HomeMy WebLinkAboutTC Res 1970-04-16 RESOLUTION NO. 284 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON CALLING FOR AND ORDERING A RECOUNT OF BALLOTS. WHEREAS, Alvin R. Kuhn, a candidate for this City Council in the Municipal Election of April 14, 1970, did, pursuant to provisions of the Elections Code of the State of California file with the City Clerk a declaration alleging that because of mistake or error, the votes in Precincts 1, 2, and 3 were so incorrectly counted that the returns do not correctly show which candidate received the plurality of the votes cast for the office in those precincts; and WHEREAS, said Elections Code requires that, upon the filing of such a declaration, the votes cast in said election must thereupon be totally recounted; and WHEREAS, the City Council must itself publicly recount the ballots or, in the alternative, cause the recount to be made by a special recounting board consisting of not less than four voters of the city to be appointed by the governing body and to act under the supervision of the City Clerk; and WHEREAS, this City Council intends that the recounting shall be performed by a special recounting board; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: THAT the recount of the vote in the Municipal Election in the City of Tiburon on April 14, 1970, shall proceed as early and as expeditiously as possible; and THAT for the purposes of recounting, a special recount- ing board is hereby appointed composed of: Vivienne Winblad Alice Oldag Mary Estudillo Elizabeth Talbot PASSED AND ADOPTED at a special meeting of the City Council of the City of Tiburon on the 16th day of April, 1970, by the following vote: AYES: COUNCILMEN: Ellinwood, Rice, Fanning NOES: COUNCILMEN: None ABSTAIN: COUNCILMEN: None ABSENT: COUNCILMEN: Bremer, Drohan //f f.
