RESOLUTION NO.
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TIBURON DECLARING ITS INTENTION TO VACATE A
PORTION OF AN AREA OFFERED FOR DEDICATION AS
A PUBLIC STREET

WHEREAS, the map entitled "Map of the Reedlands", Unit
1" was recorded on February 23, 1956 in volume 9 of Maps at
page 17 in the Office of the County Recorder of the County of
Marin, state of California, and
WHEREAS, there is shown on said Map at the entrance
to said subdivision, a parcel of land labelled "Parcel B",
and
WHEREAS, said Map did offer for dedication for public
use as a public street or highway said Parcel B, and
WHEREAS, the Board of Supervisors of the county of
Marin in approving said map for recordation did reject the
offer of dedication of said parcel B, except for the souther-
ly ten feet parallel and adjacent to the course South 59040'30"
West 255.00 feet thereof, and
WHEREAS, pursuant to the provisions of the Subdivision
Map Act of the state of California said offer of dedication
has remained open for subsequent acceptance even as to the
portion of said Parcel B, the dedication of which was rejected
by said Board of Supervisors, and
WHEREAS, Section 11616 of the Bus"i-ne'ss ard;:PtOfessi."s
code of the State of california provides that said offer of
dedication as to the remaining portion of parcel B may be
terminated and abandoned in accordance with the provisions
of Part 3, Division 9 of the Streets and Highways Code, and
WHEREAS, it appears that it may be in the public inter-
est to terminate and abandon the right to accept said offer of
dedication of the remaining portion of said parcel B,
NOW, THEREFORE, IT IS HEREBY RESOLVED, ORDERED AND
DECLARED as follows:
1. This resolution is adopted, and the proceedings
hereunder are taken, pursuant to the provisions of Part 3,
Division 9 of the Streets and Highways Code of the state of
California.
2. The city Council of the city of Tiburon does here-
by declare its intention to vacate, terminate and abandon
the right to accept the offer of dedication for public street
or highway purposes of the following described real property:
Parcel B, as shown on that certain map entitled,
"Map of the Reedlands, Unit 1" recorded on Feb-
ruary 23, 1956 in Volume 9 of Maps at Page 17 in
the Office of the County Recorder of the county
of Marin, excepting therefrom, however, that por-
tion of said Parcel B which constitutes the South-
erly ten feet thereof parallel and adjacent to
the course South 59040'30" West 255.00 feet.
3. Reference is hereby made to a map or plan on file
in the Office of the City Clerk of the city of Tiburon for
particulars as to the proposed vacation, termination and
abandonment of said right to accept said Offer of Dedication.
4. Monday, the _____ day of
, 1965 at 8:00
o'clock p.m. of said day, or as soon thereafter as the matter
may be heard, in the library room at Del Mar School, Tiburon,
California, be, and the same are hereby fixed as the time and
place for hearing all persons interested in, or objecting to
said proposed vacation.
5. The City Clerk is hereby authorized and directed
to cause a copy of this Resolution to be published once
within fifteen (15) days after its adoption in the Ebb Tide,
a newspaper of general circulation printed and published in
the City of Tiburon. The City Clerk is further authorized
and directed to cause notices of said proposed vacation,
termination and abandonment and of the hearing fixed herein
