RESOLUTION NO.~
A RESOLUTION OF THE CITY COUNCIL OF mE CITY OF TrnURON
PROVIDING FOR WORK TO BE DONE ON WEER RACOON IANE AND
FOR ACQUISITION OF QUITCIAIM DEEDS.
WHEREAS, Upper Racoon Lane has historically been used by the persons who
reside on said street, and by members of the public for vehicular and pedestrian
passage; and
WHEREAS, the owners of the property abutting said Lane desire that it be
improved by the construction of an asphaltic concrete overlay over the entire
length of the road and a subdrain on the upper portion of the road; and
WHEREAS, said owne=s have requested that said improvements be made by the
City; and
WHEREAS, in the event City agrees to undertake said work, said owners have
offered to pay for same and have further offered to quitclaim to City any and all
right, title and interest they may have in and to said street, excepting, however,
an easement for road~my purposes over the said property in favor of said abutting
owners; and
WHEREAS, City is willing to undertake said work and has received a report
from the City Engineer that the cost of said work will be the sume of $6,300.00.
NOW, mERE FORE , BE IT RESOLVED as follows:
1. The City ~~nager is directed to solicit from the following named abutting
owners, the sums set opposite their names:

2. The City Manager is directed to solicit from each of the abutting owners,
listed as follows, a quitclaim deed of any and all right, title and interest he may
have in and to said ~treet, reserving to said o~~er, however, an easement for road-
way purposes in favor of said owner:

3. At such tiU'~ as the City Manager has collected the sums specified in
Paragraph 1 above, and has received the quitclaim deeds referred to in Paragraph 2
above, he is directed to forthwith t~ke the necessary steps to see that the work
described in Exhibi t '~" is undertaken e. nd completed.

4. The City of Tiburon intends to accept the quitclaim deeds referred to
in Paragra.ph 2 above.
5. In the event that the City Engineer determines that the cost of said
work will exceed the sum specified he~einabove, the City Manager shall notify the
said owners, prior to awarding a contract for the work, of the excess sum and
shall collect from each owner a pro-rata share of such excess pri~r to the award
of the contract.
6. In the event the cost is less than the City Engineer's estimate, then
the excess monies-collected shall be returned 9n a pro-rata basis to each of the
contributors.
7. In the event the City Manager is unable to collect the sums referred to
in Paragraphs land 5 above, and the quitclaims referred to in Paragraph 2 above,
within six months from the date hereof, then he is directed to retutn all monies
and quitclaim deeds which have been previously deposited with him and this reso-
lution shall thereupon become null and void.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tiburon held on AU2Ust 13th, 1973, by tbe following vote:
