RESOLUTION NO.~
A RESOWTION OF THE CITY COUNCIL OF THE CITY OF
TIBURON WITHDRAWING ALL PORTIONS OF THE TIBURON
LIGHTING DISTRICT WITHIN THE CITY OF TIBURON FROM
SAID DISTRICT
WHEREAS the Tiburon Lighting District, formed under provisions of the Highway
Lighting District Act contained in the Streets and Highways COde of the State of
California, consists almost entirely but not exclusively of land ~lithin the City
of Tiburon;
AND WHEREAS Section 19290 of said Streets and Highways Code provides that any
territory within a city may be withdrawn from a Highway Lighting District by reso-
lution of the City Council;
AND WHEREAS on 26 September 1966 the City Council did adopt a Hinute Order
intended to accomplish the withdrawal of ter~itories within said city from said
district;
AND WHEREAS it ~~s subsequently determined that tbe intent of the Council re-
quired the adoption of a resolution in order to comply with the terms and condi-
tions of Section 19290 of the Streets and Highways Code of the State of California;
NOW, THEREFORE, BE IT RESOLVED:
THAT the territories of the Tiburon Lighting District lying within the boun-
daries of the City of Tiburon, more properly described on Exhibit A attached here-
to and made a part hereof, ought to be and are hereby withdrawn from the Tiburon
Lighting District;
THAT the City Clerk shall file a certified copy of this resolution with the
State Board of Equalization, Board of Supervisors of the County of ~arin and the
Assessor of the County of Marin;
THAT, in further compliance with the provisions of Section 19290 of the
Streets and Higm~ays Code, the Treasurer of the County of i~rin be asked to de-
liver to the Treasurer of the City of Tiburon all unencumbered funds, including
all taxes levied and collected by the District in any year in which taxes are
levied and collected by the District after the date of withdrawal on property
withdrawn from the District in proport~on to the assessed value of the real pro-
perty of the territory hereby withdra\fl1 and tbe portion remaining;
~T the Board of Supervisors of the County of Marin be asked to ~nstruct the
proper official of said County to deliver to the City of Tiburon an inventory of
any and all property belonging to said District, if any, together \lith a state-
ment of the value of said property.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tiburon held on June 14 , 1971, by the following vote:
