A RESOLUTION OF THE CIlY COUNCIL OF THE CIlY OF TIBURON
AMENDING RESOLUTION NO. 349 - CLOSING LOWER RACOON JANE
TO KJTORIZED VEHICUIAR. TRAFFIC
WHEREAS, the public has historically used Lower Racoon Lane as a pedestrian
passageway; and
WHEREAS, the public has for many years last past acquired easements for
public pedestrian travel over said lane. and
WHEREAS, motorized vehicular traffic 1s now interfering with said foot
traffic, and is considered a nuisance to surrounding residents; and
WHEREAS, the majority of persons who own property adjacent to Lower Racoan
Lane have requrested the City close said Lane to motirized vehicular traffic; and
VBEREAS, said persons have offered to quitclaim to the City and right title
and interest they may have in the underlying fee title in Racoon Lane; and
~SJ the City of Tiburon is willing to accept said offers to quitclaim.
NOW, 'l'BEREFORE, BE IT RESOLVED:
1. Except for emergencies, Lower bcoan i8 hereby declared closed to
all moalrized vehicular traffic and the City Mlnager is directed
to take such action as may be deemed appropriate to effectuate
this resolution.
2. Limited vehicular traffic shall be allowed between centro West
Street and the upper portion of the property and improvements
located thereon, commonly known as 1800 Centro West Street, Tiburon.
3. The City Munger shall secure such quitclaim deeds as are available
for whatever interest the adjacent owners may have or claim, in the
underlying fee to Lower Racoon Lane.
PASSED AND ADOPTED at a regular meating of the City Council of the City of
Tiburon held on July 26, 1971, by the fotlowing vote:
