HomeMy WebLinkAboutTC Res 1971-07-13 (2) RESOLUTION NO. 375 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON DECU-I.RING ITS INTENTION TO CALL A SPECIAL ELECTION FOR THE PURPOSE OF SUBHISSION TO ELECTORS OF THE QUESTION OF ANNEXATION AND SETTING TIME AND PLi\CE OF HEARING OF PROTESTS, AND RESCINDING RESOLUTION NO. 372. WHEREAS, on the 28th day of June, 1971, a petition proposing that certain territory be annexed to the City of Tiburon was duly presented to and received by the City Council of the City of Tiburon; and WHEREAS, said petition specifically described the boundaries of the said territory to be annexed; and WHEREAS, a copy of said description specifically describing the boundaries of the said territory proposed to be annexed is attached hereto as Exhibit A and hereby incorporated herein and made a part hereof as if the same were fully set forth; and WHEREAS, the City Council of the City of Tiburon hereby finds that said petition is signed by not less than one-fourth of the qualified electors residing within said territory proposed to be annexed as shown by the Marin County registration of voters; and wHEREAS, said petition asks that said described new territory be annexed to the City of Tiburon; and WHEREAS, pursuant to Section 35122 of the Government Code of the State of California, the question of said annexation must be presented to the electors of the City of Tiburon and to the electors residing within the territory pro- posed to be annexed. NOW, THEREFORE, IT IS HEREBY RESOLVED that it is the intention of the City Council of the City of Tiburon to call Draft date: 7/9/71 1. Revised Sate: 7/13/71 a special election for the purpose of submitting to the electors residi:lg ~lithin the hereinabove described territory proposed to be C'l.nnexed and to the electors of the City of Tiburon the question of whether said described territory shall be annexed to the City of Tiburon. IT IS F:7RTIIER RESOLVED that said territory proposed to be annexed shall be designated and referred to upon the election ballots ~s West Peninsula Annexation No. 2 (Eagle Rock-Bayview Heights-Bel Aire). IT IS FURTHER RESOLVED that any person owning real property within said described territory may appear before the City Council of the City of Tiburon, at the Council Chambers, 80 Main Street, Tiburon, California, on the 4th day of August, 1971i at the hour of 7:30 o'clock P.M. concerning written protests against the annexation filed pursuant to Section 35120 of the Government Code of the State of California. IT IS FURTHER RESOLVED that Resolution No. 372 is rescinded.
