RESOLUTION NO. 387
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TIBURON FINDING AND DECLARING THAT A
L'lAJORITY PROTEST HAS NOT BEEN r-mDE TO HEST
PENINSULA ANNEXATION NO. 2 (EAGLE ROCK-BAYVIEt.!
HEIGHTS-BEL A~RE)
~mEREAS, on July 13, 1971, the City Council of the City of
Tiburon adopted Resolution No. 375 declaring its intention to
call a special hearing and setting a time and place for hearing
of protests to the villST PENINSULA ANNEXATION NO. 2 (EAGLE ROCK-
BAYVIEN HEIGHTS-BEL AIRE); and
~mEREAS, said resolution set the date of August 4, 1971,
at 7:30 p.m. at the City Council Chambers as the time and place
for hearing written protests against said proposed annexation; and
t1HEREAS, pursuant to the provisions of Section 35120 of the
Government Code of the State of California, the hearing was
recessed until August 16, 1971, at 5:45 p.m.; and
!ViHEREAS, at the time and place designated for reconvening
said hearing on August 16, 1971, written protests by public and
private owners totaling one-half the value of the territory pro-
posed to be annexed has not been filed; and
IVHEREAS, the said hearing was recessed to August 18, 1971,
at 7:30 p.m. for the presentation of evidence, and evidence having
been received; and
NON THEREFORE, BE IT RESOLVED, that pursuant.to the provi-
sions of Section 35121.1 of the Government Code of the State of
California, the City Council of the City of Tiburon hereby finds
and declares that written protests have not been filed by public
and private owners totaling one-half or more of the value of the
territory proposed to be annexed in that certain annexation proceed-
ing knmm as NEST PENINSULA ANNEXATION NO. 2 (EAGLE ROCK-BAYVIEN
HEIGHTS-BEL AIRE) and, accordingly, finds that a majority protest
to said annexation has not been made.
PASSED AND ADOPTED at an adjourned meeting of the City
Council of the City of Tiburon held on August 18, 1971, by the
follm17ing vote:
