RESOLUTION NO. 280
A RESOLUTION GRANTING CONSENT OF THE CITY COUNCIL OF
THE CITY OF TIBURON TO THE SANITARY BOARD OF SANITARY
DISTRICT NO. 2 OF MARIN COUNTY TO UNDERTAKE PROCEEDINGS
TO ACQUIRE AND CONSTRUCT PUBLIC IMPROVEMENTS AND TO
PROVIDE THAT THE COSTS SHALL BE ASSESSED ON THE DISTRICT
BENEFITED UNDER APPROPRIATE SPECIAL ASSESSMENT AND
ASSESSMENT BOND PROCEEDINGS
TAYLOR ROAD SEWER ASSESSMENT DISTRICT
RESOLVED, by the City Council of the City of Tiburon, Calif-
ornia, that
WHEREAS, the Sanitary Board of Sanitary District No.2 of
Marin County has filed with this Council a certified copy of its
resolution requesting consent of this Council to undertake appro-
priate special assessment and assessment bond proceedings for the
acquisition and construction of public improvements and to assess
the cost thereof on the lands described in said Resolution;
WHEREAS, said work will be done in streets, highways and
public places in said City over which this Council has jurisdiction;
WHEREAS, said acquisitions and improvements to be made are
of such a character that they will directly and peculiarly affect
property within the boundaries of the City of Tiburon and the pur-
poses sought to be accomplished can best be accomplished by conduct
of proceedings for the scheme of work by Sanitary District No.2
of Marin County; and
WHEREAS, the public interest and convenience will be served
by undertaking and completing said project;
NOW, THEREFORE, IT IS ORDERED, as follows:
1. That consent be, and the same is hereby, granted to said
Sanitary District No. 2 of Marin County to acquire and construct
said improvements; as described in said Resolution Requesting Consent,
and to make such changes and modifications therein as may be proper
or advisable in the manner prOVided by law.
2. That consent be, and the same is hereby, granted to said
Sanitary District No. 2 or Marin County to open all such public
streets as are required ror the installation or said improvements.
Allwork pertaining to said project shall be done under the direc-
tion or the District Engineer and to the satisraction or the City
Engineer or said City, and in conrormity with good engineering
practice. Said District Engineer shall require or the contractor
that all or the provisions or the specirications are complied with
by the contractor, to the end that no greater amount or ditches are
open at any time than is necessary, that they shall be adequately
lighted ~nd barricaded, and that they shall be promptly backrilled,
and that the pavement shall be restored with materials or like
quality and character as those existing therein at the time Qr such
work and to its rormer condition and state or userulness as nearly
as may be.
3. That the City ~ngineer or said City be, and he is hereby,
authorized and directed to carry out the provisions or this resolu-
tion.
4. That the rorm or Resolution or Intention submitted to
this Council and the map indicati~ the extent or territory inc~uded
in the pr~posed district be, and the same are hereby, approved.
5. That the City Clerk be, and he :is hereb~, directed to
rile with the Secretary or said District a certiried copy or th~e
Resolution.
