P~SOLUTION NO. 260
A RESOLUTION OF THE CITY OF TIBURON REGARDING ACQUISITION
AND CONDEHNATION OF PROPERTY FOR PUBLIC PARK AND PATH AND
ROAD PURPOSES.
BE IT RESOLVED by the eity eouncil of the eity of Tiburon that it
finds and hereby declares that:
1. Public interest and necessity require the acquisition,
purchase and taking of those certain lands described
in Exhibit "AIt, attached hereto and incorporated berein
by reference, for public park, path and road purposes;
2. The use of all of said property for eity purposes is a
public use authorized by law;
3. The taking of said lands is necessary to such public use
and it is necessary that all of said lands be so taken;
and
4. The proposed public park, path and trail use is planned
and located in a manner which ~.1ill be most compatible
~dth the greatest public good and the least private
injury.
BE IT FURTHER RESOLVED that it is necessary that said City acquire
title in fee simple, or easement, to the land described for said public purposes,
subject only to existing easements and rights-of-way for public streets, gas lines,
sanitary and storm drain sewers, telephone and electric lines, and similar public
uses not inconsistent with the purposes of the City hereinabove described.
BE IT FURTIIER RESOLVED that said City acquire title to the herein
described land for said public purposes by donation, purchase or condemnation;
Richard A. elarke, special counsel for said eity, is hereby authorized and
directed to initiate and prosecute in the name of said eity, condemnation pro-
ceedings for the acquisition of title to said property or any part thereof.
PASSED AND ADOPTED at a regular meeting of the City Council of the
eity of Tiburon on the ~ day of September
