HomeMy WebLinkAboutTC Res 1971-03-22 (3) RESOLUTION NO. ~ A RESOLUTION OF THE CITY COUNCIL OF tHE CITY OF TI1URON CLOSING LOWER RACOON LANE TO MOTORIZED VEHICULAR TRAFFIC WHEREAS, the public has historicnlly used Lower Racoon Lane as a pedes- trian passageway; and WHER&\S, the public has for many years last past acquired easements for public pedestrian trave~ o~~r said lane; and WHEREAS, motorized vehicular traffic is nO~11 interfering ~;7ith said foot traffic. and is considered a nuisance to surrounding residents; and WHEREAS, the majority of persons who own property adjacent to Lower Racoon Lane have requested the City close said Lane to motorized vehicular traffic; and WHER&\S, said persons have offered to quitclaim to the City and right, title and interest they may have in the underlying fee title in Racoon lane; and WHEREAS, the City of Tiburon is willing to accept said offers to quit- claim. NOW, THEREFORE, ~~ IT RESOLVED: I. Except as otherwise set forth herein, Lower Racoon is hereby de- clared closed to all motorized vehicular traffic and the City Manager is directed to take such action as may be deemed appropriate to effectuate this resolution. 2. Limited vehicular traffic shall be allowed between Centro west Street and the upper portion of the property and improvements located thereon, commonly known as lS00 Centro West Street, Tiburon. 3. The City Manager shall secure such quitclaim deeds as are avail- able for whatever interest the adjacent owners may have or claim, in the under- lying fee to Lower Racoon Lane.
