HomeMy WebLinkAboutTC Res 1971-08-16 (2) RESOLUTION NO. 385 A RESOLUTION OF THE CITY COUNC IL OF THE CITY OF TIBURON FINDING AND DECIARING THAT A MAJORITY PROTEST HAS NOT BEEN MADE TO WEST PENINSUIA ANNEXATION NO.1 (STRAWBERRY). -WHEREAS, on July 13,1971, the City"Council of the City of Tiburon adopted Resolution No. 374 declaring its intention to call a special hearing and setting a t~e and place for hearing of protests to the WEST PENINSULA ANNEXATION No.1 (Strawberry); and WHEREAS, said resolution set the date of August 4, 1971, at 7:30 o'clock p.m. at the City Council Chambers as the time and place for hearing written protests against said proposed annexa- tion; and WHEREAS, pursuant to the provisions of Section 35120 of the Government Code of the State of California, the hearing was recessed until August 16, 1971, at 5:45 o'clock p.m., and WHEREAS, at the t~e and place designated for reconvening said hearing on August 16, 1971, written protests by public and private owners totaling one-half the value of the territory proposed to be annexed had not been fi~ed; NOW, THEREFORE, BE IT RESOLVED, that pursuant to the pro- visions of Section 35121.1 of the Government Code of the State of California, the City Council of the City of Tiburon hereby finds and declares that written protests have not been filed by public and private owners totaling one-half or more of the value of the territory proposed to be annexed in that certain annexation pro- ceeding known as WEST PENINSULA ANNEXATION NO. 1 (Strawberry) and, accordingly, finds that a majority protest to said annexation has not been made. PASSED AND ADOPTED at a meeting of the City Council of the City of.Tiburon held on August 16, 1971, by the following vote: AYES: NOES: r: COUNCILMEN: Fanning Sennett, Rice ABSENT: COUNCILMEN: COUNCILMEN: None BeCke~ ATTEST: ~
