RESOLUTION NO. 388
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TIBURON CALLING SPECIAL ELECTION TO SUBrrrT
QUESTION OF ~TNEXATION TO ELECTORS RESIDING IN
TERRITORY PROPOSED TO BE ANNEXED IN NEST
PENINSULA ANNEXATION NO. 2 (EAGLE ROCK-BAYVIEt']
HEIGHTS-BEL AIRE)
t'niEREAS, Resolution No. 387, adopted by the City Council
of the City of Tiburon on August 18, 1971, pursuant to the provisions
of Section 35121.1 of the Government Code of the State of California
(hereafter Government Code), found that a majority protest had not
been made as required by Section 35121 of the Government Code; and
WHEREAS, Section 35122 of the Government Code requires that
the Legislative Body of the City of Tiburon calls a special
election without delay and submit to the electors residing in the
territory proposed to be annexed the question of whether it shall
be annexed to and incorporated within the City of Tiburon; and
t'ffiEREAS, the City Council hereby finds that the value of
the territory proposed to be annexed in the ~mST PENINSULA ANNEXATION
NO. 2 (EAGLE ROCK-BAYVIEW HEIGHTS-BEL AIRE) does not equal one-half,
or more, of that within the City of Tiburon, as shown by the last
equalized assessment rolls; and
WHEREAS, the City Council further finds that the number of
qualified electors in the said territory does not equal one-half,
or more, of the number of qualified electors within the City of
Tiburon as shown by the County registration of voters;
NOlol7 THEREFORE, BE IT RESOLVED, that the City Council of the
City of Tiburon does hereby call a special election for Tuesday, the
19 day of October, 1971, for submission to the electors res1ding
In the territory proposed to be annexed, designated as WEST
PENINSULA ANNEXATION NO.2 (EAGLE ROCK-BAYVIEW HEIGHTS-BEL AlRE),
the question of whether said territory shall be annexed to and
incorporated within the City of Tiburon.
PASSED AND ADOPTED at an adjourned meeting of the City Council
of the City of Tiburon held on August 18, 1971, by the following vote:
