RESOLUTION NO. 325 A
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TIBURON APPROVING THE
TENTATIVE HAP OF MOUNT TIBURON,
UNITS 31 4, AND 5.
WHEREAS, MR. IRVING V. MOULIN, owner, has applied for approval
of a Tentative Subdivision Map for Hount Tiburon Un~8 3. 4~ and S; and
WHEREAS, said map has been reviewed by the Board of Design Review
and the Planning Commission in terms of the Policy Statement adopted
by the City Council on August 10, 1970, and has bee~,~ound to be in
accordance wi th tbose policies; and '
WHEREAS, said map has been compared with the Subdivision Ordinance
requirements.
NOW..... THEREFORE, BE IT RESOL VEn:
THAT, this Council does hereby approve the Tentative
Map for Hount Tiburon Units 3, 4, and 5, consisting of 4 sheets as re-
vised on October 23, 197P, subject to the following conditions and
stipulations:
1. Building setback lines shall be as indicated on the Tentative Hap
with tbe following exceptions:
Lots 14-27 Front Yard, garage: 0'
'Front Yard, house: In view of tbe steepness of
the road, the front setback shall be 5 feet. Upon
a showing of exceptional circumstances, tbe Desig~
Review Board can permit a 0 ft. front setback. Where
parking spaces are situated between the street and
the house, the front setback shall be 25 feet from
the curb.
Sideyard, garage and house: Total of both sideyards
must equal at least 30 feet (30')
Rear Yard: 25'
2. Alternate Parking and Driveway Study "B" shall be utilized for
development of Lots 14-27.
1. Prior to approval of final maps for Units 4 and 5, appropriate
agreements shall be made between the developer and Marin Municipa~
Water District for dedication of the roadway and pedestrian acceS8
as shown.
4. The walkway treatment along tbe through road shall be continuous,
of consistent material, and visually separated from the traveled
right-of-way and driveways.
5. The required parks and recreation in-lieu fees shall be waived by
virtue of the construction of public stairs and public pathways
in the wilderness area and view point park.
6. The on-street parking on the upper street as shown on Plat 2 of
the Tentative Map shall be removed.
