open space parcels(Parcel A-68.89 acres and Parcel B- 5.86 acres)would be offered for dedication to the Marin County Open Space District. Parcel B is proposed as a Marin dwarf flax (a special status plant species)preserve.The modified site plan also proposes a 180,000- gallon concrete water tank that would be constructed on Parcel C(0.36 acres)at the 570 foot elevation and a small adjacent parcel for the possible construction of a MERA radio communication site. A common driveway would provide access to the water tank and MERA parcels. The modified site plan proposes to construct roads and utilities to serve each of the 43 reconfigured residential lots.The modified site plan still includes a construction access road that would be used for all phases of project construction, including future home construction. The construction road would link the upper portion of the project site to Paradise Drive in the vicinity of the driveway now serving the existing Marin Municipal Water District storage tank site within the Easton Point project site. Residential lots on the modified site plan would range in size from 0.5-to 1.67 acres.The 43- lot project has a gross density of one housing unit per 2.55 acres considering the entire 110- acre site area. Each residential lot includes a designated building site.The building site would include each lot's residence. Conceptual building footprints are shown for each building site; footprint locations are illustrative only, provided to demonstrate that buildings of the proposed size would fit within the proposed building site for each lot. In addition all future development, including patios, pools, gardening sheds, etc.,would be contained within the designated building site. Houses are still proposed to range in size from 5,000 square feet to 8,750 square feet.The building footprints range in size from 2,500 square feet to 4,050 square feet. Each residential lot would be provided with a minimum of four off-street parking spaces,two of which would be in a garage. A public pedestrian access easement is proposed along a portion of Ridge Road, up to Tam View Court, and along Tam View Court to provide access from the Hill Haven neighborhood to the existing adjacent public open space(Old St. Hilary's Open Space Preserve and the Tiburon Uplands Nature Preserve).The proposed access easement would also provide access to Parcel A. Site grading is intended to prepare the project site for residential development by installing roadways and utilities and repairing landslides and unstable areas.All proposed roadways serving the residential lots now comply with the standards contained in the Marin County Development Code.Therefore the applicant is no longer requesting an exception to Marin County's road improvements standards.
