WHEREAS, the City of Tiburon has previously submitted to the Division of Highways, State of California, a request for deviation authorization for Project No. I, as amended; and WHEREAS, the Division of Highways, District 4, by letter of February 24, 1965, rejected the appl ication on the grounds that the City has not furnished sufficient additional information supporting justification of the sub-standard 36-foot wise, two-lane street; and WHEREAS, it now appears that the City can remove these objections by means of certain findings and commitments, NOW THEREFORE BE IT RESOLVED AS FOllOWS: That the Council of the City of Tiburon finds that the mountainous terrain which is characteristic of most of the city is particularly pronounced at the point of the proposed improvement and that to provide wider rights-of- way and standard width pavement would be not only unreal istical Iy expensive, and therefore extravagant in the use of gas tax funds, but would also do great harm and mischief to the entire city by reason of causing extensive and unsightly hi I Iside cuts; AND BE IT FURTHER RESOLVED, that the Counci I of the City of Tiburon finds that the specifications of the Project I appl ication, as amended, represent not only the maximum width and characteristics which would be compatiable with the enviornment of the community, but also that they wi I I be adequate to provide for al I foreseeable future traffic, particularly as other feeder roads are opened up pursuant to the approved SELECT CITY STREET SYSTEM; AND BE IT FURTHER RESOLVED, that the Counci I of the City of Tiburon does agree that upon completion of the proposed improvement of Porto Marino Drive it wit I prohibit parking on one side of the street, to be determined by the City Engineer, in order that two ful I twelve-foot wide lanes may be maintained at al I times, if and when the project is accepted and approved by the Division of Highways for matching credits.
