RESOLUTION NO. 303
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
DIRECTING REMOVAL OF POLES AND OVERHEAD WIRES AND ASSOCIATED
OVERHEAD STRUCTURES ON CERTAIN STREETS, AND THE REPLACEMENT
THEREOF UNDERGROUND.
WHEREAS, the City Council of the City of Tiburon has adopted
Ordinance No. 41 N.S., amending Chapter 12, Title III, of the Tiburon
City Code; and
WHEREAS, Section 12-2 of said Code requires that the City call
public hearings to ascertain whether the public necessity, health,
safety or welfare requires the removal of poles, overhead wires and
associated overhead structures and the underground installation there-
of; and
WHEREAS, on June 22, 1970, such a public hearing was held pur-
suant to the provisions of Chapter 12 of the City Code, and the CitR
Council did find that:
1. The public necessity, health, safety and welfare requires
the removal a~d underground installation of poles, overhead wires, a~d
associated overhead structures within that area of the City hereinafter
described, which is a portion of an Underground Utility District herein_
before created.
2. Said removal is warranted in that such undergroundiug wiil
avoid or eliminate an unusually heavy concentration of overhead distri-
bution facilities; in that the streets where such overhead facilities
are located are extensively used by the general public and carry a
heavy volume of pedestrian and vehicular traffic; and in that the said
streets adjoin and pass through a civic area of unusual scenic interest
to the general public.
WHEREAS, the City Council has been advised by Pacific Gas and
Electric Company that it would not be possible to complete under-
grounding of 50% of the Underground Utility District hereinbefore
created by July 26, 1970, but that undergrounding of 70% of the said
District by January 26, 1971, can be achieved.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Tiburon orders the removal of all poles, overhead wires and asso-
ciated overhead structures within that area described in Exhibit A.
BE IT FURTHER RESOLVED that all of said poles, overhead wires,
and associated overhead structures within said area shall be removed
and placed underground no later than January 26, 1971, and that all
affected property owners must be ready to receive underground service
no later than January 1, 1971, subject to the provisions of Chapter 12
of the City Code.
PASSED AND ADOPTED at a regular meeting of the City Council of
the City of Tiburon held on July 13, 1970, by the following vote:
