A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON VACATING, TERMINATING AND ABANDONING THE RIGHT TO ACCEPT THE OFFER OF DEDICATION OF CERTAIN PROPERTY FOR PUBLIC UTILITIES EASEMENT. WHEREAS: the "Mip of Del Miramar" was recorded on August IS, 1962 in Book 11 of Maps, at Page 33, Mirin County Records, and WHEREAS: the hereafter described property was offered for dedication by the subdivider as a public utilities easement, and WHEREAS: the Board of Supervisors of the County of Marin rejected the offer of dedication, and WHEREAS: the City of Tiburon, upon its incorporation, succeeded to the rights of the County of Marin under said offer of dedication, and WHEREAS: the owner of the property in question, Fidelity Savings and Loan Association, has requested the City to vacate, terminate and abandon its right to accept said offer of dedication, and WHEREAS: the City Council of the City of Tiburon desires to vacate, terminate and abandon its right to accept the offer of dedication; NOW, THEREFORE, BE IT RESOLVED, ORDERED AND DEClARED as follows: I. The City Council of the City of Tiburon does hereby find that the property hereafter more particularly described is unnecessary for present or prospective public utility purposes; 2. That the City of Tiburon does hereby vacate, terminate and abandon the right to accept the offer of dedication for public utility easement purposes of the following described real property: Beginning at a point on the northeast line of that certain parcel of land described in the deed from ~rren L. Bostick, et ux, recorded October 2, 1958 in Book 1222 of Official Records, at Eage 459, said point being the most easterly corner of Lot 25, as said lot is shown upon that certain map entitled, "Mip of ful Mirattar, in the County of Mlrin, California ", recorded August IS, 1962 in Book II of Mips, at !age 33, thence running along said northeasterly and southeasterly line of the Bostick parcel, south 390 00' east 175.708 feet to the most easterly corner thereof, and south 660 06' west 434.856 feet to a point, said point being the most southerly corner of Lot 28, as said lot is shown upon the above- mentioned map; thence along t~e easterly line of Lots 26 and 28, as shown upon said map, north llo II' 50" West 162.534 feet; north 90 03' east 67.0 feet and north 830 02' west 81.439 feet to a point on Wilkins Court; thence along the easterly line of Wilkins Court on a curve to the left, having a radius of 46.0 feet, through a central angle of 530 20' for a distance of 42.819 feet to the southwest corner of the above- mentioned Lot 25; thence along the southerly line of said lot, South 620 30' east 97.380 feet and north 830 33' east 263.789 feet to the point of beginning.
