RESOLUTION NO. 580
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TIBURON
REGARDING ACQUISITION AND CONDEMNATION OF PROPERTY KNOWN AS
MARIN COUNTY ASSESSOR'S PARCEL NO. 39-182-03
FOR RECREATION, PARK AND PRESERVATION OF OPEN SPACE PURPOSES
WHEREAS, the City of Tiburon, a municipal corporation of
the State10f California, has the power of eminent domain under the
Constitution and laws of the State of California; and
WHEREAS, public interest and necessity require that the
City acquire certain real property hereinafter described for recreation,
park, and preservation of open space purposes; and
WHEREAS, said real property is located within the boundaries
of the City of Tiburon, and is not now devoted to public use; and
WHEREAS, said real property is suitable, adaptable, neces-
sary and required for public use of the City, to wit: acquisition of
recreation, park and open space facilities; and
WHEREAS, the proposed public park and open space use is
planned and located in a manner which will be most compatible with the
greatest good and the least private injury; and
WHEREAS, the use of all of said property for City purposes
is a public use authorized by law;
NOW, THEREFORE, BE IT RESOLVED:
1. That the foregoing recitals are true and correct.
2. That the public interest and necessity require the
acquisition of fee simple title to the real property located in the
City of Tiburon, County of Marin, State of California, and particularly
described in Exhibit "A" (designated thereon as Assessor's Parcel No.
39-~82-03 ), attached hereto and incorporated herein by refer-
ence.
3. That the City acquire title to the said property for
said public purposes by donation, purchase or by eminent domain; the
City Attorney is hereby authorized and directed to initiate and prosecute
in the name of the City, condemnation proceedings for the acquisition of
title to said property or any part thereof.
PASSED AND ADOPTED at an adjourned regular meeting of the
City Council of the City of Tiburon held on October 25th , 1973,

That certain real property .situated in the Count.y of Marin, City of Tiburon,
