RESOLUTION NO'-11l
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TIBURON DECLARING STRUCTURE AT
NO. 6 ROLLING HILLS ROAD TO BE A NUISANCE
AND DIRECTING ABATEMENT.
WHEREAS, a residence has been, or is being, constructed at
No. 6 Rolling Hills Road in the City of Tiburon; and
WHEREAS, it was contended that said structure violated certain
regulations contained in Ordinance No.9 N.S., the Tiburon Zoning
Ordinance; and,
WHEREAS, pursuant to the provisions of Chapter 24 of the Code
of the City of Tiburon, an Order to Show Cause re abatement of
said nuisance was duly served on the owner of said real property;
and,
WHEREAS, a hearing on said Order to Show Cause was duly held
on November 23, 1970, before the Tiburon City Council; and,
WHEREAS, evidence and testimony was introduced before the
City Council at said hearing and duly considered by it; and,
WHEREAS, the hearing was then continued to November 30, and
Dece~ber 14, 1970.
NOW, THEREFORE, BE IT RESOLVED as follows:
After duly considering the evidence introduced at the hearing,
1. The City Council hereby finds that the residence at No.6
Rolling Hills Road was constructed in violation of Section
10-3-B and lO-3(C)6 of the Tiburon Zoning Ordinance, which
said regulations provides that the maximum building height
shall be 1/30 feet; 2-1/2 stories."
2. The City Council further finds that as the result of said
violation, the said structure constitutes a nuisance within
the meaning of Section 27D of the Tiburon Zoning Ordinance.
3. As the owner of the property has represented he is under-
taking actions to abate the nuisance.
4. Staff is directed to determine and report back to the
council within 30 days whether:
(a) the grade has been modified by construction of retaining
walls, and
(b) whether the owner has taken appropriate steps toward
landscaping around the house to screen the mass of
the building.
PASSED AND ADOPTED at a regular meeting of the City Council of
the City of Tiburon held on December 14, 1970 by the following vote:
