RESOLUTION NO. 448
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
DECIARING mE UNFENCED SWIMMING POOL LOCA'lED ON PROPERTY AT
7 CORTE IAS CASAS A PUBLIC NUISANCE
WHEREAS, pursuant to the prOV1S10ns of the Municipal Code of the City of Tiburon,
notice was duly given pursuant to the provisions of Section 24-3 of the L~nicipal
Code to the property owner of that certain real property located in the City of Tibu-
ron, known as 7 Corte Las Casas, to show cause why the unfenced swimming pool on said
property should not be condemned as a public nuisance and said nuisance be abated by
the fencing of said swimming pool, and why the costs ~f such abatement should not be
assessed on the property, such costs to constitute a lien thereon; and
WHEREAS, the matter \~S duly set for hearing .on June 26, 1972; and
WB!REAS, the matter duly came on for hearing on June 26, 1972, before the City
Councilf and the Council heard sworn evidence on the issue; and
WBBiEAS, no objections or protests to the proposed abatement of said public
nuisance were presented to the City Council;
NCM, THEREFORE, BE IT RESOLVED:
1. The City Council of the City of Tiburon does hereby declare the un-
fenced swimming pool at 7 Corte Las Casas, owned by Richard Miller,
to be a public nuisance;
2. The City Council finds that said nuisance is an emergency which, if un-
abated, constitutes a threat to the public safety, health and welfare;
3. The City Council hereby orders the City Manager of the City of Tiburon
to take all necessary steps to abate said nuisance following the expir-
ation of a period of seven (7) days from this date;
4. The City Council further orders that all costs of such abatement will
be assessed upon said property, and that such costs shall constitute
a lien upon such property until paid.
PASSED AND ADOPTED at a regular meeting of the City Council of the'City of Tiburon
held on June 26, 1972, by the following vote:
