RESOLUTION NO. 281
A RESOLUTION GRANTING CONSENT OF THE cITt COUNCIL OF
THE CITY OF TmURON TO THE SANITARY BOARD OF SANITARY
DISTRICT NO ~ 2 OF MARIN COUNTY TO UNDERTAKE PROCEEDINGS
TO ACQUIRE AND CONSTRUCT PUBLIC IMPROVEMENTS AND TO
PROVIDE THAT THE COSTS SHALL BE ASSESSED ON THE DISTRIQT
BENEFITED UNDER APPROPRIATE SPECIAL ASSESSMENT AND .
ASSESSMENT BOND PROCEEDINGS
ANTONETTE DRIVE SEWER ASSESSMENT DISTRICT
RESOLVED, by the City Council of the City of Tiburon, qalif-
ornia, that
WHEREAS, the Sanitary Board of Sanitary District No.2 .of
Marin County has filed with this Council a certified copy of its
resolution requesting consent of this Council to undertake ap~o-
priate special assessment and assessment bond proceedings for the
acquisition and construction of public improvements and to assess
the cost thereof on the lands described in said Resolution;
WHEREAS, said work will be done in streets, highways and
public places in said City over which this Council has jurisdiction;
WHEREAS, said acquisitions and improvements to be made are
of such a character that they will directly and peculiarly affect
property within the boundaries of the City of Tiburon and the pur-
poses sought to be accomplished can best be aC,complished by conduct
of proceedings ~or the scheme of work by Sanitary District No.2
of Marin County; and
WHEREAS, the pUblic interest and convenience will be served
by undertaking and completing said project~
NOW, THEREFO~, IT IS ORDERED, as follows:
1. That consent be, and the same is hereby, granted to said
Sanitary District No.2 of Marin County to acquire and construct
said improvements, as described in said Resolution Requesting Consent,
and to make such changes and modifications therein as may be proper
or advisable in the manner provided by law,
2. That consent be, and the same is hereby, g~anted to said
Sanitary District No.2 of Marin County to open all such public
streets as are required for the installation of said improvements.
All work pertaining to said project shall be done under the direc-
tion of the District Engineer and to the satisfaction of the City
Engineer of said City, and in conformity with good engineering
practice. Said District Engineer shall require of the cqntractor
that all of the provisions of the specifications are complied with
by the contractor, to the end that no greater amount of ditches are
open at any time than is necessary, that they shall be adequately
lighted and barricaded, and that they shall be promptly backfilled,
and that the pavement shall be restored with materials of like
quality and character as those existing therein at the time of such
work and to its former conditi.on and state of usefulness as nearly
as may be.
3. That the City ~ngineer of said City be, and he is hereby,
authorized and directed to carry out the provisions of this resolu-
tion.
4. That the form of Resolution of Intention submitted to
this Council and the map indicatiqg the extent of territory inc,luded
in the pr9Posed district be, and the same are hereby, approved.
5. That the City Clerk be, and he :is herebr, directed to
file with the Secretary of said District a certified copy of this
Resolution.
